1、propertyinsuranceclauseswholedoc.i.thepropertyinsuredthepropertyinsuredshallrefertoallpropertiesandexpensesspe-cifiedinthescheduleofthispolicy.unlessspecificallyagreeduponinwritingbetweentheinsuredandthecompanyandappraisedandvalue-establishedbyprofessionalsorassessors,thefollowingarticlesandtheexpen

2、sesrelevanttheretoshallnotbecoveredunderthispolicy:1.gold,silver,pearls,diamonds,preciousstonesandjades;2.antiques,articlesofvirtue,ancientcoins,ancientbooksandancientpaintings;3.worksofartorpostagestamps;4.advertisements,aerials,neon,piecesofsolarenergyapparatusetc.onbuildings;putersystemrecordsori

3、tsmakingandcopyingcosts.undernocirc umstancesshallthefollowingarticlesrelevanttheretobecoveredhereunder:1.guns,ammunitionorexplosives;2.banknotes,securities,bills,documents,files,accountbooksordrawings;3.animals,plantsandagriculturalcrops;4.mobilephones,portablecomputers,removablephotographapparatus

4、orotherpreciousarticles;5.vehicleslicensedforgeneraltransportuse.ii.scopeofcoverthecompanyshallindemnifytheinsuredinrespectofthephysicallossofordamagetotheinsuredpropertystatedinthescheduleduringtheperiodofinsurancedirectlyarisingfromthefollowingperils:1.fire;2.explosion;butnotincludingexplosionofab

5、oilerorotherpressurereliefdevices;3.lightning;4.hurr icane,typhoonandtornado;5.storm,tempestandflood;butnotincludinglossordamagecausedbychangeinnormalwaterlevelorinundationfromseawaterorwaterescapeorleakagefromthenormalconfinesofanynaturalwatercourse,lakeorreservoir,canalordamaswellaslossofordamaget

6、otheinsuredpropertycausedbystorm,tempestorfloodwhilebeingstoredintheopenorcoveredbyorunderashedthatchedwithreeds,tarpaulins,straw,asphaltfelt,plasticornylonsheet;6.hailstorm;7.landslide,rockslide,avalanche;8.volcanicexplosion;9.subsidenceofground;butnotincludinglossordamageresultingfrompiledriving,g

7、roundworkorexcavation;10.crashingaircraftandpartsorarticlesfallingfromaircraftandotherflyingobjects;11.burstingofwate rtankorpipe;butnotincludingburstingofwatertankorpipeduetorust.iii.exclusionsthiscompanyshallnotbeliablefor:1.lossofordamagetotheinsuredpropertyorexpensescausedbyintentionalactorgross

8、negligenceoftheinsuredorhisrepresentative;2.lossofordamagetotheinsuredpropertycausedandexpensesincurredbyearthquakeortsunami;3.depreciation,lossofmarket,lossofuseandotherconsequentiallossesofanydescription;4.lossofordamagetotheinsuredpropertyorexpensesincurredarisingfromwar,warlikeoperation,hostilit

9、ies,armedconflicts,terrorism,conspiracyinsurrection,coupdetat,strike,riot,andcivilcommotion;5.confiscation,requisition,destructionordamagebyanyactionor orderofanygovernmentdejureordefactoorbyanypublicauthorities;6.lossofordamagetoinsuredpropertydirectlyorindirectlycausedorexpensesincurredbynuclearfi

10、ssion,nuclearfusion,nuclearweapon,nuclearmaterial,nuclearradiationandradioactivecontamination;7.lossordamagecausedandexpensesincurredbypollutionofanykindordescriptionwhatsoeversuchasatmosphere,landandwaterpollutionsbutthisdoesnotincludelossordamagecausedbypollutionarisingfromperilsspecifiedinarticle

11、iithepolicy;8.thedeductiblesstatedinthescheduletobebornebytheinsured;9.lossordamagearisingfromanyotherperilsnotlistedinarticleiiofthispolicy.iv.treatmentofclaim1.thecompanyshallatitsoption,indemnifytheinsuredinrespectoflossordamagefallingwithinthescopeofcove rofthepolicybyeither:1.1payingtheamountof

12、theactualvalueofthepropertylostordamagedor;1.2payingthenecessarycostofrepairingorrestoringthedamagedpropertytoitsnearestconditionimmediatelyprecedingthedamageor;1.3repairingorrestoringthedamagedpropertytoaconditionneartootherpropertyoflikekindandquality.2.indemnityunderthispolicyshallbebaseduponthes

13、oundmarketvalueofthepropertyprevailingatthetimeofloss.ifthesoundmarketvalueofthedamagedpropertyislowerthanthesuminsuredofsuchproperty,theclaimshallbesettledonitsmarketvalue;ifthesoundmarketvalueofthepropertyisinexcessofthesuminsured,thecompanyshallonlybeliableforsuchproportionoftheclaimasthesuminsur

14、edofthedamagedpropertybearstoitssoundmarketvalue.iftheinsuredpropertyenumeratedinthesched uleismorethanoneitem,theprovisionofthisclauseshallapplytoeachthereof.3.ifaclaimforlossofordamagetotheinsureditemissettledonatotallossbasis,thesalvagevalueofsuchitemshallbedeductedfromtheindemnitypayablebythecom

15、pany.thecompanymay,atitsoption,declinetheabandonmentofanydamagedpropertybytheinsured.4.intheeventoflossofordamagetoanyequipmentiteminsuredformingpartofapairorset,thecompanyshallnotbeliableinrespectofeachofsuchitemlostordamagedformorethanitsproportionatepartofthesuminsuredonthecompletepairorset.5.int

16、heeventofanylossoccurrence,thecompanyshallalsopaytheinsuredfortheexpensesreasonablyincurredfortakingnecessarymeasurestominimizelossordamagetotheleastextent,butinnocaseshallsuchexpensesreferredheretoexceedthesuminsuredoftheinsuredproperty.6.uponsettlementofaclaim,anendorsementshallbeissuedbythecompan

17、ytoreducet hesuminsuredcorrespondingtothepropertylostordamagedbytheamountsosettledfromthedateofloss,andnopremiumshallberefundedfortheamountsoreduced.ifreinstatementofthesuminsuredisrequiredbytheinsureduponsettlementoftheclaim,anadditionalpremiumforthereinstatedamountshallbechargedatanagreedrate,andb

18、ecalculatedonproratadailybasisfromthedateoflosstotheexpiryoftheinsurance.7.thetimeofvalidityofaclaimunderthisinsuranceshallnotexceedaperiodoftwoyearcountingfromthedateofloss.v.insuredsobligationsthefollowingobligationsshallbestrictlyfulfilledbytheinsuredandhisrepresentative:1.theinsuredandhisreprese

19、ntative,whenapplyingforinsuranceshallmaketrueanswersordescriptionstothequestionsintheproposalandquestion naireortoanyotherquestionsraisedbythecompany.2.theinsuredandhisrepresentativeshallpaytothecompanyinduecoursetheagreedpremiuminthemannerasprovidedinthescheduleandendorsements.3.duringtheperiodofth

20、isinsurance,theinsuredshallathisownexpensetakeallreasonableprecautions,includingpayingsufficientattentiontoandputtingintopracticethereasonablerecommendationsofthecompany,prudentlyselectingtheworkmenandemployeesandcomplyingwithallstatutoryregulationsandsafetyoperationprocedures.4.intheeventofanyoccur

21、rencewhichgivesormightgiverisetoaclaimunderthispolicy,theinsuredorhisrepresentativeshall:4.1notifythecompanyimmediatelyandwithinseven(7)daysoranyfurtherperiodasmaybeagreedbythecompanyinwriting,furnishawrittenreporttoindicatethecourse,probablereasonandextentoflossordamage 4.2takeallnecessarymeasurest

22、oavoidaggravationofthelossordamageandminimizeittotheleastextent;4.3preservethespotaffectedanddefectivepartsbeforeaninspectioniscarriedoutbyarepresentativeorsurveyorfromthecompany;4.4furnishallsuchinformationanddocumentaryevidenceasthecompanymayrequireforsupportingtheclaim.vi.generalconditions1.polic

23、yeffectthedueobservanceandfulfilmentofthetermsandconditionsofthispolicyinsofarastheyrelatetoanythingtobedoneorcompliedwithbytheinsuredshallbeaconditionprecedenttoanyliabilityofthecompanyunderthispolicy.2.policyvoidancethispolicyshallbevoidableintheeventofmisrepresentation,m sdescriptionornon-disclos

24、uremadebytheinsuredorhisrepresentativeinanymaterialparticularinrespectofthisinsurance.3.policyterminationunlessitscontinuancebeadmittedbythecompanyinwriting,thispolicyshallbeautomaticallyterminatedif:3.1theinsurableinterestoftheinsuredislost;3.2theriskoflossordamageisincreased.afterterminationofthep

25、olicy,thepremiumshallberefundedtotheinsuredcalculatedonproratadailybasisfortheperiodfromthedateofterminationtothedateofexpiry.4.policycancellationthispolicymaybecanceledatanytimeattherequestoftheinsuredinwritingorattheoptionofthecompanybygivingafifteen(15)dayspriornoticetotheinsured.intheformercaset

26、hecompanyshallretainapremiumcalculatedonshorttermratebasisforthetimethepolicyhasbeeninforcewhileinthelattercasesuchpremiumshallbecalculatedonproratadailybasis.5.forf eitofbenefitiftheclaimisinanyrespectfraudulent,orifanyfraudulentmeansordevicesareusedbytheinsuredorhisrepresentativetoobtainanybenefit

27、underthispolicyorifanylossordamageisoccasionedbytheintentionalactorintheconnivanceoftheinsuredorhisrepresentative,theninanyofthesecases,alltherightsandbenefitsoftheinsuredunderthispolicyshallbeforfeited,andallconsequentlossesarisingtherefromincludingtheamountofclaimpaidbythecompanyshallbeindemnified

28、bytheinsured.6.reasonableinspectiontherepresentativeofthecompanyshallatanysuitabletimebeentitledtoattendthesiteandinspectorexaminetheriskexplosureofthepropertyinsured.forthispurpose,theinsuredshallprovidefullassistanceandalldetailsandinformationrequiredbythecompanyasmaybenecessaryfor theassessmentof

29、therisk.theabovementionedinspectionorexaminationshallinnocircumstancesbeheldasanyadmissiontotheinsuredbythecompany.7.doubleinsuranceshouldanyloss,damage,expensesorliabilityrecoverableunderthepolicybealsocoveredbyanyotherinsurance,thecompanyshallonlybeliabletopayorcontributehisproportionoftheclaimirr

30、espectiveastowhethertheotherinsuranceisarrangedbytheinsuredorothersonhisbehalf,orwhetheranyindemnificationisobtainableundersuchotherinsurance.8.subrogationwhereathirdpartyshallbeheldresponsibleforthelossordamagecoveredunderthispolicy,theinsuredshall,whetherbeingindemnifiedbythecompanyornot,takeallne

31、cessarymeasurestoenforceorreservetherightofrecoveryagainstsuchthirdparty,anduponbeingindemnifiedbythecompany,subrogatetot hecompanyalltherightofrecovery,transferallnecessarydocumentstoandassistthecompanyinpursuingrecoveryfromtheresponsibleparty.9.disputealldisputesunderthisinsurancearisingbetweenthe

32、insuredandthecompanyshallbesettledthroughfriendlynegotiations.wherethetwopartiesfailtoreachanagreementafternegotiations,suchdisputeshallbesubmittedtoarbitrationortocourtforlegalactions.unlessotherwiseagreed,sucharbitrationorlegalactionshallbecarriedoutintheplacewherethedefendantisdomiciled.vii.speci

33、alprovisionsthefollowingprovisionsshallbeappliedtoallpartsofthispolicyandshalloverridetheothertermsandconditionsofthispolicyifanyconflictarises.propertyinsurancepolicyp olicyno.:whereastheinsurednamedinthescheduleheretohasmadetothe_insurancecompany(hereinaftercalledthecompany)awrittenproposalwhichto

34、getherwithanyotherstatementsmadebytheinsuredforthepurposeofthispolicyisdeemedtobeincorporatedhereinandhaspaidtothecompanythepremiumstatedintheschedule.nowthispolicyofinsurancewitnessesthatsubjecttothetermsandconditionscontainedhereinorendorsedhereonthecompanyshallindemnifytheinsuredforthelossordamag
