4、nofMandatoryNationalStandards(IssuedbyOrderNo.25oftheStateAdministrationforMarketRegulationonJanuary6,2020)Article1TheseMeasuresaredevelopedinaccordancewiththeStandardizationLawofthePeoplesRepublicofChinaforthepurposesofstrengtheningtheadministrationofmandatorynationalstandardsandregulatingthedevelo

5、pment,implementation,andsupervisionofmandatorynationalstandards.Article2TheseMeasuresshallapplytothedevelopment(includingprojectproposing,projectinitiation,drafting,requestforcomments,technicalreview,publicnotification,numbering,andissuanceapproval),organizationandimplementation,andsupervisionofmand

6、atorynationalstandards.Article3Mandatorynationalstandardsshallbedevelopedfortechnicalrequirementsthatprotecthumanhealthandlifeandpropertysafety,safeguardnationalsecurityandenvironmentalsafety,andthatmeetthebasicneedsofeconomicandsocialadministration.强制性国家标准管理办法（2020年1月6日国家市场监督管理 总局令第25号公布）第一条为了加强强制性

7、国家标 准管理，规范强制性国家标准的制 定、实施和监督，根据中华人民共 和国标准化法，制定本办法。第二条强制性国家标准的制定 （包括项目提出、立项、组织起草、 征求意见、技术审查、对外通报、编 号、批准发布）、组织实施以及监督 工作，适用本办法。第三条对保障人身健康和生命 财产安全、国家安全、生态环境安全 以及满足经济社会管理基本需要的技 术要求，应当制定强制性国家标准。第四条 制定强制性国家标准应 当坚持通用性原则，优先制定适用于 跨领域跨专业的产品、过程或者服务 的标准。Article4Inthedevelopmentofmandatorynationalstandards,theprin

8、cipleofuniversalityshallbeadheredto,withprioritygiventothedevelopmentofstandardsapplicabletotheproducts,processesorservicesacrossdifferentfieldsanddisciplines.Article5Thedevelopmentofmandatorynationalstandardsshallentailanin-depthinvestigationanddemonstrationonthebasisofscientificandtechnologicalres

9、earchachievementsandexperiencefromsocialpracticestoensurethatthestandardsaredevelopedinascientific,normativeandtimelymanner.Article6Inthedevelopmentofmandatorynationalstandards,internationalstandardsshallbeadoptedinlightofnationalconditions.Article7Thedevelopmentofmandatorynationalstandardsshallbeop

10、enandtransparent,andvariousmethodsshallbeadoptedundertheprincipleofconvenienceandeffectivenesstoaskallpartiesfortheiropinions.Article8Thereshallbeaspecificdepartmentresponsibleforsupervisingandadministeringtheimplementationofmandatorynationalstandards,whichmaydealwithanyviolationofmandatorynationals

11、tandardsinaccordancewiththeprovisionsoflaws,administrativeregulationsordepartmentalrules.第五条制定强制性国家标准应 当在科学技术研究成果和社会实践经 验的基础上，深入调查论证，保证标 准的科学性、规范性、时效性。第六条 制定强制性国家标准应 当结合国情采用国际标准。第七条制定强制性国家标准应 当公开、透明，按照便捷有效的原则 采取多种方式，广泛听取各方意见。第八条强制性国家标准应当有 明确的标准实施监督管理部门，并能 够依据法律、行政法规、部门规章的 规定对违反强制性国家标准的行为予 以处理。第九条 国务

12、院标准化行政主管 部门统一管理全国标准化工作，负责 强制性国家标准的立项、编号和对外 通报。国务院有关行政主管部门依据 职责负责强制性国家标准的项目提 出、组织起草、征求意见和技术审Article9TheadministrativedepartmentforstandardizationundertheStateCouncilshalladministerstandardizationacrossthecountryinacentralizedway.Itshallberesponsiblefortheprojectinitiation,numbering,andpublicnotificat

13、ionofmandatorynationalstandards.TherelevantadministrativedepartmentsundertheStateCouncilshall,accordingtotheirrespectivefunctions,beresponsibleforprojectproposing,projectinitiation,drafting,requestforcomments,andtechnicalreview.TheissuanceofmandatorynationalstandardsshallbeapprovedbytheStateCouncilo

14、rtheapprovalthereofshallbeauthorizedbytheStateCouncil.Theadministrativedepartmentsforstandardizationandtherelevantadministrativedepartmentsunderthepeople,sgovernmentsatorabovethecountylevelshall,accordingtotheirstatutoryfunctions,superviseandinspecttheimplementationofmandatorynationalstandards.Artic

15、le10Theadministrativedepartmentforstandardizationofaprovince,autonomousregionormunicipalitydirectlyundertheCentralGovernmentmayproposetheinitiationofamandatorynationalstandardprojecttotheadministrativedepartmentforstandardizationundertheStateCouncil,whichshall,alongwiththerelevantadministrativedepar

16、tmentsundertheStateCouncil,studyanddecideonsuchproposal.Ifthedevelopmentofmandatorynationalstandardsisindeedrequired,theadministrativedepartmentforstandardizationundertheStateCouncilshallgiveexplicitinstructionstotheprojectproposingdepartment;ifnoprojectinitiationisrequired,reasonsshallbeexplained.查

17、。强制性国家标准由国务院批准发 布或者授权批准发布。县级以上人民政府标准化行政主管部 门和有关行政主管部门依据法定职 责，对强制性国家标准的实施进行监 督检查。第十条省、自治区、直辖市人 民政府标准化行政主管部门可以向国 务院标准化行政主管部门提出强制性 国家标准的立项建议，由国务院标准 化行政主管部门会同国务院有关行政 主管部门研究决定确有必要制定强 制性国家标准的，国务院标准化行政 主管部门应当明确项目提出部门，无 需立项的应当说明理由。社会团体、企业事业组织以及公民可以向国务院标准化行政主管部门提出强制性国家标准的立项建议，国务院Asocialgroup,enterprise,publi

18、cinstitution,orcitizenmayproposetheinitiationofamandatorynationalstandardprojecttotheadministrativedepartmentforstandardizationundertheStateCouncil,whichshall,alongwiththerelevantadministrativedepartmentsundertheStateCouncil,studyanddecideonsuchproposalifitdeemsthatprojectinitiationisneeded.Ifthedev

19、elopmentofmandatorynationalstandardsisindeedrequired,theadministrativedepartmentforstandardizationundertheStateCouncilshallgiveexplicitinstructionstotheprojectproposingdepartment;ifnoprojectinitiationisrequired,reasonsshallbeexplained.Article11TherelevantadministrativedepartmentsundertheStateCouncil

20、shall,inaccordancewiththeirfunctionsandduties,proposeamandatorynationalstandardprojecttotheadministrativedepartmentforstandardizationundertheStateCouncil.AmandatorynationalstandardprojectinvolvingtwoormorerelevantadministrativedepartmentsundertheStateCouncilmaybejointlyproposedbytheleaddepartmenttog

21、etherwithrelevantdepartments.标准化行政主管部门认为需要立项 的，会同国务院有关行政主管部门研 究决定。确有必要制定强制性国家标 准的，国务院标准化行政主管部门应 当明确项目提出部门，无需立项的应 当说明理由。第十一条 国务院有关行政主管 部门依据职责向国务院标准化行政主 管部门提出强制性国家标准项目。涉及两个以上国务院有关行政主管部 门的强制性国家标准项目，可以由牵 头部门会同有关部门联合提出。第十二条 国务院有关行政主管 部门提出强制性国家标准项目前，应 当充分征求国务院其他有关行政主管 部门的意见，调查企业事业组织、社 会团体、消费者和教育、科研机构等 方面的

22、实际需求，对项目的必要性和 可行性进行论证评估。Article12Beforeproposingamandatorynationalstandardproject,therelevantadministrativedepartmentsundertheStateCouncilshallfullysolicitcommentsfromotherrelevantadministrativedepartmentsundertheStateCouncilandinvestigatetheactualneedsofenterprises,institutions,socialgroups,consume

23、rsandeducationalandscientificresearchinstitutionsinabidtoevaluateanddemonstratethenecessityandfeasibilityoftheproject.Article13Whenproposingamandatorynationalstandardproject,therelevantadministrativedepartmentsundertheStateCouncilshallsubmitaprojectapplicationandadraftforstandardinitiation.Theprojec

24、tapplicationshallincludethefollowing:(1) Thenecessityandfeasibilityofdevelopingmandatorynationalstandards;(2) Maintechnicalrequirements;(3) Thedevelopmentofrelevantdomesticmandatorystandardsandsupportingrecommendedstandards;(4) Thedevelopmentofrelevantlaws,regulationsandstandardsoftheInternationalOr

25、ganizationforStandardizationandothercountriesorregions;(5) Theimplementation,supervisionandadministrationdepartmentsofmandatorynationalstandardsandthebasisofrelevantlaws,administrativeregulationsanddepartmentalrulesfordealingwithviolationsofmandatorynationalstandards;(6) Thecatalogueofproducts,proce

26、ssesorservicesinvolvedinmandatorynationalstandards;第十三条 国务院有关行政主管 部门提出强制性国家标准项目时，应 当报送项目申报书和标准立项草案。 项目申报书应当包括下列内容：（一）制定强制性国家标准的必要 性、可行性；（二）主要技术要求;（三）国内相关强制性标准和配套推 荐性标准制定情况；（四）国际标准化组织、其他国家或 者地区相关法律法规和标准制定情 况；（五）强制性国家标准的实施监督管 理部门以及对违反强制性国家标准行 为进行处理的有关法律、行政法规、 部门规章依据；（六）强制性国家标准所涉及的产 品、过程或者服务目录；（七）征求国务院

27、有关部门意见的情 况；(7) SolicitingopinionsfromrelevantdepartmentsundertheStateCouncil;(8) Thebudgetandschedule;and(9) Othermatterstobesubmitted.Article14TheadministrativedepartmentforstandardizationundertheStateCouncilshallexaminemandatorynationalstandardprojectsaccordingtothefollowingrequirements:(1) Whethe

28、ritcomplieswiththeprovisionsofArticles3and4oftheseMeasures;(2) Whetheritcomplieswiththeprovisionsofrelevantlawsandadministrativeregulationsandwhetheritcoordinateswiththetechnicalrequirementsforrelevantmandatorystandards;(3) WhetheritcomplieswiththerequirementsofArticles12and13oftheseMeasures;and(4)

29、Othercontentstobeexamined.Article15TheadministrativedepartmentforstandardizationundertheStateCouncilshallsolicitpubliccommentsonmandatorynationalstandardprojectsthatconformtotheprovisionsofArticle14oftheseMeasuresthroughtheNationalPublicServicePlatformforStandardsInformation.（）经费预算以及进度安排；（九）需要申报的其他事

30、项。第十四条国务院标准化行政主 管部门应当按照下列要求对强制性国 家标准项目进行审查：（一）是否符合本办法第三条和第四 条规定的原则；（二）是否符合有关法律、行政法规 的规定，是否与有关强制性标准的技 术要求协调衔接；（三）是否符合本办法第十二条和第 十三条的要求；（四）需要审查的其他内容。第十五条国务院标准化行政主 管部门应当将符合本办法第十四条规 定的强制性国家标准项目在全国标准 信息公共服务平台向社会公开征求意 见。征求意见期限不得少于三十日。紧急 情况下可以缩短征求意见期限，但一 般不得少于七日。Theperiodforsolicitationofpubliccommentsshall

31、benolessthan30days.Incaseofemergency,theperiodforsolicitationofpubliccommentsmaybeshortened,butgenerallyitshallbenolessthansevendays.Article16Forthecommentspostedbythepublic,theadministrativedepartmentforstandardizationundertheStateCouncilmay,asrequired,employexpertstodemonstrateandholdmeetingsforco

32、ordinationorforprovidingfeedbacktotheprojectproposingdepartment,whichshallstudyanddealwiththem.Article 17 TheadministrativedepartmentforstandardizationundertheStateCouncilmay,accordingtoexaminationcommentsandcoordination,decidewhethertoconductprojectinitiation.Ifadecisionismadetoinitiateaproject,the

33、administrativedepartmentforstandardizationundertheStateCouncilshallassignaprojectplanandspecifytheorganizinganddraftingdepartmentandthetimelimitforsubmission,approvalandissuance.IftwoormorerelevantadministrativedepartmentsundertheStateCouncilareinvolved,theleadorganizinganddraftingdepartmentshallbes

34、pecified.Ifadecisionismadenottoinitiateaproject,theadministrativedepartmentforstandardizationundertheStateCouncilshall,inwrittenform,informtheprojectproposingdepartmentofthereasonsfornotinitiatingtheproject.Article 18 Theorganizinganddraftingdepartmentmayentrusttherelevanttechnicalcommitteeforstanda

35、rdizationwiththedraftingwork.第十六条对于公众提出的意见，国务院标准化行政主管部门根据需要可以组织专家论证、召开会议进行协调或者反馈项目提出部门予以研究处理。第十七条国务院标准化行政主管部门应当根据审查意见以及协调情况，决定是否立项。决定予以立项的，国务院标准化行政主管部门应当下达项目计划，明确组织起草部门和报送批准发布时限。涉及两个以上国务院有关行政主管部门的，还应当明确牵头组织起草部门。决定不予立项的，国务院标准化行政主管部门应当以书面形式告知项目提出部门不予立项的理由。第十八条组织起草部门可以委托相关标准化技术委员会承担起草工作。未组成标准化技术委员会的，组织

36、起 草部门应当成立起草专家组承担强制 性国家标准起草工作。涉及两个以上 国务院有关行政主管部门的强制性国 家标准项目，牵头组织起草部门应当 会同其他组织起草部门成立起草专家 组。起草专家组应当具有权威性和代 表性。第十九条强制性国家标准的技 术要求应当全部强制，并且可验证、 可操作。强制性国家标准编写应当遵守国家有 关规定，并在前言中载明组织起草部 门信息，但不得涉及具体的起草单位 和起草人信息。第二十条强制性国家标准应当 对相关事项进行调查分析、实验、论 证。有关技术要求需要进行试验验证的， 应当委托具有相应能力的技术单位开展Q第二十一条起草强制性国家标 准应当同时编写编制说明。编制说明If

37、atechnicalcommitteeforstandardizationisnotformed,theorganizinganddraftingdepartmentshallestablishadraftingpanelofexpertsthatundertakesthedraftingofmandatorynationalstandards.FormandatorynationalstandardprojectsinvolvingtwoormorerelevantadministrativedepartmentsundertheStateCouncil,theleadorganizinga

38、nddraftingdepartmentshall,togetherwithotherorganizinganddraftingdepartments,formadraftingpanelofexperts.Thedraftingpanelofexpertsshallbeauthoritativeandrepresentative.Article 19 Thetechnicalrequirementsformandatorynationalstandardsshallbefullymandatory,andshallbeverifiableandoperable.Thepreparationo

39、fmandatorynationalstandardsshallcomplywiththerelevantprovisionsofthestateandspecifytheinformationontheorganizinganddraftingdepartmentinthepreface,butshallnotinvolvethespecificdraftingentityordrafter.Article 20 Mandatorynationalstandardsshallinvestigate,analyze,experimentanddemonstraterelevantmatters

40、.Iftherelevanttechnicalrequirementsneedtobetestedandverified,thetechnicalentitieswithcorrespondingcapabilitiesshallbeauthorizedtoconductsuchtests.Article 21 Compilationinstructionsshallbepreparedsimultaneouslyforthedraftingofmandatorynationalstandards.Thecompilationinstructionsshallincludethe应当包括下列内

42、ncludingverificationreports,statisticaldata)andthereasons;（三）与有关法律、行政法规和其他 强制性标准的关系，配套推荐性标准 的制定情况；(3) Therelationshipwithrelevantlaws,administrativeregulationsandothermandatorystandards,andthedevelopmentofsupportingrecommendedstandards;（四）与国际标准化组织、其他国家 或者地区有关法律法规和标准的比对 分析；(4) Acomparativeanalysisoft

43、helaws,regulationsandstandardsrelatingtotheInternationalOrganizationforStandardizationorothercountriesorregions;（五）重大分歧意见的处理过程、处 理意见及其依据；(5) Thehandlingprocessandopinionsofmajordifferencesandthebasisthereof;（六）对强制性国家标准自发布日期 至实施日期之间的过渡期（以下简称 过渡期）的建议及理由，包括实施强 制性国家标准所需要的技术改造、成 本投入、老旧产品退出市场时间等；(6) Propo

44、salsandreasonsforthetransitionalperiodbetweenthedateofissuanceandthedateofimplementationofmandatorynationalstandards(hereinafterreferredtoasthetransitionalperiodn),includingthetechnicaltransformationandcostinputrequiredfortheimplementationofmandatorynationalstandardsandthetimeforwithdrawalofoldprodu

45、ctsfromthemarket.(7) Policiesandmeasuresrelatedtotheimplementationofmandatorynationalstandards,includingtheimplementation,supervisionandadministrationdepartmentsandthebasisofrelevantlaws,administrativeregulationsanddepartmentalrulesfordealingwithviolationsofmandatorynationalstandards;(8) Proposalsan

46、dreasonsfortheneedforpublicnotification;(9) Proposalsforabolishingtheexistingrelevantstandards;(10) Relevantexplanationsrelatingtopatents;(11) Thecatalogueofproducts,processesorservicesinvolvedinmandatorynationalstandards;and(12) Otherissuesthatshallbeexplained.Article 22 Theorganizinganddraftingdep

47、artmentshallsolicitcommentsinwritingfromtherelevantadministrativedepartments,enterprises,publicinstitutions,socialgroups,consumerorganizations,educationalandscientificresearchinstitutions,amongothers.（七）与实施强制性国家标准有关的 政策措施，包括实施监督管理部门以 及对违反强制性国家标准的行为进行 处理的有关法律、行政法规、部门规 章依据等；（A）是否需要对外通报的建议及理 由；（九）废止现行有
