1、山西可再生能源开发利用的法律问题研究 山西可再生能源开发利用的法律问题研究 A Study on the Legal Issues of Renewable Energy Exploitation in Shanxi Province【中文摘要】 提高能源利用效率和发展可再生能源已成为全球能源可持续发展的两个车轮。近年来,伴随着经济快速发展对能源的需求,传统的煤炭、石油等能源开采利用越来越受到资源、环境和运输等条件的限制,能源是否可持续发展关系到社会和经济能否健康稳定地发展,面对经济社会发展和环境保护的双重任务,重新构建合理的能源结构,加强对可再生能源的立法建设是十分必要的。我国的可再生能源的

2、立法和实施才刚刚起步,中华人民共和国可再生能源法的通过对促进可再生能源的开发利用、增加能源供应、改善能源结构、保障能源安全、保护环境、实现我国经济社会的可持续发展,具有十分重大的意义;但是由于我国可再生能源的开发利用还存在许多障碍和自身的诸多问题,并且对开发利用可再生能源过程中的法律体系还不完善,因此为兼顾各地不同的情况,需要国家及各地方及时制定各项配套的法规、规章及标准,进一步构建有我国特色的可再生能源法律体系,即一个稳定的、具有实际内容和效力的,以基本法与专项立法相结合,以全国人大立法和国务院行政法规为主、部门规章和地方性法规为辅的法律体系,它是以可再生能源基本法为核心,专项法完备的,有多

3、层次,门类齐全的可再生能源法组成的有机联系的统一整体。本研究从国外、国内及地方开发利用可再生能源的法律问题入手,通过借鉴国外成熟的相关法律,立足山西,提出完善我省可再生能源开发利用的法规的建议,如:构建山西可再生能源产业促进法;构建山西可再生能源科技促进法;构建山西可再生能源的其它配套法规规章;细化或补充配套法律制度;协调相关政策法律制度之间的关系;评估政策法律的实施情况;加强可再生能源政策体系建设,强化行业管理等。为建立我们山西良性循环的资源市场,促进人与自然和谐共处贡献自己的一份力量。【英文摘要】 Improving energy use efficiency and developing

4、 renewable energy have become two wheels of the sustainable development of global energy. In recent years,with the rapid development of economy the demand for energy has increased.The exploitation of traditional energy resources, such as coal and oil,is more constrained by the conditions of natural

5、resources,environment and transportation.The sustainable energy development will matter a lot for the healthy and stable development of our society and economy.With the double task of economic and social development and environmental protection,it is extremely necessary to reconstruct reasonable ene

6、rgy structure and reinforce the legislation of renewable energy.In our country,the legislation of renewable energy and its enforcement has just begun.The approval of The Law of Renewable Energy in PRC is of great significance to promote the exploitation of renewable energy,increase energy supply,imp

7、rove energy structure, guarantee energy safety,and protect environment,so as to achieve the sustainable development of our economic society.But due to the existing barriers and problems of renewable energy exploitation in our country as well as the imperfection of legislative system in the process o

8、f energy exploitation,in order to take into consideration different conditions in different regions,the state and the local governments should make matching laws,regulations and standards,further construct a legal system of renewable energy exploitation with Chinese characteristics, that is,a stable

9、,practical and effective legal system which combines basic law with special legislation,takes the NPC legislation and executive regulations of the state council as the major part,with reference to the department regulations and local laws and regulations.It is a integrated whole which focuses on the

10、 basic law of renewable energy,and is equipped with complete special laws,with multi-level and comprehensive renewable energy laws.The present study begins with the legal problems of renewable energy exploitation both home and abroad.In view of the relevant laws in other countries the study takes Sh

11、anxi province as the study subject,providing some suggestions on improving the renewable energy exploitation laws in our province.Such as,constructing the promotion law on Shanxi renewable energy industry,constructing the promotion law on Shanxi renewable energy technology,constructing other matchin

12、g regulations on Shanxi renewable energy,refining or compensating matching legal system,coordinating relations between relevant policies,laws and systems,assessing the enforcement of policies and laws,reinforcing the policy system construction of renewable energy and strengthening administration of
