1、网络游戏虚拟财产的界定及民法保护 网络游戏虚拟财产的界定及民法保护 Definition of Virtual Property in Online Games and Its Civil Law Protection 【摘要】 网络虚拟财产是当今网络游戏产业迅猛发展的产物。它具有财产的一般属性,但在其存在和功用等方面又具有不同于一般财产的特点。随着互联网经济的发展,由网络游戏引发的纠纷将越来越多,而此类纠纷又多以“虚拟财产”为争论点。本文分四个部分来分析虚拟财产的法律保护问题。笔者着眼于我国日益增多的虚拟财产纠纷,力图从学理层面、制度层面分析保护网络虚拟财产的价值导向、制度设计、终极目标等各

2、方面的意义,提出保护虚拟财产的具体方法和立法构思,以求最终使得该问题在理论上和司法实践中能够得到最为有效的解决。本文第一部分首先从网络游戏虚拟财产的基本概念入手,概述虚拟财产的定义,并归纳出作为虚拟财产所应具备基本特征,如:虚拟性、价值性、合法性等。本文第二部分研究了网络游戏虚拟财产的财产属性。在网络虚拟财产的财产属性及法律属性问题上,学者存在较多争议。在财产属性上,大部分学者持肯定的观点,也有少部分学者对其财产性进行否定。本文通过对财产观念形成、财产形式的历史发展及财产基本属性的分析,认为网络虚拟财产已经具备财产的基本要素,因此应当承认网络虚拟财产是财产,并受到法律的保护。本文第三部分则着重

3、研究网络游戏虚拟财产的法律属性。在网络虚拟财产的法律属性上,主要分为知识产权说、物权说、债权说几种观点。本文对各种观点进行了评析,认为网络虚拟财产的本质属性应该是准物权。本文第四部分则是在对上述几个方面进行分析研究之后,从民法角度架构一个完整的网络游戏虚拟财产法律保护体系。对网络游戏用户和运营商的虚拟财产关系、网络游戏用户之间的虚拟财产关系进行了分析,指出他们之间围绕虚拟财产所存在的物权法律关系和债权法律关系,并列举、分析了网络游戏用户和运营商各自应当享有的权利和承担的义务。在网络虚拟财产价值的确定上,本文认为应当根据案件的不同情况进行具体的分析,充分考虑网络虚拟财产的官方定价和网络虚拟财产交

4、易市场对网络虚拟财产价值、价格的决定作用,并提出根据纠纷性质确定网络虚拟财产价值的四种方式。【Abstract】 The network virtual property is the outcome of the speedy development in network game industry. It has the general characteristics of property, and it has own characteristics which is different from the general characteristics of property. Alo

5、ng with the development of the internet economy, the disputes that are caused from the network game will be more and more. And the most of this kind of disputes are surrounding the” network virtual property “. This dissertation has four Parts. It sets out form the porgressive entanglements, tries to

6、 analyze the significance of protecting the network virtual propertys value orientation. Institutional design and ultimate objective from both theory and system layers, puts forward concrete methods and legislative design in order to find the most efective resolution in both theoretical and practica

7、l aspects.In the first part of this dissertation, it starts with the basic definition, concludes its essential charac- teristics, such as virtual quality, valuable quality and soon.In the second part, there are many disputes among scholars on the question of property attribute. On the question of pr

8、operty attribute, a majority of scholars hold affirmative opinions about the property attribute of network virtual property, only few scholars hold negative opinions. Through the analysis on the forming of property concept, the development of property form and the analysis of basal attribute of prop

9、erty , so network virtual property belongs to property, it should be protected by law.In the third part, it epmhasizes the research of the legal character of the virtual proerty. On the question of legal attribute, there are several options in cluding theory of intellectual property, theory of prope

10、rty right, theory of obligatory right. Though the analysis of above opinions, this dissertation points out that the essential attribute of network virtual property is quasi-real right.In the end, the paper suggests that certain laws should be made to protect the virtual property in online games. thi

On the issue of the value of network virtual property, this dissertation claim that the determining of value of network virtual property should be based on adequate analysis of diversified cases, adequately consider officially fixed price of network games and the determinative ficti
