7、法的或者不当的国家外汇管理局及其分支机构（以下简称外汇局）行政行为，保护公民、法人和其他组织的合法权益，监督和保障外汇局依法行使职权，发挥行政复议化解行政争议的主渠遒作用，推进法治速设，根据中华人民共和国行政复议法（以下简称行政.复议法）、中华人民共和国行政复议法实施条例中华人民共和国外Article1TheseMeasuresaredevelopedinaccordancewiththeAdministrativeReconsideration1.awofthePeoplesRepublicofChina(AdministrativeReconsideration1.aw)，theRegul

8、ationontheImplementationoftheAdministrativeReconsideration1.aw,theRegulationofthePeoplesRepublicofChinaonForeignExchangeAdministration,andotherrelevantprovisionsforthepurposesofpreventingandcorrectingillegalorimproperadministrativeactionstakenbytheStateAdministrationofForeignExchangeanditsbranches(f

9、oreignexchangeauthorities),protectingthelawfulrightsandinterestsofcitizens,legalpersons,andotherorganizations,supervisingandguaranteeingtheexerciseoffunctionsandpowersbyforeignexchangeauthoritiesinaccordancewiththelaw,maximizingtheroleofadministrativereconsiderationasthemainchannelforresolvingadmini

10、strativedisputes,andpromotingthebuildingoflegalorgans.Article2Whereacitizen,alegalperson,oranyotherorganizationconsidersthathisoritslawfulrightsandinterestshavebeeninfringeduponbyanyadministrativeactiontakenbytheforeignexchangeauthorityandfilesanapplicationforadministrativereconsideration,theseProce

11、duresshallapplyiftheStateAdministrationofForeignExchange(SAFE)oritsbranchwithanauthorityatalowerlevel(administrativereconsiderationauthority)acceptsanapplicationforadministrativereconsideration,triesanadministrativereconsiderationcase,andmakesanadministrativereconsiderationdecision.Article 3 Theadmi

12、nistrativereconsiderationworkoftheforeignexchangeauthorityshalladheretotheleadershipoftheCommunistPartyofChina.Administrativereconsiderationauthoritiesshall,whenperformingadministrativereconsiderationduties,followtheprinciplesoflegitimacy,impartiality,openness,efficiency,convenienceforthepeople,ands

13、en/iceforthepeople,insistoncorrectingmistakeswheneverdiscovered,andensurethecorrectimplementationoflawsandregulations.Article 4 Theleadinginternalinstitutionofanadministrativereconsiderationauthorityinchargeoflegalworkshallbetheadministrativereconsiderationinstitutionoftheauthority(administrativerec

14、onsiderationinstitution),whichshallhandleadministrativereconsiderationmattersinaccordancewiththelawandorganizethehandlingofadministrativeresponsemattersoftheauthority.汇管理条例等规定，制定本程序。笫二条公民、法人或者其他组织认为外汇局的行政行为侵犯其合法权益提出行政复议申请，国家外汇管理局及其有下级局的分局（以下简称“行政复议机关”）受理行政受议申请、审理行政复议案件、作出行政熨议决定，适用本程序。第三条外汇局行政烫议工作坚持中

15、国共产党的领导。行政更议机关履行行政复议职责，应当遵循合法、公正、公开、高效、便民、为民的原则，坚持有错必纠，保障法律、法规的正确实施。笫四条行政复议机关内设牵头负责法律工作的机构是本机关的行政复议机构（以下简称行政复议机构），依法办理行政复议事项，同时组织办理本机关的行政应诉事项。行政复议机构应当指定行Theadministrativereconsiderationinstitutionshalldesignateadministrativereconsiderationofficerstoberesponsibleforhandlingadministrativereconsiderati

16、oncases.Administrativereconsiderationofficersshallkeepconfidentialthestatesecrets,tradesecrets,andpersonalprivacytowhichtheyhaveaccessinthecourseofhandlingadministrativereconsiderationcases.Article 5 Theadministrativereconsiderationauthoritymayconductmediationwhenhandlingadministrativereconsideratio

17、ncases.Mediationshallbeconductedundertheprinciplesoflegalityandfreewill,withoutdamagingthenationalinterest,publicinterest,orotherslawfulrightsandinterests,orviolatingthecompulsoryprovisionsofanylaworregulation.Article 6 Acitizen,legalperson,oranyotherorganizationapplyingforadministrativereconsiderat

18、ioninaccordancewiththeAdministrativeReconsideration1.awistheapplicant,andtheforeignexchangeauthorityconductingtheadministrativeactionagainstwhichanapplicationforadministrativereconsiderationisfiledistherespondent.Acitizen,legalperson,oranyotherorganization,otherthantheapplicant,thatisapartyofinteres

19、ttotheadministrativeactionagainstwhichanapplicationforadministrativereconsiderationisfiledorthehandlingresultofanadministrativereconsiderationcasemayforparticipationintheadministrativereconsiderationasathirdparty,orbenotifiedbytheadministrativereconsiderationinstitutiontoparticipateintheadministrati

20、vereconsiderationasathirdparty.Thefailureofathirdpartytoparticipateintheadministrativereconsiderationshallnotaffectthetrialofanadministrativereconsiderationcase.政复议人员负责办理行政复议案件。行政复议人员对办理行政复议案件过程中知悉的国家秘密、商业秘密和个人隐私，应当予以保密。笫五条行政复议机关办理行政复议案件，可以进行调解。调解应当遵循合法、自愿的原则，不得损害国家利益、社会公共利益和他人合法权益，不得违反法律、法规的强制性规定。第

21、六条依照行政.复议法申请行政复议的公民、法人或者其他组织是申请人，作出被申请行政复议的行政行为的外汇局是被申请人。申请人以外的同被申请行政复议的行政行为或者行政复议案件处理结果有利害关系的公民、法人或者其他组织，可以作为第三人申请参加行政复议，或者由行政焚议机构通知其作为第三人参加行政.复议；第三人不参加行政复议，不影响行政复议案件的审理。Ifanapplicantappliesforadministrative申请人申请行政复议，第reconsiderationorathirdpartyparticipatesintheadministrativereconsideration,heorsh

22、eshallsubmithisorherlawfulandvalididentifications.Iftheapplicantorthethirdpartyentrustsanyotherpersontoparticipateintheadministrativereconsideration,heorsheshallprovidehisorherlawfulandvalididentificationsandthoseoftheagentaswellasthepowerofattorney,whichshallspecifytheentrustedmatters,thecontentofa

23、uthority,andtheterm.Iftheapplicantorthirdpartymodifiesorrevokestheagentsauthority,heoritshallnotifytheadministrativereconsiderationinstitutioninwritingafteraffixingthesignatureorseal.ChapterIlApplicationforAdministrativeReconsiderationandAcceptanceArticle7Whereacitizen,legalperson,oranyotherorganiza

24、tionconsidersthattheadministrativeactiontakenbytheforeignexchangeauthorityhasinfringeduponhisoritslawfulrightsandinterests,heoritmayfirstfileanapplicationforadministrativereconsiderationwiththeadministrativereconsiderationauthoritywithin60daysfromthedatewhenheoritknowsorshouldhaveknownofsuchanadmini

25、strativeaction.Theapplicantmay,inaccordancewiththelaw,fileanadministrativelawsuitagainsttheadministrativereconsiderationdecisionwiththepeoplescourtunlessitisprescribedinlawsthattheadministrativereconsiderationdecisionisafinalruling.三人参加行政复议，应当提交合法有效身份证明文件。申请人、第三人委托他人代为参加行政复议的，应当提交自身及代理人的合法有效身份证明文件以及

26、授权委托书，授权委托书中应当载明委托事项、权限内容和期限；申请人、第三人变更或者解除代理人权限的，应当签名或者签章后书面告知行政复议机构。第二章行政复议申请和受理第七条公民、法人或者其他组织认为外汇局的行政行为侵犯其合法权益，可以自知道或者应当知道该行为之日起六十日内先向行政复议机关提出行政复议申请。对行政复议决定不服的，可以依法向人民法院提起行政诉讼，但是法律规定行政复议决定为最终裁决的除外。申请人因不可抗力或者其他正当理由耽误法定申请期限的，申请期限自障碍消除之日起继续计算。Iftheapplicantfailstofileanapplicationwithinthestatutoryti

27、melimitforfilinganapplicationduetoforcemajeureoranyotherjustifiablereason,thetimelimitforfilinganapplicationshallcontinuetobecalculatedfromthedatewhentheobstacleisremoved.Iftheforeignexchangeauthority,whentakinganadministrativeaction,failstoinformthecitizen,legalperson,oranyotherorganizationoftherig

28、httoapplyforadministrativereconsideration,theadministrativereconsiderationauthority,andthetimelimitforfilinganapplication,thetimelimitforfilinganapplicationshallbecalculatedfromthedatewhenthecitizen,legalperson,oranyotherorganizationknowsorshouldhaveknownoftherighttoapplyforadministrativereconsidera

29、tion,theadministrativereconsiderationauthority,andthetimelimitforfilinganapplication,providedthattheperiodshallnotexceedoneyearfromthedatewhenheoritknowsorshouldhaveknownofthecontentoftheadministrativeaction.Article8Acitizen,legalperson,oranyotherorganizationmayfileanapplicationforadministrativereco

30、nsiderationinwriting;andifitisdifficultfortheapplicanttofileawrittenapplication,theapplicantmayalsofileanoralapplication.(1) Ifanapplicationisfiledinwriting,thewrittenapplicationforadministrativereconsiderationmaybesubmittedinperson,bymailorInternetchannelsorothermethodsdesignatedbytheadministrative

31、reconsiderationauthority.Ifanapplicantsubmitsawrittenapplicationforadministrativereconsiderationbymail,suchwordsasadministrativereconsiderationshallbeindicatedontheenvelope.外汇局作出行政行为时，未告知公民、法人或者其他组织申请行政复议的权利、行政复议机关和申请期限的，申请期限自公民、法人或者其他组织知道或者应当知道申请行政复议的权利、行政复议机关和申请期限之日起计算，但是自知道或者应当知道行政行为内容之日起最长不得超过一年

32、。第八条公民、法人或者其他组织申请行政复议，可以书面申请；书面申请有困难的，也可以口头申请：（一）书面申请的，可以通过当面提交、邮寄或者行政复议机关指定的互联网渠道等方式提交行政复议申请书：通过邮寄方式提交行政复议申请书的，应当在信封注明“行政复议”字样。（二）口头申请的，行政复议机关应当当场记录申请人的基本情况、行政复议请求、申请行政复议的主要事实、理由和时间，交申请人核对或者向申请人宣读，并由其当场签名(2) Iftheapplicationisfiledorally,theadministrativereconsiderationauthorityshallmakeanon-the-sp

33、otrecordofthebasicinformationoftheapplicant,administrativereconsiderationrequest,andthemajorfactsandgroundsbasedonwhichtheapplicationforadministrativereconsiderationisfiled,andtherecordshallbeturnedovertotheapplicanttocheckorreadouttotheapplicant,andtherecordshallbeconfirmedonsitebytheapplicantbysig

34、natureorseal.Article9Anapplicantthatappliesforadministrativereconsiderationagainstanadministrativepenaltydecisionmadebytheforeignexchangeauthorityonthespotmayfileanapplicationforadministrativereconsiderationthroughtheforeignexchangeauthoritythathasmadetheadministrativepenaltydecision.Afterreceivinga

35、napplicationforadministrativereconsideration,theforeignexchangeauthoritymakingtheadministrativepenaltydecisionshalleffectivelymakerecordsandhandletheapplicationinatimelymanner;andifitdeemsitnecessarytomaintaintheadministrativepenaltydecision,itshallforwardtheapplicationtotheadministrativereconsidera

36、tionauthoritywithinfiveworkingdaysofreceivingtheapplicationforadministrativereconsideration.Article 10 Whereanapplicantconsidersthattheregulatorydocumentsasthebasisforanadministrativeactiontakenbytheforeignexchangeauthorityareillegal,heoritmay,whenapplyingforadministrativereconsiderationagainstthead

37、ministrativeaction,alsofileanapplicationfortheincidentalreviewoftheaforesaidregulatorydocuments.Theregulatorydocumentsasmentionedintheprecedingparagraphdonotincluderules.或者签章确认。第九条申请人对外汇局当场作出的行政处罚决定不服申请行政复议的，可以通过作出行政处罚决定的外汇局提交行政复议申请。作出行政处罚决定的外汇局收到行政复议申请后，应当做好记录、及时处理，经审查认为需要维持行政处罚决定的，应当自收到行政复议申请之日起五个

38、工作日内转送行政复议机关。笫十条申请人认为外汇局的行政行为所依据的规范性文件不合法，在对行政行为申请行政复议时可以一并提出对该规范性文件的附带审查申请。前款所称规范性文件不含规章。笫d一条申请人对外汇局行政行为不服的，向上一级外汇局申请行政复议。Article 11 Theapplicantmayfileanapplicationforadministrativereconsiderationagainstanadministrativeactiontakenbytheforeignexchangeauthoritywiththeforeignexchangeauthorityatthenex

39、thigherlevel.TheapplicantmayfileanapplicationforadministrativereconsiderationagainstanadministrativeactiontakenbytheSAFEwiththeSAFE;andtheapplicantmay,inaccordancewiththelaw,fileanadministrativelawsuitagainsttheadministrativereconsiderationdecisionmadebytheSAFEwiththepeoplescourtorapplytotheStateCou

40、ncilforafinalruling.Article 12 Theadministrativereconsiderationauthorityshallconductanexaminationwithinfiveworkingdaysofreceivinganapplicationforadministrativereconsideration,andaccepttheapplicationifitmeetstheacceptanceconditionsasprescribedintheAdministrativeReconsideration1.aw.Ifanapplicationfora

41、dministrativereconsiderationdoesnotmeettheconditionsforacceptance,itshalldecidenottoaccepttheapplicationandexplainthereasonthereforandinformtheapplicantinwriting;andiftheapplicationisnotunderitsjurisdiction,itshallalsoinformtheapplicantoftheadministrativereconsiderationauthorityhavingjurisdictionini

42、tsdecisionofnotacceptingtheapplication.Ifanadministrativereconsiderationauthorityfailstomakeadecisiontorejectanapplicationupontheexpiryofthetimelimitforthereviewofanapplicationforadministrativereconsideration,theapplicationshallbedeemedacceptedfromthedateofexpiryofthetimelimitforreview.对国家外汇管理局作出的行政

43、行为不服的，向国家外汇管理局申请行政复议；对国家外汇管理局行政复议决定不服的，可依法向人民法院提起行政诉讼，也可以向国务院申请最终裁决。第十二条行政复议机关应当自收到行政复议申请之日起五个工作日内进行审查，符合行政复议法规定的受理条件的，予以受理：不符合受理条件的，决定不予受理并说明理由，书面告知申请人；不属于本机关管辖的，还应当在不予受理决定中告知申请人有管辖权的行政复议机关。行政夏议申请的审查期限届满，行政复议机关未作出不予受理决定的，审查期限届满之日起视为受理。第十三条行政复议申请材料不齐全或者表述不清楚，无法判断行政复议申请是否符合受理条件的，行政复议机关应当自收到申请之日起五个工作日

44、内书面通知申请人补Article 13 Wheretheapplicationmaterialsforadministrativereconsiderationareincompleteorhaveunclearstatements,makingitimpossibletodeterminewhethertheapplicationforadministrativereconsiderationmeetstheconditionsforacceptance,theadministrativereconsiderationauthorityshallnotifyinwritingtheappli

45、canttomakesupplementsorcorrectionswithinfiveworkingdaysofreceivingtheapplication.Thenoticeofsupplementsorcorrectionsshallindicateallnecessarysupplementsandcorrections.Theapplicantshallsubmitsupplementsorcorrectionstotheadministrativereconsiderationauthoritywithin10workingdaysofreceivingthenoticeofsu

46、pplementsorcorrections,andifsupplementsorcorrectionsarenotmadewithintheprescribedtimelimitduetoanyjustifiablereason,theadministrativereconsiderationauthoritymayextendthereasonableperiodformakingsupplementsorcorrections.Iftheapplicantfailstomaketherequiredsupplementsorcorrectionswithintheprescribedti

47、melimitwithoutanyjustifiablereason,itshallbedeemedthattheapplicanthaswaivedtheapplicationforadministrativereconsiderationandthecaseshallberecordedonfile.Afterreceivingthesupplementsorcorrections,theadministrativereconsiderationauthorityshallhandletheminaccordancewithArticle12oftheseProcedures.Articl

48、e 14 Wheretheadministrativereconsiderationauthorityfindsthatanapplicationforadministrativereconsiderationdoesnotsatisfytherequirementsspecifiedinparagraph1ofArticle30oftheAdministrativeReconsideration1.awafteracceptingtheapplication,itshalldecidetorejecttheapplicationandexplainthereasontherefor.Chap

49、terIIITrialofAdministrativeReconsideration正。补正通知应当一次性载明需要补正的事项。申请人应当自收到补正通知之日起十个工作日内向行政复议机关提交补正材料，有正当理由不能按期补正的，行政复议机关可以延长合理的补正期限。申请人无正当理由逾期不补正的，视为申请人放弃行政复议申请，并记录在案。行政复议机关收到补正材料后，按照本程序第十二条的规定处理。笫十四条行政复议机关受理行政复议申请后，发现该行政复议申请不符合行政复议法第三十条第一款规定的，应当决定驳回申请并说明理由O第三章行政复议审理笫十五条行政复议机关受理行政复议申请后，依照彳：云适用普通程序或者简易程序进行审理。Article15Afteracceptinganapplicati
