3、tiveRegulationsonNovember29,2020.)ChapterIGeneralProvisionsArticle 1 TheseRegulationsareformulatedinaccordancewiththeprovisionsoftheCivilAviationLawofthePeoplesRepublicofChinawithaviewtoenhancingtheadministrationofcivilaircraftnationality,ensuringsafetyincivilaviationactivitiesandmaintainingorderinc

4、ivilaviationactivities.Article 2 ThefollowingcivilaircraftshallenterintonationalityregistrationpursuanttotheseRegulations:中华人民共和国民用航空器国籍登记条例（1997年10月21日中华人民共和国国务院令第232号发布根据2020年11月29日国务院关于修改和废止部分行政法规的决定修订）第一章总则第一条为了加强对民用航空器国籍的管理，保障民用航空活动安全，维护民用航空活动秩序，根据中华人民共和国民用航空法的规定，制定本条例。第二条下列民用航空器应当依照本条例进行国籍登记：(

5、1) civilaircraftofstateinstitutionsofthePeoplesRepublicofChina;(2) civilaircraftofacorporateenterpriseestablishedinaccordancewiththelawsofthePeoplesRepublicofChina;(3) othercivilaircrafttheregistrationofwhichisapprovedbythecompetentdepartmentofcivilaviationundertheStateCouncil.Civilaircraftleasedfro

6、mabroadtheleaseholderofwhichconformstotheprovisionsoftheprecedingparagraphandthecrewmembersofthesaidcivilaircraftareprovidedbytheleaseholdermayapplyfortheregistrationofthenationalityofthePeoplesRepublicofChina;however,theoriginalnationalityregistrationofthesaidcivilaircraftmustfirstbenullified.Artic

7、le 3 AcivilaircraftacquiresthenationalityofthePeoplesRepublicofChinauponregistrationinaccordancewithlaw.Article 4 Acivilaircraftshallnothavedualnationalities.AcivilaircraftwhoseforeignnationalityhasnotbeennullifiedshallnotapplyfornationalityregistrationinthePeoplesRepublicofChina;acivilaircraftwhose

8、nationalityofthePeoplesRepublicofChinahasnotbeennullifiedshallnotapplyfornationalityregistrationinforeigncountries.（一）中华人民共和国国家机构的民用航空器；（二）依照中华人民共和国法律设立的企业法人的民用航空器；（三）国务院民用航空主管部门准予登记的其他民用航空器。自境外租赁的民用航空器，承租人符合前款规定，该民用航空器的机组人员由承租人配备的，可以申请登记中华人民共和国国籍；但是，必须先予注销该民用航空器原国籍登记。第三条民用航空器经依法登记，取得中华人民共和国国籍。第四条民用

9、航空器不得具有双重国籍。未注销外国国籍的民用航空器，不得在中华人民共和国办理国籍登记；未注销中华人民共和国国籍的民用航空器，不得在外国办理国籍登记。Article 5 ThecompetentdepartmentofcivilaviationundertheStateCouncilshalltakechargeoftheworkofnationalityregistrationofcivilaircraftofthePeoplesRepublicofChina,setupacivilaircraftnationalityregistrationbookofthePeoplesRepublico

10、fChinawithuniformrecordingoftheparticularsrelatingtocivilaircraftnationalityregistration.Article 6 Acivilaircraftnationalityregistrationshallnotserveastheproofofownershipofthecivilaircraft.ChapterIINationalityRegistrationArticle7ForapplicationforcivilaircraftnationalityregistrationofthePeoplesRepubl

11、icofChina,anapplicantshalltruthfullyfillouttheapplicationformforcivilaircraftnationalityregistrationinaccordancewiththeformatprescribedbythecompetentdepartmentofcivilaviationundertheStateCouncilandpresentthefollowingdocumentstothecompetentdepartmentofcivilaviationundertheStateCouncil:(1) documentspr

12、ovingthelegalstatusoftheapplicant:(2) purchasecontractanddeliverydocumentsasproofsoftheobtainmentofownershipofthecivilaircraft;orleasecontractanddeliverj,documentsasproofsofpossessionofthecivilaircraft;(3) proofsofnothavingenteredintonationalityregistrationin第五条国务院民用航空主管部门主管中华人民共和国民用航空器国籍登记工作，设立中华人民

13、共和国民用航空器国籍登记簿，统一记载民用航空器的国籍登记事项。第六条民用航空器国籍登记，不得作为民用航空器所有权的证据。第二章国籍登记第七条申请中华人民共和国民用航空器国籍登记的，申请人应当按照国务院民用航空主管部门规定的格式如实填写民用航空器国籍登记申请书，并向国务院民用航空主管部门提交下列文件：（一）证明申请人合法身份的文件；（二）作为取得民用航空器所有权证明的购买合同和交接文书，或者作为占有民用航空器证明的租赁合同和交接文书；（三）未在外国登记国籍或者已注销外国国籍的证明；foreigncountriesorofnullificationofforeignnationality;(4)

14、otherrelevantdocumentsrequiredtobepresentedbythecompetentdepartmentofcivilaviationundertheStateCouncil.Article8ThecompetentdepartmentofcivilaviationundertheStateCouncilshall,withinsevenworkingdaysfromthedateofreceiptofanapplicationforcivilaircraftnationalityregistration,examinetheapplicationformandr

15、elevantdocumentsofproof;acertificateofcivilaircraftnationalityregistrationofthePeoplesRepublicofChinashallbeissuedtotheapplicantiftheapplicationconformstotheprovisionsoftheseRegulationsuponexamination.Article 9 ThecompetentdepartmentofcivilaviationundertheStateCouncilshallcarrythefollowingparticular

16、sinthecivilaircraftnationalityregistrationbook:(1) nationalitymarkandregistrationmarkofthecivilaircraft;(2) nameofthemanufacturerofthecivilaircraft;(3) typeofthecivilaircraft;(4) plantserialnumberofthecivilaircraft;(5) nameandaddressoftheownerofthecivilaircraft;（四）国务院民用航空主管部门要求提交的其他有关文件。第八条国务院民用航空主管

17、部门应当自收到民用航空器国籍登记申请之日起7个工作日内，对申请书及有关证明文件进行审查；经审查，符合本条例规定的，应当向申请人颁发中华人民共和国民用航空器国籍登记证书。第九条国务院民用航空主管部门应当在民用航空器国籍登记簿中载明下列事项：（一）民用航空器国籍标志和登记标志；（二）民用航空器制造人名称；（三）民用航空器型号；（四）民用航空器出厂序号；（五）民用航空器所有人名称及其地址；(6) nameandaddressofthepossessorofthecivilaircraft;（六）民用航空器占有人名称及其地址:(7) registrationdaleofthecivilaircraft

18、;and（七）民用航空器登记日期;(8) nameoftheissuerofthecertificateofcivilaircraftnationalityregistration.Article 10 Thecivilaircraftnationalityregistrationcertificateshallbeplacedinaprominentpositioninthecivilaircraftforinspectionandexamination.Article 11 Intheeventofanyofthefollowingcircumstances,acivilaircrafth

19、avingobtainedthenationalityofthePeoplesRepublicofChinashallapplyforgoingthroughtheformalitiesofchangesinregistration:(1) changeintheownerorhis/heraddressofthecivilaircraft;(2) changeinthepossessororhis/heraddressofthecivilaircraft;and(3) othercircumstanceswhichcallforgoingthroughtheformalitiesofchan

20、gesinregistrationasprescribedbythecompetentdepartmentofcivilaviationundertheStateCouncil.Article 12 Intheeventofanyofthefollowingcircumstances,acivilaircrafthavingobtainedthenationalityofthePeoplesRepublicofChinashallapplyforthenullificationoftheregistration:（八）民用航空器国籍登记证书签发人姓名。第十条民用航空器国籍登记证书应当放置于民用

21、航空器内显著位置，以备查验。第H-一条取得中华人民共和国国籍的民用航空器，遇有下列情形之一时，应当申请办理变更登记：（一）民用航空器所有人或其地址变更；（一）民用航空器占有人或其地址变更；（三）国务院民用航空主管部门规定需要办理变更登记的其他情形。第十二条取得中华人民共和国国籍的民用航空器，遇有下列情形之时，应当申请办理注销登记：(1) acivilaircrafttheownershipofwhichhasbeentransferredabroadinaccordancewithlawandacertificateofairworthinessforexportofwhichhasbeeno

22、btained;(2) acivilaircraftwhichhasbeenphasedoutorhastobescrapped;(3) acivilaircraftwhichhascrashed,orhasbeenmissingandthesearchofwhichhasbeenstopped;(4) terminationoftheleasecontractofacivilaircraftinconformitywiththeprovisionsofthesecondparagraphofArticle2oftheseRegulations;and(5) othercircumstance

23、swhichcallfornullificationoftheregistrationasprescribedbythecompetentdepartmentofcivilaviationundertheStateCouncil.Article 13 Anapplicantgoingthroughtheformalitiesofcivilaircraftnationalityregistrationshallpaytheregistrationfee.Therateofregistrationfeeshallbefixedbythecompetentdepartmentofcivilaviat

24、ionundertheStateCouncilinconjunctionwiththecompetentdepartmentofpricecontrolundertheStateCouncil.Article 14 ThecompetentdepartmentofcivilaviationundertheStateCounciloritsauthorizedregionalcivilaviationadministrationsmaybanthetake-offofsuchcivilaircraftwhichhasnoordoesnotcarryacivilaircraftnationalit

25、yregistrationcertificate.(一)民用航空器所有权依法转移境外并已办理出口适航证的：(一)民用航空器退出使用或者报废的；(三)民用航空器失事或者失踪并停止搜寻的；(四)符合本条例第二条第二款规定的民用航空器租赁合同终止的：(五)国务院民用航空主管部门规定需要办理注销登记的其他情形。第十三条申请人办理民用航空器国籍登记，应当缴纳登记费。登记费的收费标准由国务院民用航空主管部门会同国务院价格主管部门制定。第十四条民用航空器没有或者未携带民用航空器国籍登记证书的，国务院民用航空主管部门或者其授权的地区民用航空管理机构可以禁止该民用航空器起飞。ChapterIIINational

26、ityMarkandRegistrationMark第三章国籍标志和登记标志Article 15 ThecivilaircraftnationalitymarkofthePeoplesRepublicofChinashallbetheRomanizedcapitalletterB.ThecivilaircraftregistrationmarkofthePeoplesRepublicofChinashallbetheArabicnumeralsandtheRomanizedcapitalletterorthecombinationofboth.Article 16 Thecivilaircra

27、ftnationalitymarkofthePeoplesRepublicofChinashallbeplacedaheadoftheregistrationmark,withahyphenbetweenthenationalitymarkandregistrationmark.Article 17 AcivilaircrafthavingobtainedthenationalityofthePeoplesRepublicofChinashallspray-paintthenationalitymarkandregistrationmarkonthecivilaircraftorattacht

28、hemtothecivilaircraftinotherwaysthatcanmaintainequaldurabilityandkeepthemclearlyvisible.Theposition,sizeandletter-formofthenationalitymarkandregistrationmarkoncivilaircraftshallbeprescribedbythecompetentdepartmentofcivilaviationundertheStateCouncil.Article 18 Nounitorindividualshallspray-paintorstic

29、kanypattern,markorsymboloncivilaircraftliabletocreateconfusionwiththenationalitymarkandregistrationmark.第十五条中华人民共和国民用航空器的国籍标志为罗马体大写字母B。中华人民共和国民用航空器的登记标志为阿拉伯数字、罗马体大写字母或者二者的组合。第十六条中华人民共和国民用航空器的国籍标志置于登记标志之前，国籍标志和登记标志之间加一短横线。第十七条取得中华人民共和国国籍的民用航空器，应当将国籍标志和登记标志喷涂在民用航空器上或者用其他能够保持同等耐久性的方法附着在民用航空器上，并保持清晰可见。国

30、籍标志和登记标志在民用航空器上的位置、尺寸和字体，由国务院民用航空主管部门规定。第十八条任何单位或者个人不得在民用航空器上喷涂、粘贴易与国籍标志和登记标志相混淆的图案、标记或者符号。Article 19 AcivilaircrafthavingobtainedthenationalityofthePeoplesRepublicofChinashallcarryanidentificationplaquemadeofrefractorymetalorotherrefractorymaterialsandwiththenationalitymarkandregistrationmarkengrav

31、edthereon.Chapter IV ProvisionalRegistrationArticle20Withrespecttoacivilaircrafthavingnotobtainedacivilaircraftnationalityregistrationcertificate,theapplicantshall,within30dayspriortothefollowingflightsandpursuanttotheformatprescribedbythecompetentdepartmentofcivilaviationundertheStateCouncil,truthf

32、ullyfillouttheapplicationformandpresenttherelevantcertificationdocumentstothecompetentdepartmentofcivilaviationundertheStateCouncilforgoingthroughtheformalitiesofprovisionalregistration:(1) orientationtestflightsandproductiontestflights;(2) performanceflights;(3) orientationflightsfordeliverj,orexpo

33、rt:and(4) othernecessaryights.Applicantsreferredtointheprecedingparagraphmeanthemanufacturers,sellersofcivilaircraftorotherapplicantsacknowledgedbythecompetentdepartmentofcivilaviation第十九条取得中华人民共和国国籍的民用航空器，应当载有一块刻有国籍标志和登记标志并用耐火金属或者其他耐火材料制成的识别牌。第四章临时登记第二十条对未取得民用航空器国籍登记证书的民用航空器，申请人应当在进行下列飞行前30日内，按照国务院

34、民用航空主管部门规定的格式如实填写申请书，并向国务院民用航空主管部门提交有关证明文件，办理临时登记：（一）验证试验飞行、生产试验飞行；（二）表演飞行；（三）为交付或者出口的调机飞行；（四）其他必要的飞行。前款申请人是指民用航空器制造人、销售人或者国务院民用航空主管部门认可的其他申请人。undertheStateCouncil.CivilaircrafttheprovisionalregistrationofwhichhasbeenapprovedbythecompetentdepartmentofcivilaviationundertheStateCouncilshalldetermineth

35、eprovisionalregistrationmarkandbeissuedaprovisionalregistrationcertificate.Article21Civilaircrafthavingobtainedtheprovisionalregistrationmarkmay,forexport,attachtheprovisionalregistrationmarkonthecivilaircraftusingerasablematerialsandshallcompletelycovertheforeignnationalitymarkandregistrationmarkalreadyspray-paintedthereonasrequestedbytheforeignparty.Chapter V SupplementaryProvisionArticle22TheseRegulationsshallenterintoforceasofthedateofpromulgation.国务院民用航空主管部门准予临时登记的，应当确定临时登记标志，颁发临时登记证书。第二一条取得临时登记标志的民用航空器出口时，可以使用易于去除的材料将临时登记标志附着在民用航空器上，并应当完全覆盖外方要求预先喷涂的外国国籍标志和登记标志。第五章附则第二十二条本条例自发布之日起施行。
