4、tryofAgriculture,HusbandryandFisheryonOctober20,1987)ChapterIGeneralProvisionsArticle 1 TheseDetailedRulesareformulatedinaccordancewithArticle34oftheFisheriesLawofthePeoplesRepublicofChina(hereinafterreferredtoasthe“FisheriesLaw).Article 2 ForthepurposesoftheFisheriesLawandtheseDetailedRules,thefoll

5、owingtermsshallbedefinedasfollows:1. “internalwatersofthePeoplesRepublicofChina”meanstheseaslocatedonthelandwardsideofthebaselinefromtheterritorialseaofthePeoplesRepublicofChina,aswellasrivers,lakesandotherinlandwaters.2. “allotherseasunderthejurisdictionofthePeoplesRepublicofChinameanstheseasunderI

6、hejurisdictionofthePeoplesRepublicofChinainaccordancewiththelawsofthePeoplesRepublicofChinaandtheinternationaltreaties,agreementsorotherrelevantinternationallawsconcludedoraccededtobythePeoplesRepublicofChina.3. “fisherywaters“meansthespawningfans,feedingfarms,winteringfarms,andmigratorypassagesoffi

7、sh,shrimps,crabs,andshellfishaswellastheaquaticfarmsforfish,shrimps,crabs,shellfish,algaeandotheraquaticplantsandanimalsonthewatersunderIhejurisdictionofthePeoplesRepublicofChina.ChapterIIFisherySupervisionandAdministrationArticle3FiSherysupervisionandadministrationshallbesubjecttounifiedleadershipa

8、ndgradedadministrationbythestate.Fishingactivitiesonwatersoutside*thelineofclosedfishingareasforbottomtrawlfishingbymotorizedfishingvessels”asdelineatedbytheStateCouncilthatareunderthejurisdiction（一）“中华人民共和国的内水”，是指中华人民共和国领海基线向陆一侧的海域和江河、湖泊等内陆水域。（二）“中华人民共和国管辖的一切其他海域”，是指根据中华人民共和国法律，中华人民共和国缔结、参加的国际条约、协定

9、或者其他有关国际法，而由中华人民共和国管辖的海域。（三）“渔业水域”，是指中华人民共和国管辖水域中鱼、虾、蟹、贝类的产卵场、索饵场、越冬场、涧游通道和鱼、虾、蟹、贝、藻类及其他水生动植物的养殖场所。第二章渔业的监督管理第三条国家对渔业的监督管理，实行统一领导、分级管理。国务院划定的“机动渔船底拖网禁渔区线”外侧，属于中华人民共和国管辖海域的渔业，由国务院渔业行政主管部门及其所属的海区渔政管理机构监督管理；“机动渔船底拖网禁渔区线”内侧海域的渔业，除国家另有规定者外， 由毗邻海域的省、自治区、直辖市人民政府渔业行政主管 部门监督管理。内陆水域渔业，按照行政区划由当地县级以上地方人民政 府渔业行政

10、主管部门监督管理；跨行政区域的内陆水域渔 业，由有关县级以上地方人民政府协商制定管理办法，或 者由上一级人民政府渔业行政主管部门及其所属的渔政监 督管理机构监督管理：跨省、自治区、直辖市的大型江河 的渔业，可以由国务院渔业行政主管部门监督管理。重要的、涧游性的共用渔业资源，由国家统管理；定居 性的、小宗的渔业资源，由地方人民政府渔业行政主管部 门管理。ofthePeoplesRepublicofChinashallbesupervisedandadministeredbythefisherj,administrativedepartmentoftheStateCouncil;andfishin

12、mentadjacenttotheseas,unlessitisotherwiseprovidedforbythestate.Fishingactivitiesoninlandwatersshallbesupervisedandadministeredbythefisheryadministrativedepartmentsoflocalpeoplesgovernmentsatorabovethecountylevelaccordingtoadministrativedivisions.Withrespecttofishingoninlandwatersacrossadministrative

13、regions,Iherelevantlocalpeoplesgovernmentsatorabovethecountylevelthroughconsultationsshallformulatetheadministrativemeasuresthroughconsultation,orthefisheryadministrativedepartmentofthepeoplesgovernmentatthenexthigherlevelandtheirsubordinatesupervisoryinstitutionsoffisheryadministrationshalltakechar

14、geofthesupervisionandadministrationthereof.Fishinginlargeriversacrossdifferentprovinces,autonomousregions,andmunicipalitiesdirectlyundertheCentralGovernmentmaybesupervisedandadministratedbythefisheryadministrativedepartmentoftheStateCouncil.Importantandmigratorysharedfisheryresourcesshallbeadministe

15、redbythestateinaunifiedmannerandsettledandsmallfisheryresourcesshallbeadministeredbythefisheryadministrativedepartmentsofthelocalpeoplesgovernments.第四条机动渔船底拖网禁渔区线”内侧海域的 渔业，由有关省、自治区、直辖市人民政府渔业行政主管 部门协商划定监督管理范围；划定监督管理范围有困难 的，可划叠区或者共管区管理，必要时由国务院渔业行政 主管部门决定。Article4Thescopeofsupervisionandadministrationo

16、ffisheryonwatersinside“thelineofclosedfishingareasforbottomtrawlfishingbymotorizedfishingvessels*,shallbedelineatedbythefisheryadministrativedepartmentsofrelevantprovinces,autonomousregionsandmunicipalitiesdirectlyundertheCentralGovernment;ifitisdifficulttodelimitthescopeofsupervisionandadministrati

17、on,relatedareasmaybedividedintooverlappingareasorco-adninisteredareasforpurposesofadministration,and,wherenecessary,thefisheryadministrativedepartmentoftheStateCouncilmaymakeadecisiontodeterminetherelevantscope.第五条渔场和渔汛生产，应当以渔业资源可捕量为依据，按照有利于保护、增殖和合理利用渔业资源，优 先安排邻近地区、兼顾其他地区的原则，统筹安排。Article5Productioni

18、nfishingfarmsandduringfishingseasonsshallbesubjecttooverallarrangementsbasedontheallowablecatchesoffisheryresourcesandundertheprinciplesofbeingconducivetotheprotection,proliferationandrationaluseoffisheryresourcesandgivingprioritytothearrangementforadjacentareaswithdueregardtootherareas.舟山渔场冬季带鱼汛，浙江

19、渔场大黄鱼汛，闽东、闽中渔 场大黄鱼汛，吕泗渔场大黄鱼、小黄鱼、自昌鱼汛，渤海渔 场秋季对虾汛等主要渔场、渔汛和跨海区管理线的捕捞作 业，由国务院渔业行政主管部门或其授权单位安排。Fishingoperationsinmajorfishingfarms,duringfishingseasons,andalongmanagementlinesacrossdifferentseaareas,suchasduringthefishingseasonofoverwinteringhairtailinthefishingfarmsoftheZhoushanIslands,thefishingseason

21、dministrativedepartmentoftheStateCounciloritsauthorizedentities.第六条 国务院渔业行政主管部门的渔政渔港监督管理机构，代表国家行使渔政渔港监督管理权。Article6TheregulatoryagenciesoffisheryadministrationandfishingportsunderthefisheryadministrativedepartmentoftheStateCouncilshallexercisethepowertosuperviseandadministerfisheryadministrationandf

22、ishingportsonbehalfofthestate.国务院渔业行政主管部门在黄渤海、东海、南海三个海区 设渔政监督管理机构；在重要渔港、边境水域和跨省、自 治区、直辖市的大型江河，根据需要设渔政渔港监督管理 机构。ThefisheryadministrativedepartmentoftheStateCouncilshallestablishtheregulatoryagenciesoffisheryadministrationinthreeseaareas,includingtheYellowSeaandBohaiSea,theEastChinaSeaandtheSouthChina

23、Sea;andshallestablishregulatoryagenciesoffisheryadministrationandfishingportsatimportantfishingports,forborderwaters,andalonglargeriversacrossdifferentprovinces,autonomousregions,andmunicipalitiesdirectlyundertheCentralGovernment,asisneeded.第七条渔政检查人员有权对各种渔业及渔业船舶的证件、渔船、渔具、渔获物和捕捞方法，进行检查。Article 7 Fish

24、eryinspectorshavetheauthoritytocheckthevariousfishingandfishingvesselcertificates,fishingvessels,fishinggears,catchesandfishingmethods.渔政检查人员经国务院渔业行政主管部门或者省级人民政 府渔业行政主管部门考核，合格者方可执行公务。第八条渔业行政主管部门及其所属的渔政监督管理机构，应当与公安、海监、交通、环保、工商行政管理Fisheryinspectorsshallbeassessedbythefisheryadministrativedepartmentoft

25、heStateCouncilorthefisheryadministrativedepartmentsoftheprovincialpeoplesgovernments,andonlythosewhoarequalifiedmayperformtheirofficialduties.Article 8 Thefisheryadministrativedepartmentanditssubordinateregulatoryagenciesoffisheryadministrationshallcooperatewiththepublicsecurityauthorities,maritimes

26、urveillanceforces,transportdepartments,environmentalprotectiondepartments,administrationsforindustryandcommerce,andotherrelevantdepartmentstoconductsupervisoryinspectionoftheimplementationoffisherylawsandregulations.Article 9 Amassmanagementorganizationforfisheryprotectionshallmanagefisheryprotectio

27、ninaccordancewiththelawundertheprofessionalguidanceofthefisheryadministrativedepartmentofthelocalpeoplesgovernmentatorabovethecountylevel.ChapterIIIAquacultureIndustryArticle10Anentityownedbythewholepeopleandacollectively-ownedentitythatusesthewatersurfaceorintertidalzoneownedbythewholepeopletoengag

28、einaquacultureproductionshallapplyforanaquaculturelicensewiththelocalpeoplesgovernmentatorabovethecountylevel.Wherethewatersurfaceorintertidalzoneownedbythewholepeopleiswithintheadministrativeareaofacounty,thepeoplesgovernmentofthecountyshallissueanaquaculturelicense;forthoseacrossdifferentcounties,

29、thepeoplesgovernmentsofrelevantcountiesshallissueaquaculturelicensesthroughconsultation,andwhennecessary,thepeople,sgovernmentatahigherlevelshalldecidewhichgovernmentistoissueaquaculturelicenses.等有关部门相互协作，监督检查渔业法规的施行。第九条群众性护渔管理组织，应当在当地县级以上人民政府渔业行政主管部门的业务指导下，依法开展护渔管理工作。第三章养殖业第十条使用全民所有的水面、滩涂，从事养殖生产的全民

30、所有制单位和集体所有制单位，应当向县级以上地方人民政府申请养殖使用证。全民所有的水面、滩涂在一县行政区域内的，由该县人民政府核发养殖使用证：跨县的，由有关县协商核发养殖使用证，必要时由上级人民政府决定核发养殖使用证。Article11Whereanentitythathasobtainedanaquaculturelicensefailstoengageinaquacultureproductionwithoutjustification,oritsaquaculturecapacityislessthan60%ofthelocalaverageaquaculturecapacityofsim

31、ilaraquaculturewaters,relevantwatersurfaceandintertidalzonesshallbedeemedtohavebeenidled.Article12Thenaturalspawningfarms,aquaculturefarms,feedingfarmsandimportantmigratorypassagesoffish,shrimps,crabs,shellsandalgaeonthewatersurfaceorinintertidalzonesownedbythewholepeoplemustbeprotectedandshallnotbe

32、designatedasaquaculturefarms.Article 13 Therequisitionofthewatersurfaceorintertidalzonesownedbyacollectiveforstateconstructionshallbegovernedbythelandadministrationlawsandregulationsofthestate.ChiIPterIVFishingIndustryArticle 14 Thedivisionofinlandseafishingfarmsandopenseafishingfarms:1. Thefishingf

33、armsintheBohaiSeaandtheYellowSeaareinlandseafishingfarms.2. TheseaareainsidethelineconnectingthefollowingfourbasicpointsistheinlandseafishingareaoftheEastChinaSea;theseaareaoutsidethelineconnectingthefollowingfour第H-一条领取养殖使用证的单位，无正当理由未从事养殖生产，或者放养量低于当地同类养殖水域平均放养量60%的，应当视为荒芜。第十二条全民所有的水面、滩涂中的鱼、虾、蟹、贝、藻类

34、的自然产卵场、繁殖场、索饵场及重要的涧游通道必须予以保护，不得划作养殖场所。第十三条国家建设征用集体所有的水面、滩涂,按照国家土地管理法规办理。第四章捕捞业第十四条近海渔场与外海渔场的划分：()渤海、黄海为近海渔场。(二)下列四个基点之间连线内侧海域为东海近海渔场;四个基点之间连线外侧海域为东海外海渔场。四个基点是：basicpointsistheopenseafishingareaoftheEastChinaSea.Thefourbasicpointsare:(l)31oN,125oE;1、北纬33度,东经125度;(2)29oN,125oE;2、北纬29度,东经125度;(3)28oN,1

TheseaareainsidethefollowingtwoisobathsistheinlandseafishingareaoftheSouthChinaSea;theseaareaoutsidethetwoisobathsistheopenseafishingareaoftheSouthChinaSea.Thetwoisobathsare:(1) the80-meterisobatheastof112oE;and(2) the100-meterisobathwestof112

36、oE.(三)下列两条等深线之内侧海域为南海近海渔场：两条等深线之外侧海域为南海外海渔场。两条等深线是：1、东经112度以东之80米等深线；2、东经112度以西之100米等深线。Article 15 Thestateimplementsafishinglicensesystemforthefishingindustry.Anoperatorthatengagesinopen-seaorocean-goingfishingshallfileanapplication,whichshallbesubmittedtothefisheryadministrativedepartmentoftheStat

37、eCouncilforapprovaluponexaminationandverificationbythefisherj,administrativedepartmentofthepeoplesgovernmentoftheprovince,autonomousregion,ormunicipalitydirectlyundertheCentralGovernment.Afishingvesselthatengagesin第十五条国家对捕捞业，实行捕捞许可制度。从事外海、远洋捕捞业的，由经营者提出申请，经省、自治区、直辖市人民政府渔业行政主管部门审核后，报国务院渔业行政主管部门批准。从事外海

41、ntylevel.TheformatoffishinglicensesshallbeformulatedbythefisheryadministrativedepartmentoftheStateCouncil.第十六条在中华人民共和国管辖水域，中外合资、中外合作经营的渔业企业，未经国务院有关主管部门 批准，不得从事近海捕捞业。第十七条有下列情形之一的，不得发放捕捞许可证：Article 16 OnthewatersunderthejurisdictionofthePeoplesRepublicofChina,noChinese-foreignequityjointventureoraChin

42、ese-foreigncontractualjointventurefisheryenterpriseshallengageinthefishingindustryoninlandseaswithouttheapprovaloftherelevantcompetentdepartmentoftheStateCouncil.Article 17 Underanyofthefollowingcircumstances,nofishinglicenseshallbeissued:(1) Afishinggearorfishingmethodthatdamagesfisheryresourcesori

43、sexpresslyprohibitedisused.(2) Fishingvesselsaremanufactured,renovatedortransformed,purchasedorimportedwithoutundergoingtheapprovalformalitiesaccordingtotheprovisionsofthestate.(3) Theoperatortailstoobtainsuchcertificatesasfisheryvesselcertificates,navigationvisabooks,on-dutycrewscertificates,regist

44、ersofvessels,andfishermencertificateaccordingtotheprovisionsofthestate.Article 18 Forrecreationalsportfishingandmanualcollectionofsporadicaquaticproductsinintertidalzonesthathavenotbeenculturedormanaged,anapplicationforafishinglicenseisnotrequiredtobefiled,butmanagementshallbestrengthenedtopreventda

45、magetofisherj,resources.Specificadministrativemeasuresshallbeformulatedbythepeoplesgovernmentsatorabovethecountylevel.Article 19 Whoeverengagesinfishinginclosedfishingareasorclosedfishingperiods,usesprohibitedfishinggearsandfishingmethods,orcatchesthevarietiesoffisheryresourcesunderkeyprotectionfors

46、cientificresearchorforotherspecialpurposesmustbesubjecttoapprovalbythefisheryadministrativedepartmentofthepeoplesgovernmentatorabovetheprovinciallevel.ChapterVProliferationandProtectionofFisheryResources(一)使用破坏渔业资源、被明令禁止使用的渔具或者捕捞方法的；(二)未按国家规定办理批准手续，制造、更新改造、购置或者进口捕捞渔船的；(三)未按国家规定领取渔业船舶证书、航行签证簿、职务船员证书、

47、船舶户口簿、渔民证等证件的。第十八条娱乐性游钓和在尚未养殖、管理的滩涂手工采集零星水产品的，不必申请捕捞许可证，但应当加强管理，防止破坏渔业资源。具体管理办法由县级以上人民政府制定。第十九条因科学研究等特殊需要，在禁渔区、禁渔期捕捞，或者使用禁用的渔具、捕捞方法，或者捕捞重点保护的渔业资源品种，必须经省级以上人民政府通业行政主管部门批准。第五章渔业资源的增殖和保护第二十条禁止使用电力、鱼鹰捕鱼和敲?作业。在特定水域确有必要使用电力或者鱼鹰捕鱼时，必须经省、 自治区、直辖市人民政府渔业行政主管部门批准。Article20Theuseofelectricity,ospreyandship-hull

48、knocking(knownast4Qiaogu)infishingshallbeprohibited.Whereitisnecessarj,toengageinfishingbyelectricityorospreyonspecificwaters,approvalofthefisheryadministrativedepartmentofthepeoplesgovernmentoftheprovince,autonomousregion,ormunicipalitydirectlyundertheCentralGovernmentmustbeobtained.第二一条县级以上人民政府渔业行政主管部 门，应当依照本实施细则第三条规定的管理权限，确定重 点保护的渔业资源品种及采捕标准。在重要鱼、虾、蟹、 贝、藻类，以及其他重要水生生物的产卵场、索饵场、越 冬场和涧游通道，规定禁渔区和禁渔期，禁止使用或者限 制使用的油具和捕捞方法，最小网目尺寸，以及制定其他 保护渔业资源的措施。Article21Thefisheryadministrativedepartmentofapeoplesgovernmentatorab
