2、igiblesourcecountriesasdefinedundertheguidelinesforprocurementoftheworldbank.2._companynowinvitessealedtendersfrompre-qualifiedtenderersforprovisionofthenecessarylabour,materials,equipmentandservicesfortheconstructionandcompletionoftheproject.3.pre-qualifiedtenderersmayobtainfurtherinformationfrom,a

3、ndinspectthetenderdocumentsattheofficeof:_.4.acompletesetoftenderdocumentsmaybeobtainedbyanypre-qualifiedtendererforthecostofrmb_orus$_onthesubmissionofawrittenapplicationtotheabove.5.alltendersmustbeaccompaniedbyatendersecurityinanacceptableformandmustbedeliveredto_companyattheabove-mentionedaddres

4、s(refertoitem3)onorbefore_.6.tenderswillbeopenedinthepresenceofthosetenderersrepresentativeswhochoosetoattendat_(time).7.ifaprequalifiedforeigntendererwishestoformjointventurewithadomesticcontractor,sucharequestwillbeconsideredifreceivedwithin_daysbeforetheclosingdateforsubmissionoftenders.theselect

5、edlocalcontractorshallbesubjecttoapprovalbytheemployer.8.thepre-tendermeetingwillbeheldon_atthefollowingaddress:_.instructionstotenderersgeneral1.descriptionofworks(sketch)alltenderersshallhaveequalaccessforsupplyofdomesticlabourandmaterial.thecontractorshallmakehisownarrangementsfortheprocurementof

6、locallabour,materials,transportationandotherservices.theemployerwillassistcontractorinlocatingpotentialnumberofsuppliersforlocallabour,materials.theemployerwillalsoassistthecontractorinmakinghisownarrangementforsupplyoffuelandexplosives.2.sourceoffunds2.1thepeoplesrepublicofchinahasappliedforaloanan

7、dcreditfromtheworldbank(hereinafterreferredtoastheifi)towardsthecostof_project,andintendstoapplyaportionoftheproceedsoftheloanandcredittoeligiblepaymentsunderthecontractforwhichthesedocumentsareissued.paymentbytheifiwillbemadeonlyattherequestofthechinesegovernmentanduponapprovalbytheifiandwillbesubj

8、ectinallrespectstothetermsandconditionsoftheloanagreement.nopartyotherthanthepeoplesrepublicofchinashallderiveanyrightsfromtheloanagreementorhaveanyclaimtotheloanproceeds.2.2paymentfromtheproceedsoftheworldbankloanwillbelimitedtogoodsproducedin,andservicessuppliedfrom,switzerlandandthemembercountrie

9、softheworldbankwhichhavecommercialrelationswithchina.2.3allcostsnotmetbytheifiloanwillbepaidbytheemployerfromfundsallocatedbythegovernmentofchina.3.eligibilityandqualificationrequirements3.1thistenderisopentoallpre-qualifiedtenderersfromeligiblesourcecountriesasdefinedundertheguidelinesforprocuremen

10、toftheworldbank.3.2allgoodsandservicestobesuppliedunderthiscontractshallhavetheiroriginineligiblesourcecountries,andallexpendituresmadeunderthecontractwillbelimitedtosuchgoodsandservices.3.3theoriginofgoodsandservicesisdistinctfromthenationalityofthetenderer.3.4tobeeligibleforawardofcontract,tendere

11、rsshallhaveprovidedevidencesatisfactorytotheemployeroftheireligibilityunderclause3.1above,andoftheircapabilityandadequacyofresourcestoeffectivelycarryoutthecontract.tothisend,theemployerand_companymay,atanytimepriortoawardofcontract,requesttendererstoamplifyorupdatepreviouslysubmittedprequalificatio

12、ndata.alltenderssubmittedsha【正文】includethefollowinginformation:(a)copiesoforiginaldocumentsdefiningtheconstitutionorlegalstatus,placeofregistrationandprincipalplaceofbusinessofthecompany,firmorpartnershipor,ifajointventure,ofeachpartytheretoconstitutingthetenderer;(b)thequalificationsandexperienceof

13、keypersonnelproposedforadministrationandexecutionofthecontract,bothonandoffsite,intheformatprescribedinschedulev;(c)majoritemsofconstructionalplantandequipmentproposedforuseincarryingoutthecontractintheformatprescribedinscheduleiv;(d)alistofproposedsub-contractorsintheformatprescribedinschedulevi;(e

14、)informationregardinganycurrentlitigationinwhichthetendererisinvolved;(f)thedetailsoftheconstructionmethodsproposed.3.5forthepurposesofsub-clause3.4,tendererswhohavebeenpre-qualifiedmayupdateandaugmenttheinformationsuppliedwiththeirapplicationforpre-qualification,and,inparticular,shallgiveparticular

15、sofworkinhandatthedateoftendering.3.6tenderssubmittedbyajointventureoftwoormorefirmsaspartnersshallcomplywiththefollowingrequirements:(a)thetender,andincaseofasuccessfultendertheformofagreement,shallbesignedsoastobelegallybindingonallpartners;(b)oneofthejointventuremembersshallbenominatedassponsor;a

16、ndthisauthorisationshallbeevidencedbysubmittingapowerofattorneysignedbylegallyauthorisedsignatoriesofallthemembersofthejointventure;(c)thejointventuresponsorshallbeauthorisedtoincurliabilitiesandreceiveinstructionsforandonbehalfofanyandallmembersofthejointventureandtheentireexecutionofthecontractinc

17、ludingpaymentshallbedoneexclusivelywiththejointventuresponsor;(d)allmembersofthejointventureshallbeliablejointlyandseverallyfortheexecutionofthecontractinaccordancewiththecontractterms,andarelevantstatementtothiseffectshallbeincludedintheauthorisationmentionedunder(b)aboveaswellasintheformoftenderan

18、dtheformofagreement(incaseofasuccessfultender);and(e)acopyoftheagreemententeredintobythejointventurepartnersshallbesubmittedwiththetender.3.7domestictenderersorcombinationsorjointventuresofdomesticandforeigntenderersapplyingforeligibilityfortheapplicationofa_%marginofpreferenceinthecomparisonoftheir

19、tenderwithothertendersshallsupplyallinformationrequiredtosatisfythecriteriaforeligibilityasdescribedinclause29oftheseinstructions.4.costoftenderingthetenderershallbearallcostsassociatedwiththepreparationandsubmissionofhistenderandneithertheemployernorhisagent_companywillinanywayberesponsibleorliable

20、forthosecosts,regardlessoftheoutcomeofthetenderingprocess.5.sitevisit5.1thetendererisadvisedtovisitandexaminethesiteoftheworksandthesurroundingsandtoobtainforhimselfonhisownresponsibility,allinformationthatmaybenecessaryforpreparingthetenderandenteringintoacontract.thecostsofvisitingthesiteshallbeat

21、thetenderersownexpense.5.2arrangementsforavisittosite,includingtransportationandaccommodation.willbemadebytheemployerorhisagent_companyandwillbeadvisedtotenderersatthepre-tendermeeting,detailsofwhicharegiveninclause16oftheseinstructionstotenderers.,5.3thetendererandanyofhisrepresentativeswillbegrant

22、edpermissionbytheemployerorhisagent_companytoenteruponitspremisesandlandsforthepurposeofsuchinspectionbypriorarrangement,butonlyupontheexpressconditionthatthetendererandhisrepresentatives,willreleaseandindemnifytheemployerorhisagent_companyanditspersonnelfromandagainstallliabilityinrespectthereofand

23、willberesponsibleforpersonalinjury(whetherfatalorotherwise),lossofordamagetopropertyandanyotherloss,damage,costsandexpenseshowevercaused,which,butfortheexerciseofsuchpermission,wouldnothavearisen.tenderdocuments6.contentoftenderdocuments6.1thesetofdocumentsissuedtopre-qualifiedtenderersforthepurpose

25、dersecuritybillofquantitiesschedulesofsupplementaryinformation1volume4drawings6.2tenderdocumentsshallincludeanyaddendaissuedpriortotheclosingdateoftendersinaccordancewithclause8andanyminutesofpre-tendermeetingsissuedinaccordancewithclause16oftheseinstructionstotenderers.6.3furthercopiesofthedocument

26、smaybepurchasedbypre-qualifiedtenderersforanon-refundablefeeasfollows:(sketch)6.4sub-contractors,manufacturers,suppliersandotherswhorequirecopiesofthedocumentsshallnotrequestthemdirectlyfrom_butshallobtainthemonlyfrompre-qualifiedtenderers.6.5onreturnofthedocumentsinanundamagedanduseablecondition,ei

29、dbymechanicalmeansandtenderersshouldchecktoensurethattheycontaina【正文】pages(whicharenumberedconsecutively)andthatallsupplementsreferredtoarealsoincluded.7.clarificationoftenderdocuments7.1aprospectivetendererrequiringanyclarificationofthetenderdocumentsmaynotify_inwritingorbytelexatthefollowingaddres

30、s:_.theemployerorhisagent_willrespondinwritingtoanyrequestforclarificationwhichisreceivedmorethan_dayspriortothedeadlineforsubmissionoftenders.writtencopiesoftheresponse(includinganexplanationofthequery,butwithoutidentifyingthesourceoftheinquiry)willbesenttoallprequalifiedtendererswhohavebeenissuedw

31、ithtenderdocuments.8.amendmentoftenderdocuments8.1priortothedeadlineforsubmissionoftenders,theemployermay,foranyreason,whetheratitsowninitiativeorinresponsetoaclarificationrequestedbyaprospectivetenderer,modifythetenderdocumentsbytheissueofanaddendum.8.2theaddendumwillbesentinwritingorbytelexorteleg

32、ramtoallpre-qualifiedtendererswhohavepickedupthetenderdocumentsandwillbebindinguponthem.prospectivetenderersshallpromptlyacknowledgereceiptthereofbytelexortelegramto_.8.3inordertoaffordprospectivetenderersreasonabletimeinwhichtotakeanaddendumintoaccountinpreparingtheirtenders,theemployerorhisagent_m

33、ay,attheirdiscretion,extendthedeadlineforthesubmissionoftendersinaccordancewithclause19hereof.preparationoftenders9.languageoftender9.1thetenderandallcorrespondencerelatingtothetenderexchangedbythetendererandtheemployerorhisagent_shallbeinenglish.supportingdocumentsandprintedliteraturefurnishedbythe

34、tendererwiththetendermaybeinanotherlanguageprovidedtheyareaccompaniedbyanappropriateenglishtranslationofpertinentpassages.forthepurposeofinterpretationofthetender,theenglishversionshallprevail.10.documentscomprisingthetender10.1thetendertobepreparedbythetenderershallcontainthefollowing:theformoftend

35、erandappendixthereto;thetendersecurity;thepricedbillofquantities;theschedulesofsupplementaryinformation;theinformationoneligibilityandqualifications;alternativeoffers,ifany;andanyotherinformationrequiredtobesubmittedinaccordancewiththeseinstructions.theforms,billofquantitiesandschedulesprovidedinvol

36、ume3ofthesedocumentsshallbeusedwithoutexception(subjecttoextensionsoftheschedulesinthesameformat,andtotheprovisionsofclause14.2hereofregardingthealternativeformsoftendersecurity).10.2alldocumentsissuedforthepurposeoftenderingasdescribedinclause6.1andaddendaissuedinaccordancewithclause8shallbedeemedi

37、ncorporatedinthetender.tenderdocumentsnotrequiredtobesignedandsubmittedinaccordancewithclauses17and18shallbereturnedtotheofficeofissuebeforetheexpiryofthetendervalidityperiod,butmustnotbeenclosedwiththetender.10.3tenderersshallsubmitwiththeirtenderapreliminaryprogrammeintheformatrequiredbyclause14of

38、theconditionsofcontract.10.4thesuccessfultendererwillberequiredtoreviseoraugmenthisprogrammeassetoutinthecontract.11.tenderprices11.1unlessexplicitlystatedotherwiseinthetenderdocuments,thecontractshallbeforthewholeoftheworks_asdescribedinclause1hereof,basedontheschedulesofunitratesandamountssubmittedbythetenderer.11.2thetenderershallfillinratesandamountsforallitemsofworkdescribedinthebillofquantities,whetherquantitiesarestatedornot.itemsagainstwhichnorateoramountisenteredbythetendererwillnotbepaidforbytheemployerwhenexecutedandshallbedeemedcoveredbytheotherratesandamountsenteredinthebillofq
