1、对紧急状态法律制度的宪法思考 对紧急状态法律制度的宪法思考 Constitutional Thoughts on the Law of Emergency Responses 【摘要】 紧急状态作为现代民主宪政的一个重要课题,也是20世纪下半叶世界各国处理紧急危险局势所采取的最主要的应急措施。紧急状态法律制度是对该国家在应对威胁其生存的紧急情况时所采取的一些与正常状态下民主宪政的一般原则及实践所不同的关于国家紧急权力行使的方式、程序、原则及人权保障与人权克减的手段和界限的法律制度的总称,其目的是为了在紧急状态下更好的保卫统治阶级的国家政权,维护最基本的社会秩序,并给与公民基本权利及社会组织、法

2、人等以最低限度的保障,是对民主宪政制度在处理威胁国家生存的紧急情况时的补充和完善。由于紧急状态的特殊性质,在国家遭受紧急情况时,往往要通过行使超越宪法和法律规定的紧急权力来摆脱危机,那么在这种情况下,如何认识紧急状态下的宪法效力问题,如何在权力行使与权利保障之间寻求适当的平衡,正是本文写作的探讨之处,面对我国现有的、较为零散的有关紧急状态的法律法规,笔者建议解决措施就是以宪法为依据,构建我国的紧急状态法律体系。【Abstract】 As the important topic modern of democratic constitutionalism, the emergency respo
