7、ember15,2023MeasuresfortheAdministrationoftheDirectoryDatabaseofIntellectualPropertyRightIdentificationInstitutionsChapterIGeneralProvisionsArticle1TheseMeasuresareherebydevelopedtoimplementthemechanismfortheselectionandrecommendationofIPRidentificationinstitutionsintheGuidingOpinionsoftheChinaNatio

8、nalIntellectualPropertyAdministrationonStrengtheningIntellectualPropertyIdentification,establishtheworkarrangementsforthedirectorydatabaseofIPRidentificationinstitutions,andensurethesmoothselectionofinstitutionstobeincludedinthedirectorydatabaseofIPRidentificationinstitutions.进知识产权鉴定机构专业化、 规范化发展，我局制

9、定知识 产权鉴定机构名录库管理办 法，现予印发，请结合实际 认真贯彻落实。国家知识产权局办公室2023年9月15日知识产权鉴定机构名录库管理 办法第一章总则第一条为落实国家知 识产权局关于加强知识产权鉴 定工作的指导意见中构建知 识产权鉴定机构遴选荐用机 制，建立知识产权鉴定机构名 录库的工作部署，保障知识产 权鉴定机构名录库遴选工作顺 利进行，特制定本办法。第二条本办法适用于知 识产权鉴定机构名录库入库遴 选及管理工作。Article2TheseMeasuresshallapplytotheselectionofinstitutionstobeincludedinthedirectoryda

10、tabaseofIPRidentificationinstitutionsandtheadministrationthereof.Article3TheChinaNationalIntellectualPropertyAdministration(uCNIPA)shall,incooperationwithrelevantdepartments,jointlyconducttheselectionofIPRidentificationinstitutionstobeincludedinthedirectorydatabaseofIPRidentificationinstitutions.Pro

11、vincialIPRadministrativedepartmentsandnationalself-regulatoryorganizationsintheIPRidentificationindustryshallberesponsibleforrecommendingidentificationinstitutionsthatmeetthebasicconditionstotheCNIPA.Article4BasedontheneedsoftheIPRidentificationwork,theCNIPAshallorganizetheselectionofIPRidentificati

12、oninstitutionsingoodtimeaccordingtotherelevantrequirementsoftheseMeasures.Article5TheselectionofIPRidentificationinstitutionsshallfollowtheprinciplesofopenness,fairnessandimpartialityandadheretohighstartingpointsandhighstandards,andinstitutionsincludedinthedirectorydatabaseshallbedeterminedaccording

13、tocomprehensivelevelofidentificationcapabilitiesandmanagementstandards,amongothers,onameritbasis.ChapterIlRecommendationandDetermination第三条国家知识产权局 联合有关部门共同开展入选知 识产权鉴定机构名录库的知识 产权鉴定机构的遴选工作。省级知识产权行政管理部门及 全国性知识产权鉴定行业自律 组织负责向国家知识产权局推 荐符合基本条件的鉴定机构Q第四条根据知识产权鉴 定工作需要，国家知识产权局 依照本办法的有关要求，适时 组织开展知识产权鉴定机构遴 选工作。第

14、五条知识产权鉴定机 构遴选工作以公开、公平、公 正为原则，坚持高起点、高标 准，根据鉴定能力和管理规范 等方面的综合水平择优确定入 库机构。第二章推荐与确定第六条知识产权鉴定机 构应当具有开展知识产权鉴定 的专业能力。Article6IPRidentificationinstitutionsshallhavetheprofessionalcompetencetoconductIPRidentification.Article7AnidentificationinstitutionrecommendedbyaprovincialIPRadministrativedepartmentoranati

15、onalself-regulatoryorganizationintheIPRindustry(hereinafterreferredtoasarecommendedistitution)shallmeetthefollowingbasicconditions:第七条省级知识产权行政管理部门及全国性知识产权鉴定行业自律组织推荐的鉴定机构（以下简称“被推荐机构”）应当具备以下基本条件：(1)Ithasbeenformedforfiveyearsormoreandhasindependentlegalpersonstatusandindependentofficespace.（一）成立五年（含）以

16、上并具有独立法人资格，具备独立办公场所；(2)Thepaid-inregisteredcapitalis1millionyuan（二）实缴注册资本100万元ormore.以上;(3)IthasthreeyearsormoreofexperienceinundertakingIPRidentificationandhadeverbeenauthorizedbyapeoplescourt,peoplesprocuratorate,publicsecurityorganorIPRadministrativedepartmenttoconductIPRidentification.（三）具有三年（含）

17、以上承担知识产权鉴定工作的经历，承担过人民法院、人民检察院、公安机关或者知识产权行政管理部门的知识产权鉴定委托；(4) It has the technical identification professionals suitable for IPR identification.（四）拥有与知识产权鉴定工作相适应的技术鉴定专业人员；（五）具备与知识产权鉴定工 作相适应的、有效运行的管理 体系，并通过知识产权鉴定国 家标准或者团体标准的贯彻实 施认证；（六）担任机构法定代表人 （负责人）应当符合法律、法 规和规章的规定。(5) Ithasamanagementsystemthatiscomm

18、ensuratewithIPRidentificationandrunssmoothly,andhaspassedthecertificationintermsofimplementationofnationalstandardsorgroupstandardsforIPRidentification.(6) Thelegalrepresentative(personincharge)oftheinstitutionshallcomplywiththeprovisionsoflaws,regulationsandrules.第八条被推荐机构的业 务范围同时涉及法医类、物证 类、声像资料和环境损

19、害鉴定 事项的，应当按规定经司法行 政机关审核登记。Article8Ifthebusinessscopeofarecommendedinstitutionconcurrentlyinvolvesforensic,physicalevidence,audiovisualmaterials,andenvironmentaldamageidentificationmatters,itshallberegistereduponexaminationbythejudicialadministrativeorganasrequired.第九条省级知识产权行 政管理部门及全国性知识产权 鉴定行业自律组织的推

20、荐材料 应当包括以下内容：Article9TherecommendationmaterialssubmittedbyaprovincialIPRadministrativedepartmentoranationalself-regulatoryorganizationintheIPRindustryshallincludethefollowing:（一）省级知识产权行政管理 部门或者全国性知识产权鉴定 行业自律组织加盖部门或组织 公章的被推荐机构入库申请 表；(1) Therecommendedinstitutionsapplicationformforbeingincludedinthedi

21、rectorydatabasetowhichtheofficialsealoftheprovincialIPRadministrativedepartmentorthenationalself-regulatoryorganizationintheIPRindustryisaffixed.（二）被推荐机构基本材料， 包括法人登记证明文件、实缴 注册资本的证明、知识产权鉴 定管理体系认证证书、知识产 权鉴定人资质证书，办公场所 证明等；(2) Basicmaterialsoftherecommendedinstitution,includinglegalpersonregistrationcer

22、tificationdocuments,paid-inregisteredcapitalcertificate,IPRidentificationmanagementsystemcertificationcertificate,IPRidentificationexpertqualificationcertificate,andcertificateonbusinesspremise,amongothers.（三）被推荐机构的遴选自荐 报告（以下简称“自荐报 告”），并附电子版；(3) Theself-recommendationreportforselectionoftherecommend

23、edinstitution(hereinafterreferredtoastheuself-recommendationreportn)towhichanelectronicversionshallbeattached.(4) 1.etterofcommitmentfromtherecommendedinstitution.（五）其他能证明被推荐机构(5) Othermaterialsthatcanprovetheprofessionalcompetenceoftherecommendedinstitution.Article 10 Where an IPR identification in

24、stitution complies with the provisions of Article 7 of these Measures, it may submit a recommendation application to a provincial IPR administrative department or a national self-regulatory organization in the IPR identification industry in accordance with the relevant requirements of these Measures

25、.第十条知识产权鉴定机 构符合本办法第七条规定的， 可以依照本办法有关要求，向 省级知识产权行政管理部门及 全国性知识产权鉴定行业自律 组织提出推荐申请。Article 11 An institution filing an application for recommendation shall ensure that the materials submitted are standardized, true and complete. The provincial IPR administrative department or the national self-regulatory

26、organization in the IPR identification industry shall be responsible for examining and confirming relevant materials.Article 12 After receiving the recommendation materials submitted by a provincial IPR administrative department or a national self- regulatory organization in the IPR identification i

27、ndustry, the CNIPA shall conduct a preliminary examination of the materials. If the materials meet the requirements, a review W川 be organized.第十一条提出推荐申请 的机构应当确保提交的材料规 范、真实、完整。省级知识产 权行政管理部门及全国性知识 产权鉴定行业自律组织负责对 相关材料进行审查确认。第十二条国家知识产权 局收到省级知识产权行政管理 部门及全国性知识产权鉴定行 业自律组织提交的推荐材料 后，对资料进行初步审核。资 料符合要求的，组织开展评 审

28、。Article 13 The CNIPA shall be responsible for organizing the review of recommended institutions.第十三条国家知识产权 局负责组织被推荐机构的评审 工作。Article 14 The specific content of the review of a recommended institution shall include the following:第十四条包括：具体评审内容(1) Period of formation, that is, the number ofyears when t

29、he recommended institution has（一）成立年限，被推荐机构 持续从事知识产权鉴定业务的专业能力水平的资料。consecutivelyengagedintheIPRidentification年限;business.（二）专业人员情况，被推荐 机构持有鉴定相关从业资质或 者培训证书的知识产权鉴定专 业人员数量以及其中拥有高级 以上职称人员人数等；(2) Informationonprofessionals,thatis,thenumberofIPRidentificationprofessionalswhoholdidentification-relatedpract

30、icingqualificationsortrainingcertificatesandthenumberofthosewithseniorprofessionaltitlesorabovethereof,amongothers,intherecommendedinstitution.（三）专业能力，近五年接受 人民法院、人民检察院、公安 机关以及行政管理部门委托案 件数量以及出具鉴定意见被人 民法院、人民检察院、公安机 关以及行政管理部门判案采纳 的数量；(3) Professionalcompetence,thatis,thenumberofcasesinwhichitisauthoriz

31、edbythepeoplescourt,peoplesprocuratorate,publicsecurityorgan,oradministrativedepartmenttoconductidentificationandthenumberofitsopinionsadoptedbythepeoplescourt,peoplesprocuratorate,publicsecurityorgan,oradministrativedepartmentinthetriedcasesinthepastfiveyears.（四）荣誉表彰，近五年被市 级（含）以上人民法院、人民 检察院、公安机关、司法

32、行政 管理部门表彰以及省级（含） 以上主流媒体宣传报道情况；(4) Honorsandcommendations,thatis,commendationsmadebypeople,scourts,people,sprocuratorates,publicsecurityorgansandjudicialadministrativedepartmentsatorabovethemunicipallevel,andthepublicityandreportingbymainstreammediaatorabovetheprovinciallevel.（五）其他与被推荐机构管理 水平、专业能力等有关

33、的情 况。(5) Otherinformationrelatedtothemanagementlevelandprofessionalcompetence,amongothers,oftherecommendedinstitution.国家知识产权局根据每一批次 被推荐机构情况、当年的名录 库动态调整情况和政策要求， 确定最终入库机构。TheCNIPAshalldeterminethefinalinstitutionsincludedinthedirectorydatabasebasedonthestatusofeachbatchofrecommendedinstitutions,thedyn

34、amicadjustmentstothedirectorydatabasethatyear,andpolicyrequirements.第十五条根据评审工作 需要，国家知识产权局可组织 省级知识产权行政管理部门及 全国性知识产权鉴定行业自律 组织对被推荐机构进行现场核 查。Article15Basedontheneedsofthereviewwork,theCNIPAmayorganizeprovincialIPRadministrativedepartmentsandnationalself-regulatoryorganizationsintheIPRidentificationindus

35、trytoconducton-siteinspectionsofrecommendedinstitutions.第十六条在审查确认和 评审等过程中，发现被推荐机 构存在提供虚假材料、编造资 历和业务等情况的，三年内不 得再被推荐入库，国家知识产 权局同时向省级知识产权行政 管理部门、全国性知识产权鉴 定行业自律组织和有关部门通 报不诚信机构名单及相关情 况。Article16Whereitisfoundintheprocessofexamination,confirmationandreview,amongothers,thatanyrecommendedinstitutionhasprovi

36、dedfalsematerialsorfabricatedqualificationsorbusiness,amongothers,itshallnotberecommendedtobeincludedinthedirectorydatabaseagainwithinthreeyears,andtheCNIPAshallconcurrentlynotifythelistofdishonestinstitutionsandrelevantcircumstancestotheprovincialIPRadministrativedepartment,thenationalself-regulato

37、ryorganizationintheIPRidentificationindustry,andrelevantdepartments.第十七条国家知识产权 局根据评审结果，择优确定被 推荐机构作为入选知识产权鉴 定机构名录库的候选机构，经 征求有关部门意见后确认拟入 选机构。入库遴选的评分标 准，在发布推荐通知时公布。Article17TheCNIPAshall,accordingtothereviewresults,determineonameritbasistherecommendedinstitutionsascandidatesforbeingselectedtobeincluded

38、inthedirectorydatabaseofIPRidentificationinstitutions,anddeterminetheinstitutionstobeincludedinthedirectorydatabaseofIPRidentificationinstitutionsaftersolicitingopinionsfromrelevantdepartments.Thescoringcriteriaforbeingselectedtobeincludedinthedirectorydatabaseshallbepublishedwhenarecommendationnoti

39、ceisreleased.第十八条国家知识产权 局对拟入选知识产权鉴定机构 进行公示。公示期满后，正式 公布知识产权鉴定机构名录库 入库机构名单。Article18TheCNIPAshallpublicizetheIPRidentificationinstitutionstobeselectedtobeincludedinthedirectorydatabaseofIPRidentificationinstitutions.Aftertheexpirationofthepublicityperiod,thelistofinstitutionsincludedinthedirectorydata

40、baseofIPRidentificationinstitutionsshallbeofficiallyannounced.第三章监督管理ChapterIIISupervisionandAdministration第十九条国家知识产权 局、省级知识产权行政管理部 门加强对入库知识产权鉴定机 构的监督管理和业务指导。全 国性知识产权鉴定行业自律组 织加强对知识产权鉴定会员机 构的自律管理，发现违法违规 行为的，应当及时向国家知识 产权局和相关部门报告。Article19TheCNIPAandprovincialIPRadministrativedepartmentsshallstrengthen

41、thesupervisionandadministrationofandbusinessguidancefortheIPRidentificationinstitutionsincludedinthedirectorydatabase.Thenationalself-regulatoryorganizationsintheIPRidentificationindustryshallstrengthentheself-regulatorymanagementofthememberIPRidentificationinstitutions,andreportalltheviolationsofla

42、wsandregulationstheyfindtotheCNIPAandrelevantdepartmentsinatimelymanner.第二十条入库知识产权 鉴定机构应当按照国家知识产 权局要求定期提供开展鉴定业 务的相关信息。Article 20 TheIPRidentificationinstitutionsincludedinthedirectorydatabaseshallprovideonaregularbasistherelevantinformationonconductingidentificationbusinessinaccordancewiththerequire

43、mentsoftheCNIPA.第二十一条入库知识产 权鉴定机构一般注册信息变更 的，需向国家知识产权局提交 信息变更申请，及时更新相关 信息。Article 21 WherethegeneralregistrationinformationofanIPRidentificationinstitutionincludedinthedirectorydatabasechanges,theinstitutionshallsubmitaninformationchangeapplicationtotheCNIPAtoupdaterelevantinformationinatimelymanner.入

44、库知识产权鉴定机构涉及法 定代表人（负责人）或者股东 变更、发生重大债务或产生重 大亏损等重大经营事项变更以 及专业人员数量减少超过半数 等可能影响其经营资质或鉴定 能力的，应及时向国家知识产 权局报告，由国家知识产权局 审查确认其入库资格。WherethebusinessqualificationoridentificationcapabilityofanIPRidentificationinstitutionsincludedinthedirectorydatabasemaybeaffectedbythechangeinitslegalrepresentative(personinchar

45、ge)orshareholder,theoccurrenceofanymajorbusinessmatterchangesuchasmajordebtsorlosses,orareductioninthenumberofprofessionalsbymorethanhalfofthetotalnumber,amongothers,itshallreporttotheCNIPAinatimelymanner,andtheCNIPAshallberesponsibleforexaminingandconfirmingitsqualificationforbeingincludedinthedire

46、ctorydatabase.Article22IfanIPRidentificationinstitutionfallsunderanyofthefollowingcircumstances,theCNIPAshallmakeadecisiontocancelitsqualificationforbeingincludedinthedirectorydatabaseofIPRidentificationinstitutions:第二十二条知识产权鉴定机构有下列情形之一的，国家知识产权局应当作出取消其知识产权鉴定机构名录库资格的处理决定：(1)Itconcealsrelevantinformat

47、ion,providesfalsematerials,orisselectedbyimpropermeanssuchasbriberyorfraud.（一）隐瞒有关情况、提供虚假材料，或者采取贿赂、欺骗等不正当手段通过遴选的；(2) Itisdisqualifiedfromornolongermeetstheconditionsforbeingincludedinthedirectorydatabase.(3) ItcommitsanyviolationoflawsorregulationswhenengagingintheIPRidentificationwork,whichhasbeenv

48、erifiedtobetrue.(4) Itfailstosubmitinformationonaregularbasisasrequired,andstillfailstodosoafterbeingurgedbytheStateIntellectualPropertyOfficebyanotice.(5) Itisdisqualifiedfrombeingincludedinthedirectorydatabaseasrequiredbythepeople,scourt,peoplesprocuratorate,publicsecurityorgan,ortheadministrativedepartmentforanyofitsotherviolationsoflawsordisciplines.(6) Otheractsthatcauseadversesocialeffectsandmakeitineligibleforbeingincludedinthedirectorydatabase.（二）丧失入库资格/条件的;（三）从事知识产权鉴定工作存在违法违规行为并经查证属实的；（四）未按照要求定期报送信息，且经国家知识产权局催告后仍未报送的；（五）存在其他违规违纪情形，被
