5、svessels,maintainingthesafetyandmanagementorderofthewaters,andpreventingtheriskofusingthreenoesvesselsforillegalactivitiessuchassmuggling,illegalimmigration,andillegalfishing,theseProvisionsaredevelopedaccordingtotheHainanFreeTradePortLawofthePeople,sRepublicofChinaandotherrelevantlawsandregulations

6、,inlightoftheconditionsofHainanFreeTradePort.Article2ForthepurposesoftheseProvisions,threenoes,vessel1meansamotorizedornonmotorizedvesselonavoyage,berthing,oroperatingonthewater,orafacilityorinstallationmovingorfloatingonthewaterandmanagedasavessel,thathasnovesselnameoridentificationnumber,certifica

7、te,orportofregistry.Forthepurposesoftheprecedingparagraph,certificatemeansacertificateofinspectionorregistryoranyothercertificatethatavesselengagedinrelevantactivitiesisrequiredtoholdaccordingtothelaw.海南自由贸易港“三无”船舶综 合治理规定（2023年11月24日海南省第七 届人民代表大会常务委员会第七 次会议通过）第一条为了有效治理“三 无”船舶，维护水域安全和管理 秩序，防范利用“三无”船舶

8、实 施走私、偷渡、非法捕捞等违法 活动的风险，根据中华人民共 和国海南自由贸易港法等有关 法律法规，结合海南自由贸易港 实际，制定本规定。第二条本规定所称“三 无”船舶，是指具有无船名船 号、无船舶证书、无船籍港等情 形，在水上航行、停泊、作业的 各类机动、非机动船舶以及其他 按照船舶管理的水上移动或漂浮 设施、装置。前款所称的船舶证书，是指船舶 检验证书和船舶登记证书以及从 事相关活动的船舶依法应当持有 的其他证书证件。第三条省人民政府应当依 托社会管理信息化平台，建立全 省船舶信息综合管理平台及数据Article3TheProvincialPeoplesGovernmentshall,re

9、lyingonthesocialmanagementinformationplatform,establishaprovincialcomprehensivevesselinformationmanagementplatformanddatabase,andupdateitinrealtime,soastointegrateresourcesandshareinformation.Thepeoplesgovernmentsofcities,counties,andautonomouscountiesshallarrangeforagricultureandruralaffairs,mariti

10、me,coastguard,publicsecurity,transportation,tourismandculture,andotherrelevantauthoritiesandentitiestocollectstatisticsforthreenoesvesselswithintheirrespectiveadministrativeareas,uniformlycreaterecordsofvessels,andentervesselinformationintotheprovincialcomprehensivevesselinformationmanagementdatabas

11、e.Article4Thepeoplesgovernmentsatorabovethecountylevelshallleadthecomprehensiveregulationof,threenoesvesselswithintheirrespectiveadministrativeareas,establishacoordinationandcommunicationmechanismwithmaritime,coastguard,customs,andotherentities,supportcomprehensiveregulationintermsoffunds,custodysit

12、es,andpersonnel,amongothers,andrequestrelevantauthoritiestoincorporatethecomprehensiveregulationintosafetyinitiativeassessments.Townvesselpeoplesgovernmentsandsubdistrictofficesshallsupportandcooperatewithrelevantauthoritiesinthecomprehensiveregulationofthreenoesvessels,andguidevillagerscommitteesan

13、dresidentscommitteesintasksrelatedtocomprehensiveregulation.库，并实时更新，实现资源整 合、信息共享。市、县、自治县人民政府应当组 织农业农村、海事、海警、公 安、交通运输、旅游和文化等有 关部门和单位对本行政区域内的 “三无”船舶进行统计，统一建 立船舶档案，并将船舶信息录入 全省船舶信息综合管理数据库。第四条 县级以上人民政府 应当加强对本行政区域内“三 无”船舶综合治理工作的领导， 建立与海事、海警、海关等单位 的协作沟通机制，做好“三无” 船舶综合治理经费、看管场所和 人员等相关保障工作，协调有关 部门将“三无”船舶综合治理工

14、 作纳入平安建设考核。乡镇人民政府、街道办事处应当 支持和配合有关部门开展“三 无”船舶综合治理工作，并指导 村民委员会、居民委员会做好 “三无”船舶综合治理的相关工 作。第五条 县级以上人民政府 渔业渔政主管部门负责机动渔船 底拖网禁渔区线内侧海域内“三 无”船舶涉渔活动的监督管理工Article5Thefisheryadministrationauthoritiesofthepeoplesgovernmentsatorabovethecountylevelshallberesponsibleforsupervisingandadministeringthefishing-relatedac

15、tivitiesofthreenoesvesselsinthewaterswithinazone作。wherebottomtrawlingbymotorizedfishingvesselsisprohibited.Maritimeauthoritiesshallberesponsibleforsupervisingandinspecting,threenoesvesselswithintheirjurisdictionthataffectwatertrafficsafety.Coastguardagenciesshallberesponsibleforsupervisingandinspect

16、ingthefishing-relatedactivitiesof,threenoesvesselsinthewatersoutsidezoneswherebottomtrawlingbymotorizedfishingvesselsisprohibitedandinfishinggroundswithspecificfisheryresources.Coastguardagenciesandpublicsecurityauthoritiesshallberesponsibleforthesecurityadministrationofthreenoesvesselswithintheirre

17、spectiveadministrativeareas.Thetransportationauthoritiesofthepeoplesgovernmentsatorabovethecountylevelshallberesponsibleforsupervisingandadministeringthreenoesvesselsthatillegallyperformwatertransportationwithintheirrespectiveadministrativeareas.Thetourismandculturalauthoritiesofthepeoplesgovernment

18、satorabovethecountylevelshallberesponsibleforsupervisingandadministeringthreeoesvesselsengagedinwatertourismprojectswithintheirrespectiveadministrativeareas.海事管理机构负责对辖区内影响 水上交通安全的“三无”船舶依 法实施监督检查。海警机构负责对机动渔船底拖网 禁渔区线外侧海域和特定渔业资 源渔场内“三无”船舶涉渔活动 的监督检查。海警机构、公安机关负责本行政 区域内“三无”船舶的治安管理 工作。县级以上人民政府交通运输主管 部门负责本行

19、政区域内“三无” 船舶违法经营水路运输业务的监 督管理工作。县级以上人民政府旅游和文化主 管部门负责本行政区域内从事水 上旅游项目经营活动“三无”船 舶的监督管理工作。县级以上人民政府工业和信息化 部门负责本行政区域内船舶修造 行业的管理工作。Theindustryandinformationtechnologyauthoritiesofthepeoplesgovernmentsatorabovethecountylevelshallberesponsibleforadministeringthevesselyardindustrywithintheirrespectiveadministra

20、tiveareas.Themarketregulatoryauthoritiesofthepeoplesgovernmentsatorabovethecountylevelshallberesponsibleforinvestigatingandmakingdispositionregardingvesselyardsoperatingwithoutabusinesslicensewithintheirrespectiveadministrativeareas.Customs,emergencymanagement,andotherrelevantauthoritiesandentitiess

21、hallsuperviseandadministerthethreenoesvesselsinaccordancewiththeirrespectivepurview.Article6Agricultureandruralaffairs,maritime,coastguard,publicsecurity,transportation,customs,andotherrelevantauthoritiesandentitiesshalldeterminethreenoesvesselswithintheirpurview.Theyshalldetermineavesselasathreenoe

22、svesselif(1) Thevesselfailstoobtainanameoridentificationnumber,certificate,orportofregistryinaccordancewiththelaw.(2) Allthevesselscertificateshavebeencanceled,revoked,withdrawn,orforfeited,orhavenotbeenrenewedinaccordancewiththelawsinceexpiration.(3) Theregistrationoftitletothevesselhasbeencanceled

23、duetoloss,disappearance,sinking,dismantling,destruction,orvoluntaryterminationofproduction.县级以上人民政府市场监督管理 部门负责本行政区域内无营业执 照经营船舶修造厂点的查处工 作。海关、应急管理等有关部门和单 位按照各自职责，共同做好“三 无”船舶的监督管理工作。第六条 农业农村、海事、 海警、公安、交通运输、海关等 有关部门和单位应当按照职责对 “三无”船舶进行认定，具有以 下情形之一的，认定为“三无” 船舶：（一）船舶未依法取得船名船 号、船舶证书和船籍港的；（二）所有船舶证书均已被注 销、撤销、

24、撤回、吊销或者有效 期届满未依法延续的；（三）船舶所有权登记已注销， 且注销原因为船舶灭失、失踪、 沉没、拆解、销毁或者自行终止 生产的；（四）船舶系未经审批或者未经(4) Thevesselisbuiltwithoutapprovalorbuildinginspection.建造检验擅自非法建造的;（五）伪造、变造、套用其他船 舶的船名船号、船舶证书、船籍 港的；(5) Thevesselbearsaforged,altered,orborrowednameoridentificationnumber,certificate,orportofregistry.（六）船舶主尺度、船体结构、 重

25、要机电设备等与船舶证书记载 严重不符的；(6) Thevessesmaindimensions,hullstructure,importantmechanicalandelectricalequipment,amongothers,areinconsistentwiththosestatedinitscertificates.(7) The law otherwise permits.（七）其他依法可以认定为“三 无”船舶的情形。情况复杂、认定困难，确需联合 认定的，由需要认定的部门和单 位提出申请，市、县、自治县人 民政府组织实施。“三无”船舶 的联合认定标准和程序按照国家 和本省相关规定执

26、行。Ifthecomplexityofcircumstancesanddifficultyindeterminationsorequire,thepeoplesgovernmentofacity,county,orautonomouscountyshall,uponapplicationbytheauthoritiesandentitiesinneed,organizeajointdetermination.Thejointdeterminationofthethreenoesvesselshallbemadeinaccordancewiththecriteriaandprocedureses

27、tablishedbythestateandtheprovince.Article7Noentityorindividualshall:第七条任何单位和个人不得有下列行为：(1)Illegallybuildavesselorrenovateorconverta,threenoesvessel.（一）非法制造船舶或者更新改造“三无”船舶；(2)Repaira,threenoesvessel,exceptforemergencyrescueatsea.（二）维修“三无”船舶，因海上紧急救援情况除外；(3)Supplyoil,water,ice,orpowertoa,threenoesvessel,

28、exceptforemergencyrescueatsea.（三）向“三无”船舶供油、供水、供冰、供电，因海上紧急救援情况除外;(4)Freezeonbehalfoftheprincipal,transvessel,purchase,process,orsellacatchoranyotheritemcaughtbyathreenoes,vessel.（四）代冻、转载、收购、加工、销售“三无”船舶捕捞的渔获物和其他物品；(5)Buy,sell,transfer,orleaseathreenoesvessel.（五）买卖、转让、租借“三无”船舶。Article8Ifa,threenoesvess

29、elfallsunderanyofthefollowingcircumstances,theappropriatelawenforcementauthorityshall,accordingtothefollowingresponsibilities,confiscateitandimposeapenaltyinaccordancewithrelevantlawsandregulations:第八条“三无”船舶有下列情形之一的，由有关执法机关按照下列职责予以没收，并依照相关法律法规处罚：(1)Ifthevesselengagesinfishing-relatedactivitiesinthew

30、atersinsideazonewherebottomtrawlingbymotorizedfishingvesselsisprohibited,thefisheryregulatoryagencyofthepeople,sgovernmentatorabovethecountylevelshallinvestigateandmakedisposition.（一）“三无”船舶在机动渔船底拖网禁渔区线内侧海域从事涉渔活动的，由县级以上人民政府渔政监督管理机构查处；(2)Ifthevesselengagesinsmugglingatsea,disobeyspublicsecurityadminis

31、trationorentryandexitadministration,orengagesinfishing-relatedorotheractivitiesinwatersoutsidezoneswherebottomtrawlingbymotorizedfishingvesselsisprohibitedorinafishinggroundwithspecificfisheryresources,acoastguardagencyshallinvestigateandmakedisposition.（二）“三无”船舶在海上从事走私，违反治安管理、入境出境管理活动，或者在机动渔船底拖网禁渔区

32、线外侧海域和特定渔业资源渔场从事涉渔等活动的，由海警机构查处；(3)Ifthevesselviolateslawsandregulationsrelatedtowatertrafficsafetywithinthejurisdictionofamaritimeauthority,themaritimeauthorityshallinvestigateandmakedisposition.（三）“三无”船舶在海事管理机构辖区内违反水上交通安全相关法律法规的，由海事管理机构查处；（四）“三无”船舶在水上从事 其他活动的，由市、县、自治县 人民政府综合行政执法部门查 处。(4)Ifthevessel

33、engagesinotheractivitiesonthewater,thecomprehensiveadministrativelawenforcementauthorityofthepeoplesgovernmentofacity,county,orautonomouscountyshallinvestigateandmakedisposition.有关执法机关为制止违法行为、 防止证据损毁、避免危害发生、 控制危险扩大等，可以对违反本 规定的“三无”船舶采取扣押、 强制拖离等措施。第九条船舶所有人或者实 际使用人未依法取得制造、更新 改造手续，自行或者委托他人制 造、更新改造船舶的，由县

34、级以 上人民政府渔政监督管理机构、 海事等有关部门和单位按照职责 没收制造、更新改造的船舶，并 可以处二万元以上十万元以下罚 款。Tostopaviolation,preventdamagetoevidence,avoidharm,orcontroltheincreaseofdanger,anappropriatelawenforcementauthoritymaytakemeasuressuchasdetainingorforciblytowingawayavesselthatviolatestheseProvisions.Article9Ifanowneroruserofavesselbu

35、ilds,renovates,orconvertsthevesselinpersonorbyanagentwithoutfollowingthebuilding,renovation,andconversionprocedures,thefisheryregulatoryagency,maritimeauthority,andotherrelevantauthoritiesandentitiesofthepeoplesgovernmentatorabovethecountylevelshallconfiscatethevesselwithintheirpurviewandmayimposeaf

36、ineofnotlessthan20,000yuannormorethan100,000yuan.第十条船舶修造厂点有下 列行为之一的，由市、县、自治 县人民政府指定的部门责令停止 违法行为，没收违法所得，并处 十万元以上二十万元以下罚款：Article10Ifavesselyardcommitsanyofthefollowingacts,theauthoritydesignatedbythepeople,sgovernmentofacity,county,orautonomouscountyshallorderittostoptheillegalact,confiscateitsillega

37、lincome,andimposeafineofnotlessthan100,000yuannormorethan200,000yuan:（一）制造、更新改造未取得法 律法规规定相关手续的船舶的；（二）未按照船舶检验机构审查 批准或者签发的检验证书、设计(1) Building,renovating,orconvertingavesselthathasnotfollowedtherelevantproceduresspecifiedbylawsandregulations.(2) Failingtobuild,renovate,orconvertavesselinaccordancewitht

38、hecertificateofinspection,图纸、技术文件制造、更新改造 船舶的；design,ortechnicaldocumentsexaminedandapprovedorissuedbyavesselinspectionagency.（三）更新改造、维修“三无” 船舶的；(3) Renovating,converting,orrepairingathreenoesvessel.（四）有其他非法制造、更新改 造船舶行为的。(4) Otherwiseillegallybuilding,renovating,orconvertingavessel.船舶修造厂点未取得营业执照从 事经营

39、活动的，由县级以上人民 政府市场监督管理部门依照中 华人民共和国市场主体登记管理 条例的有关规定予以处罚。Ifavesselyardengagesinbusinesswithoutobtainingabusinesslicense,themarketregulatoryauthorityofthepeoplesgovernmentatorabovethecountylevelshallimposeapenaltyinaccordancewiththerelevantprovisionsoftheRegulationofthePeoplesRepublicofChinaontheAdminist

40、rationoftheRegistrationofMarketEntities.第十一条 单位或者个人知 道或者应当知道船舶属于“三 无”船舶，违法向其供油、供 水、供冰、供电或者代冻、转 载、收购、加工、销售其捕捞的 渔获物和其他物品的，由县级以 上人民政府渔政监督管理机构等 部门没收违法所得、渔获物和其 他物品，并处十万元以下罚款。Article 11 Ifanentityorindividualthatknowsorshouldknowthatavesselisa,threenoesvessel川egallysuppliesoil,water,ice5orelectricity,orfr

41、eezesonbehalfoftheprincipal,transvessels,purchases,processes,orsellsthecatchoranyotheritemcaughtbythevessel,thefisheryregulatoryagencyandotherauthoritiesofthepeoplesgovernmentatorabovethecountylevelshallconfiscatetheillegalincomeandthecatchorotheritem,andimposeafineofnotmorethan100,000yuan.第十二条村（居）民

42、家庭 自用且符合相关条件的船舶，可 以申请备案，实行过渡期管理。 具体办法由省人民政府制定。Article 12 Avesselusedbyavillager(resident)forhouseholdpurposesthatmeetsrelevantconditionsmay,onapplicationforrecordation,beplacedundertransitionaladministration.SpecificmeasuresshallbeformulatedbytheProvincialPeople,sGovernment.第十三条县级以上人民政 府应当统筹推进现有“三无”

43、船 舶综合治理中的就业促进工作。 在研究制定减船转产政策方案 时，因地制宜发展海水养殖、海 水产品加工和休闲渔业等产业， 鼓励、引导、支持相关从业人员 就业创业，将符合享受社会救助 条件的减船转产人员纳入当地社 会救助保障范围。Article 13 Thepeoplesgovernmentsatorabovethecountylevelshalltakeintoconsiderationemploymentpromotionwhilecomprehensivelyregulatingexistinguthreenoesnvessels.Whenstudyingandformulatingpol

44、iciesandplansforvesselreductionandemploymentswitch,theyshalldevelopindustriessuchasmarineaquaculture,marineproductprocessing,andrecreationalfisheryaccordingtolocalconditions,guideandsupportrelevantemployeesinfindingemploymentandstartingbusinesses,andprovidelocalsocialaidtoeligiblepersonsrelatedtothe

45、vesselreductionandemploymentswitch.鼓励企业吸纳相关从业人员，对 吸纳相关从业人员超过一定比例 的企业，市、县、自治县人民政 府应当出台相关政策和措施予以 支持。Enterprisesshallbeencouragedtoemploytherelevantpersons.Forenterprisesthatemploymorethanacertainpercentageoftherelevantpersons,thepeople,sgovernmentsofcities,counties,andautonomouscountiesshallissuerelev

46、antsupportpoliciesandmeasures.县级以上人民政府农业农村、人 力资源和社会保障等部门，应当 指导职业技能培训机构对相关从 业人员开展职业技能培训和就业 指导援助服务，鼓励和引导相关 从业人员转产转岗、就业创业。Theagricultureandruralaffairs,humanresourcesandsocialsecurity,andotherauthoritiesofthepeoplesgovernmentsatorabovethecountylevelshallguidevocationalskillstraininginstitutionsinofferi

47、ngvocationalSMllStraining,employmentguidance,andassistanceservicesfortherelevantpersons,andencourageanddirecttherelevantpersonstomakeavesselreductionandemploymentswitchandstartbusinesses.第十四条 下列船舶、载具 适用有关法律法规和国家、本省 有关规定，不适用本规定：（一）城市园林水域水上船舶;Article 14 Thefollowingvesselsandvehiclesgovernedbyrelevant

48、laws,regulations,andrelevantnationalandprovincialprovisionsshallbeexemptfromtheseProvisions:(1) Vesselsinurbangardenwaters.（二）水上摩托艇、橡皮艇、香 蕉船、皮划艇、帆船、帆板、冲 浪板、水上飞机、拖伞等用于水 上体育运动和旅游经营活动的各 类载具；（三）法律法规未明确应当持有 证书证件的其他船舶。(2) Personalwatercraft,inflatableboats,bananaboats,kayaks,sailboats,windsurfers,surfboards,seaplanes,paraglidingwings,andothervehiclesusedforwatersportsandtourismoperations.(3) Othervesselsrequiredtoholdce
