4、blicofChinaontheQuarantineofEntryandExitAnimalsandPlantsandtheregulationonitsimplementation,theFoodSafetyLawofthePeoplesRepublicofChinaandtheregulationonitsimplementation,theBiologicalSafetyLawofthePeoplesRepublicofChina,theAnimalEpidemicPreventionLawofthePeoplesRepublicofChina,andotherapplicablelaw

5、sandadministrativeregulationsforthepurposesofeffectivelyconductingtheinspectionandquarantineofedibleterrestrialanimalssuppliedtoHongKongandMacao,preventingthespreadofanimalepidemics,andguaranteeingthehealthandfoodsafetyofedibleterrestrialanimalssuppliedtoHongKongandMacao.Article2TheGeneralAdministra

6、tionofCustoms(uGACn)shalluniformlyadministertheinspectionandquarantineofedibleterrestrialanimalssuppliedbytheMainlandtoHongKongandMacaoandthesupervisionandadministrationthereof.CustomsatalllevelsshallberesponsiblefortheinspectionandquarantineofedibleterrestrialanimalssuppliedtoHongKongandMacaoandthe

7、supervisionandadministrationthereofwithintheirrespectivejurisdictions.Article3Anyentityorindividualengagedinactivitiessuchasthebreeding,transport,transit,andtradingofedibleterrestrialanimalssuppliedtoHongKongandMacaoshallabidebytheseMeasures,acceptthesupervisionandadministrationoftheCustomsinaccorda

8、ncewiththelaw,fulfilltheirprimaryresponsibilitiesforanimalepidemicpreventionandproductqualitysafety,undertakesocialresponsibilities,andensurethehealthandfoodsafetyofedibleterrestrialanimalssuppliedtoHongKongandMacao.Article4TheCustomsshallimprovethelevelofinspectionandquarantineofedibleterrestrialan

9、imalssuppliedtoHongKongandMacaoandthesupervisionandadministrationthereofthroughriskmanagementandinformationtechnology-basedmeans.和国生物安全法、中华 人民共和国动物防疫法等 法律、行政法规的规定，制 定本办法。第二条海关总署统一 管理内地供港澳食用陆生动 物的检验检疫和监督管理工 作。各级海关负责所辖区域供港 澳食用陆生动物的检验检疫 和监督管理工作。第三条从事供港澳食 用陆生动物饲养、运输、中 转、贸易等活动的单位和个 人应当遵守本办法，依法接 受海关的监督管理，

10、履行动 物防疫和产品质量安全主体 责任，承担社会责任，确保 供港澳食用陆生动物卫生和 食用安全。第四条海关运用风险 管理和信息化手段，提升供 港澳食用陆生动物检验检疫 和监督管理水平。第二章注册登记Chapter II RegistrationArticle 5 TheCustomsshallmanagetheregistrationofbreedingfarmsofedibleterrestrialanimalssuppliedtoHongKongandMacao(breedingfarms).Registrationshallbecarriedoutonafarm-by-farmbasis

11、,withonecertificateforeachfarm,andtheregistrationnumbershallbeusedexclusivelyforaspecificfarm.EdibleterrestrialanimalsraisedbyanyunregisteredbreedingfarmshallnotbesuppliedtotheHongKongSpecialAdministrativeRegionortheMacaoSpecialAdministrativeRegion.Article 6 Toregisterabreedingfarm,thefollowingrequi

12、rementsshallbemet:(1) Havingthequalificationofabusinessentity.(2) Havingobtainedthecertificateofcompliancewithanimalepidemicpreventionconditionsissuedbythedepartmentofagricultureandruralaffairs.(3) Thesiteselection,breedingscale,breedingmode,partitionlayout,facilitiesandequipment,managementrules,and

13、animalepidemicpreventionconditions,amongothers,ofthebreedingfarmcomplywiththerulesoftheCustoms,andthespecificrequirementsthereofshallbeseparatelydevelopedbytheGAC.第五条海关对供港澳 食用陆生动物饲养场（以下 简称“饲养场”）实行注册 登记管理。注册登记以饲养场为单位， 一场一证，注册登记编号应 专场专用。饲养场未经注册登记的，其 饲养的食用陆生动物不得供 应香港、澳门特别行政区。第六条饲养场注册登 记应当符合以下条件：（一）具有经营

14、主体资格;（二）取得农业农村部门颁 发的动物防疫条件合格证；（三）饲养场的选址、饲养 规模、饲养模式、分区布 局、设施设备、管理制度、 动物防疫条件等符合海关规 定，具体要求由海关总署另 行制定。饲养场不具备经营主体资格 的，应当由经营该饲养场的 经营主体申请注册登记。Ifthebreedingfarmdoesnothavethequalificationsofabusinessentity,theapplicationforregistrationshallbefiledbythebusinessentityoperatingthefarm.Article 7 Abreedingfarmsh

15、allfileanapplicationforregistrationwiththelocalCustomsbysubmittinganapplicationformforregistrationandaplanefigureofthefarm.TheCustomsdirectlyundertheGACattheplacewherethebreedingfarmislocatedshallexaminematerialsandconducton-siteexamination.Ifregistrationconditionsaremet,itshalldecidetograntadminist

16、rativelicensinginaccordancewiththelawandissuetheregistrationcertificateofthebreedingfarm;orifregistrationconditionsarenotmet,itshallmakeadecisionnottogranttheadministrativelicensinginaccordancewiththelaw.Article 8 Incaseofachangeintheaddress(excludingrelocation),thetypeofbusinessentity,thename,legal

17、representative,orpersoninchargeofaregisteredbreedingfarm,orincaseofachangeintheregistrationrequirementsasaresultofreconstructionorexpansion,theenterpriseshallapplytothelocalCustomsforundergoingmodificationformalitiesandsubmittherelevantmaterialswithin30daysaftertheoccurrenceofsuchachange.Whenaregist

18、eredbreedingfarmisrelocated,thefarmshallreapplytotheCustomsatthenewaddressforundergoingregistrationformalities.TheCustomsshallcanceltheregistrationattheoriginallocationandwithdrawtheoriginalregistrationcertificate.Article 9 Theregistrationofbreedingfarmsshallbevalidforfiveyears.第七条饲养场向所在 地海关提出注册登记申请

19、， 提交饲养场注册登记申请表 和饲养场平面图。饲养场所在地直属海关组织 开展材料审核和实地审查， 符合注册登记条件的，依法 作出准予行政许可的决定， 颁发饲养场注册登记证书； 不符合注册登记条件的，依 法作出不予行政许可的决 定。第八条注册登记饲养 场场址（迁址除外）、经营 主体类型、单位名称、法定 代表人或者负责人变更的以 及因改扩建引起注册登记条 件发生变化的，应当在变更 后30日内向所在地海关申 请办理变更手续，并提交相 关材料。注册登记饲养场迁址的，应 当向新址所在地海关重新申 请办理注册登记手续。海关 应当注销原址注册登记，收 回原饲养场注册登记证书。第九条饲养场注册登 记有效期5年

20、。饲养场注册登记有效期届满Ifthevalidityperiodoftheregistrationofabreedingfarmexpiresandneedstobeextended,anapplicationforextensionshallbefiledwiththelocalCustoms30daysbeforetheexpirationofthevalidityperiod.Article 10 Wheretheregistrationofabreedingfarmshallbewithdrawn,revoked,orcanceledinaccordancewiththelaw,the

21、Customsshallhandlethecaseinaccordancewiththeprovisionsonadministrativelicensing.Article 11 TheGACshalluniformlypublishalistofregisteredbreedingfarms.ChapterIIIInspectionandQuarantineArticle 12 AregisteredbreedingfarmshallsubmititsplanforsupplyingedibleterrestrialanimalstoHongKongandMacaotothelocalCu

22、stomssevendaysbeforetheloadingofsuchedibleterrestrialanimals.Article 13 EdibleterrestrialanimalstobesuppliedtoHongKongandMacaoshallbesubjecttoisolatedquarantinebeforeloadingandtransport.Theperiodofisolatedquarantineforlivecattle,livesheep,andlivepigstobesuppliedtoHongKongandMacaoshallnotbelessthanse

23、vendays.TheperiodofisolatedquarantineforlivepoultrytobesuppliedtoHongKongandMacaoshallnotbelessthanfivedays.需要延续的，应当在有效期 届满30日前向所在地海关 申请办理延续手续。第十条饲养场注册登 记依法应当撤回、撤销、注 销的，海关按照行政许可相 关规定办理。第十一条海关总署统 一公布注册登记饲养场名 单。第三章检验检疫第十二条注册登记饲 养场应当在供港澳食用陆生 动物装运7日前向所在地海 关报送供港澳计划。第十三条供港澳食用 陆生动物装运前应当进行隔 离检疫。供港澳活牛、活 羊、活猪

24、隔离检疫期不少于 7日，供港澳活禽隔离检疫 期不少于5日。第十四条注册登记饲 养场应当在装运3日前向所 在地海关申请启运地检验检 疫。特殊情况下，经海关同Article 14 AregisteredbreedingfarmshallapplytothelocalCustomsforinspectionandquarantineattheplaceofdeparturethreedaysbeforetheloadingandtransport.Underspecialcircumstances,atemporaryapplicationforinspectionandquarantineatth

25、eplaceofdeparturemaybefiledwiththeconsentoftheCustoms.Article 15 Whennecessary,theCustomsmaycollectsamplesfromedibleterrestrialanimalssuppliedtoHongKongandMacaofortesting.Article 16 ThequarantinemarksofedibleterrestrialanimalssuppliedtoHongKongandMacaoandthemanagementoftheiruseshallsatisfytherequire

26、mentsoftheCustoms,andthespecificrequirementsshallbeseparatelyformulatedbytheGAC.Article 17 ThelocalCustomsshallconductpreshipmentinspectionandsupervisetheloadingofedibleterrestrialanimalssuppliedtoHongKongandMacaothathavepassedisolationquarantineandaffixsealstothemeansoftransport.Thepre-shipmentinsp

27、ectionshallincludebutnotbelimitedtoconfirmingwhethertheedibleterrestrialanimalssuppliedtoHongKongandMacaocomefromtheregisteredbreedingfarms,verifyingthequantityofsuchterrestrialanimals,inspectingtheaffixingofquarantinemarkstosuchterrestrialanimals,confirmingwhetherthereareanyanimalepidemicsymptomsor

28、injuriesordisabilitiesofanimals,andconfirmingwhetherthemeansoftransportandloadingequipmentsatisfyanimalhealthrequirements.意，可以临时申请启运地检 验检疫。第十五条必要时，海 关可以对供港澳食用陆生动 物采集样品进行检测。第十六条供港澳食用 陆生动物的检疫标志及其使 用管理应当符合海关要求， 具体要求由海关总署另行制 定。第十七条所在地海关 对经隔离检疫合格的供港澳 食用陆生动物实施装运前检 查、监督装载，对运输工具 加施封识。装运前检查包括确认供港澳 食用陆生动物来自注册

29、登记 的饲养场、核定供港澳食用 陆生动物数量、检查供港澳 食用陆生动物检疫标志加施 情况、确认无任何动物疫病 症状和伤残情况、确认运输 工具及装载器具符合动物卫 生要求等。第十八条经所在地海 关检验检疫合格的供港澳食 用陆生动物，由海关总署授 权的兽医官签发动物卫生证 书。Article 18 ForedibleterrestrialanimalssuppliedtoHongKongandMacaothathavepassedtheinspectionandquarantineconductedbythelocalCustoms,veterinariansauthorizedbytheGACs

30、hallsignandissueanimalhealthcertificates.Ananimalhealthcertificateshalltakeeffectfromthedateofissuanceandbevalidfornotmorethan14days,andthespecificrequirementsforthetimelimitshallbeseparatelyformulatedbytheGAC.Article 19 WhenedibleterrestrialanimalstobesuppliedtoHongKongandMacaoaretransportedtotheex

31、itportordockingsite,theCustomsshallconductexitinspectionandquarantine.TheCustomsshallexaminethedocumentssuchasanimalquarantinemarksandtheanimalhealthcertificatesubmittedbytheownerofgoodsortheagentthereof,conductanclinicalexaminationoftheanimals,andpermittheexitofedibleterrestrialanimalssuppliedtoHon

32、gKongandMacaothatsatisfytheregulatoryrequirementsoftheCustoms.CustomsofficersshallendorseontheanimalhealthcertificatesuchinformationasthenumberofedibleterrestrialanimalsactuallysuppliedtoHongKongandMacaoandthedateofexitofsuchanimals,signthecertificateforconfirmation,andaffixthesealoftheCustoms.Edibl

33、eterrestrialanimalssuppliedtoHongKongandMacaothatdonothavecompliantanimalquarantinemarksorvalidanimalhealthcertificatesorfailtopasstheclinicalexaminationshallnotbepermittedtoexitfromtheterritory.Article 20 WhenexportingedibleterrestrialanimalstoHongKongandMacao,theownerofgoodsortheagentthereofshallt

34、ruthfullydeclaretotheCustomsinaccordancewiththelaw.动物卫生证书自签发之日起 生效，有效期不超过14 0,具体时限要求由海关总 署另行制定。第十九条供港澳食用 陆生动物运抵出境口岸或者 接驳场地时，海关实施离境 检验检疫。海关审核动物检疫标志、货 主或者其代理人提交的动物 卫生证书等单证，并对动物 实施临床检查，符合海关监 管要求的供港澳食用陆生动 物，准予出境。海关工作人 员应当在动物卫生证书上加 签实际供港澳食用陆生动物 数量、出境日期等信息，签 字确认并加盖海关印章。无符合要求的动物检疫标 志、无有效的动物卫生证书 或者经临床检查不合格的

35、供 港澳食用陆生动物，不准出 境。第二十条货主或者其 代理人出口供港澳食用陆生 动物时应当依法向海关如实 申报。第二十一条供港澳食Article 21 WhereedibleterrestrialanimalssuppliedtoHongKongandMacaoneedtobepickedupbythemeansoftransportfromHongKongorMacaoatthedepartureplace,itshallbecarriedoutataplacesatisfyingtheregulatoryrequirementsoftheCustoms.Article 22 Theregi

36、steredbreedingfarms,theownersofgoodsortheiragentsshalleffectivelycleananddisinfectthemeansoftransportandloadingequipment.ThemeansoftransportreturningemptyaftertransportingedibleterrestrialanimalssuppliedtoHongKongandMacaoshallbethoroughlycleaneduponentryanddisinfectedforepidemicpreventionunderthesup

37、ervisionoftheCustoms.ChapterIVSupervisionandAdministrationArticle23Registeredbreedingfarmsshallcarryoutanimalbreedingactivitiesinaccordancewiththelaw,carryoutanimalepidemicpreventionrules,truthfullyrecordanimalbreedingconditions,andensurethatedibleterrestrialanimalssuppliedtoHongKongandMacaocomplywi

38、ththerelevantlaws,regulations,andcompulsorystandardsofthestate,andthespecificrequirementsshallbeformulatedseparatelybytheGAC.Article 24 Wherearegisteredbreedingfarmistoberebuiltorexpanded,thereconstructionorexpansionplanandanimalepidemicpreventionmeasuresshallbereportedtotheCustomsinadvance.用陆生动物需要由

39、香港、澳 门的运输工具在出境地接驳 出境的，应当在符合海关监 管要求的场地进行。第二十二条注册登记 饲养场、货主或者其代理人 应当做好运输工具及装载器 具的清洗消毒工作。装运供港澳食用陆生动物的 回空运输工具入境时应当清 洗干净，并在海关的监督下 作防疫消毒处理。第四章监督管理第二十三条注册登记 饲养场应当依法开展饲养活 动，落实动物防疫制度，如 实记录动物饲养情况，保证 供港澳食用陆生动物符合国 家有关法律法规、强制性标 准，具体要求由海关总署另 行制定。第二十四条注册登记 饲养场改扩建的，应当事前 向海关报告改扩建计划以及 动物防疫措施。改扩建期间，饲养的供港澳 食用陆生动物不得供应香 港

41、rticle 25 TheCustomsshallmonitoranimalepidemicsandmonitorandcontroldrugresiduesandothertoxicandharmfulsubstancesinregisteredbreedingfarms.TheCustomsmaycollectsamplesformonitoringandcontrolwhennecessary.Article 26 TheCustomsshallsuperviseandinspectthebreedingmanagement,animalepidemicprevention,andani

42、malhealthconditions,amongothers,ofregisteredbreedingfarms.Supervisionandinspectionshallincluderoutinesupervisionandinspectionandannualsupervisionandinspection.Article 27 TheCustomsshallcarryouttheclassifiedmanagementofregisteredbreedingfarmsinlightofthemanagementofregisteredfarmsandtheirlevelofappli

43、cationofinformationtechnologies.影响动物防疫条件并经海关 同意的除外。第二十五条海关对注 册登记饲养场实施动物疫病 监测、药物残留和其他有毒 有害物质监控。海关可以根据需要采集样品 开展监测监控。第二十六条海关对注 册登记饲养场的饲养管理和 动物防疫情况、动物健康状 况等进行监督检查。监督检查包括日常监督检查 和年度监督检查。第二十七条海关根据 注册登记饲养场的管理情况 和信息化应用水平，对注册 登记饲养场实行分类管理。第二十八条从事供港 澳食用陆生动物饲养、运 输、中转、贸易等活动的单 位和个人，发现动物染疫或 者疑似染疫的，应当立即按 要求向海关报告，并迅速

44、采 取隔离等控制措施，防止动 物疫情扩散。Article 28 Whereanyentityorindividualengagedinactivitiessuchastheraising,transport,transit,ortradingofedibleterrestrialanimalssuppliedtoHongKongandMacaofindsthatanimalsareinfectedwithanepidemicoraresuspectedofbeinginfectedwithanepidemic,theentityorindividualshallimmediatelyrepor

45、ttotheCustomsasrequired,andpromptlytakeisolationandothercontrolmeasurestopreventthespreadofanimalepidemics.TheCustomsshallhandlethematterinaccordancewithlaws,regulations,andrelevantprovisionsissuedbythestate.海关按照法律法规以及国家有关规定进行处置。Article29Wherearegisteredbreedingfarmfallsunderanyofthefollowingcircums

46、tances,theCustomsshallorderittotakecorrectiveaction,andtheanimalsraisedatthefarmduringtheperiodofcorrectiveactionshallnotbesuppliedtotheHongKongSpecialAdministrativeRegionortheMacaoSpecialAdministrativeRegion:第二十九条注册登记饲养场出现下列情形之一时，由海关责令改正，整改期间其饲养的动物不得供应香港、澳门特别行政区：(1)TheraisedanimalsareinfectedwithaC

47、lassIorClassIlinfectiousdiseaseoranyotherepidemicseriouslyharmfultoanimals.（一）饲养的动物发生一类、二类传染病或者其他具有严重危害动物疫病的；(2)TheraisedanimalsarefoundtobeinfectedwithaClassIorClassIlinfectiousdiseaseoranyotherepidemicseriouslyharmfultoanimals.（二）饲养的动物被检出一类、二类传染病或者其他具有严重危害动物疫病的；(3)Theraisedanimalsarefoundtobeunqua

48、lifiedinanyitemofdrugresidueoranyitemofothertoxicorharmfulsubstances.（三）饲养的动物被检出药物残留项目不合格的，或者被检出其他有毒有害物质项目不合格的；(4)Usingorstoringdrugsprohibitedbythestateorotherinputsprohibitedbythestate.（四）使用、存放国家禁用药物或者其他禁用投入品的；(5)Failingtouse,accordingtotherelevantprovisionsissuedbythestate,thedrugsorotherinputspermittedbythestate.（五）对国家允许使用的药物或者其他投入品不按国家有关规定使用的；(6)Forginganimalbreedingrecords.（六）伪造动物饲养记录的；（七）其他不符合饲养管理 或者动物防疫要求的。注册登记饲养场应当配合海 关或者其他有关部门查明原 因，并按照有关规定进行整 改。整改结果经海关认可 的，方可恢复向香港、澳门 特别行政区供应其饲养的动 物。(7)Failingtosatisfytherequireme
