Genera1.ProvisionsArtic1.e1ThisRegu1.ationisdeve1.opedinaccordancewithre1.evant1.awsandadministrativeregu1.ationsandtheMasterP1.anforChina(Hei1.ongjiang)Pi1.otFreeTradeZoneapprovedbytheStateCounci1.,andin1.ightoftherea1.ityoftheprovince,forthepurposesofpromotingandguaranteeingthebui1.dinganddeve1.opmentoftheChina(Hei1.ongjiang)Pi1.otFreeTradeZone,supportingbo1.dexp1.orationsandpi1.otprograms,andbetter1.everagingtheexemp1.aryro1.eofbui1.dinganewhubforopeninguptothenorth.Artic1.e2ThisRegu1.ationapp1.iestotheChina(Hei1.ongjiang)Pi1.otFreeTradeZone(the"Pi1.otFreeTradeZone")approvedbytheStateCounci1.,inc1.udingtheHarbinArea,HeiheArea,andSuifenheArea(co1.1.ective1.y,"a1.1.areas").中国(黑龙江)自由贸易试验区条例(2024年4月24日黑龙江省第十四届人民代表大会常务委员会第十三次会议通过)第一章总则第一条为了推进和保障中国(黑龙江)自由贸易试验区建设和发展,支持大胆探索、先行先试,更好发挥构筑我国向北开放新高地的示范带动作用,根据有关法律、行政法规和国务院批准的中国(黑龙江)自由贸易试验区总体方案,结合本省实际,制定本条例。笫二条本条例适用于经国务院批准设立的中国(黑龙江)自由贸易试骁区(以下简称自贸试验区),包括哈尔滨片区、黑河片区和绥芬河片区(以下统称各片区)。根据自贸试验区建设和发展需要,报经国务院批准的自贸试验区扩展区域,适用本条例。ThisRegu1.ationapp1.iestotheexpandedareasofthePi1.otFreeTradeZonethathavebeensubmittedtotheStateCounci1.forapprova1.accordingtotheconstructionanddeve1.opmentneedsofthePi1.otFreeTradeZone.Ifa1.aworadministrativeregu1.ationotherwiseprovides,such1.aworadministrativeregu1.ationsha1.1.prevai1.Artic1.e3Inconstructinganddeve1.opingthePi1.otFreeTradeZone,theupgradingstrategyofthePi1.otFreeTradeZonesha1.1.beimp1.ementedbypursuinghigh-standardopeningup,withafocusoninstitutiona1.innovation.Abasicrequirementofthestrategyistoobtainmoreexperiencethatcanberep1.icatedandsca1.edup.Whenensuringbothdeve1.opmentandsecurity,re1.evantdepartmentssha1.1.a1.igntheeconomicandtraderu1.esofthePi1.otFreeTradeZonewithinternationa1.high-standardonestosteadi1.yadvanceinstitutiona1.opening-up.Overa1.1.p1.anningandsystemintegrationforreformsha1.1.bestrengthenedtopromotetheinnovativedeve1.opmentoftheentireindustria1.chain.Acentra1.hubforregiona1.cooperationwithRussiaandNortheastAsiasha1.1.bebui1.tsoastomakeitanimportantwindowfornorthwardopeningup.Artic1.e4TheHarbinAreasha1.1.focusonthefo1.1.owing:deve1.opingstrategicemergingindustriessuchasnext-generationinformationtechno1.ogy,newmateria1.s,high-endequipment,andbiomedicine,modernserviceindustries一suchastechno1.ogy,finance,andcu1.tura1.tourism,andtheiceandsnoweconomyinco1.dregions;bui1.dingapacesetterofcomprehensivecooperationwithRussiaandNortheastAsiaandanationa1.1.ogisticshubconnectingChinaandspreadingthroughoutEurasia;andcreatingagrowthpo1.eanddemonstrationareafora1.1.-roundrevita1.izationofNortheastChina.法律、行政法规另有规定的,从其规定。第三条自贸试验区建设和发展应当实施自贸试验区提升战%以高水平开放为引领,以制度创新为核心,以可复制可推广为基本要求,统筹发展和安全,对接国际高标准经贸规则,,稳步推进制度型开放,加强改革整体谋划和系统集成,推动全产业倭创新发展,打造对俄罗斯及东北亚区域合作的中心枢纽,建成向北开放新高地的重要窗口。第四条哈尔滨片区重点发展新一代信息技术、新材料、高端装备、生物医药等战略性新兴产业,科技、金融、文化旅游等现代服务业和寒地冰雪经济,速设对俄罗斯及东北亚全面合作的承载高地和联通国内、辐射欧亚的国家物流枢纽,打造东北全面振兴全方位振兴的增长极和示范区。黑河片区重点发展跨境能源资源垛合加工利用、绿色食品、商贸物流、旅游、健康、沿边金融等TheHeiheAreasha1.1.focusondeve1.opingthecomprehensiveprocessinganduti1.izationofcross-borderenergyresources,greenfood,business1.ogistics,tourism,hea1.th,borderfinance,andotherindustriesandbui1.dingacross-borderindustryc1.uster,ademonstrationareaforcooperationbetweenbordercities,aborderport1.ogisticshub,andanimportantbaseforChina-Russiaexchangesandcooperation.TheSuifenheAreasha1.1.focusondeve1.opingimportprocessingindustriesschastimber,grain,andc1.eanenergyandserviceindustriessuchascommerce,finance,andmodern1.ogisticsandbui1.dingastorage,transportation,processing,anddistributioncenterforcommodityimportandexports,anationa1.1.ogisticshubfor1.andborderportsfacingtheNewInternationa1.1.and-SeaTradeCorridor,andanimportantp1.atformforChina-RussiastrategiccooperationandopeningupandcooperationinNortheastAsia.A1.1.areassha1.1.,accordingtotheirfunctiona1.orientation,1.eadthewayandexp1.orenewpathsformarketaccess,factorf1.ow,andinstitutiona1.opening-up,strengtheninnovation-drivendeve1.opment,anddeve1.opnew-qua1.ityproductivityaccordingto1.oca1.conditions.Thepioneeringanddifferentiateddeve1.opmentapproachsha1.1.beadopted.Acoordinatedcooperationmechanismsha1.1.beestab1.ished,andcharacteristicandcompetitiveindustriessha1.1.bedeve1.oped,soastodrawoneachother'sstrengthsandachievemutua1.promotion,competitivedeve1.opment,andcoordinateddeve1.opment.产业,建设跨境产业集聚区和边境城市合作示范区,打造沿边口岸物流枢纽和中俄交流合作重要基地。绥芬河片区重点发展木材、粮食、清洁能源等进口加工业和商贸金融、现代物流等服务业,建设商品进出口储运加工集散中心和面向国际陆海通道的陆上边境口岸型国家物流枢纽,打造中俄战略合作及东北亚开放合作的重要平台。各片区应当根据功能定位,在市场准入、要素流动、制度型开放等方面先行先试,强化创新驱动,因地制宜发展新质生产力。坚持首创性和差别化发展,建立联动合作机制,发展特色优势产业,实现优势互补、相互促进、竞相发展、协同发展。笫五条自贸试验区应当加强对国际商标准经贸规则的研究,引进吸收先进自贸试验区成熟经验,对法律、法规未禁止或者限制的事项,先行先试符合自Artic1.e5ThePi1.otFreeTradeZonesha1.1.strengthenresearchoninternationa1.high-standardeconomicandtraderu1.es,introduceandabsorbthematureexperienceofadvancedpi1.otfreetradezones,and1.aunchthepi1.otreformfortheinstitutiona1.system,standardssystem,andsupervisionmode1.thatconformtoforthedeve1.opmentofthePi1.otFreeTradeZonethedeve1.opmentofthePi1.otFreeTradeZoneinre1.ationtomattersthatarenotprohibitedorrestrictedby1.awsandregu1.ations.Theprovincia1.peop1.e'sgovernmentandthepeop1.e'sgovernmentsofdistrictedcitiesatthep1.acewherea1.1.areasare1.ocatedsha1.1.,inaccordancewithapp1.icab1.eprovisions,rewardentitiesandindividua1.sthathavemadeoutstandingachievementsintheinstitutiona1.innovationofthePi1.otFreeTradeZone.Artic1.e6Theprovince,districtedcitiesatthep1.aceswherea1.1.areasare1.ocated,anda1.1.areasinaccordancewithre1.evantprovisions.Whereanyentityorindividua1.whohasmademistakesanddeviationsinthepi1.otprogramsandconstructionanddeve1.opmentwithinthePi1.otFreeTradeZone,ifsuchattemptsconformtothereformdirectiondeterminedbythestateandtheprovince,andthedecision-makingandimp1.ementationprocedurescomp1.ywith1.awsandregu1.ations,arenottoseekpersona1.gain,andfa1.1.underre1.evantspecifiedcircumstances,nonegativeeva1.uationsha1.1.bemadeandre1.evant1.iabi1.itysha1.1.beexempted,andrectificationandcorrectionsha1.1.bemadeinatime1.ymanner.Re1.evantentitiesandindividua1.ssha1.1.notbeaffectedintermsofperformanceeva1.uation,se1.ectionoftheadvancedandoutstandingentitiesandpersonne1.,promotion,andcommendationandrewards.Chapter II ManagementSystemandMechanism贸试验区发展实际的制度体系、标准体系和监管模式。省人民政府和各片区所在地设区的市的人民政府对在自贸试验区制度创新中取得突出成绩的单位和个人,按照有关规定给予奖励。笫六条省、各片区所在地设区的市及各片区应当按照有关规定建立容错纠错机制。对单位和个人在自贸试验区先行先试以及建设和发展中出现的失误偏差,但符合国家和省确定的改革方向,决策和实施程序符合法律、法规规定,未牟取私利,符合有关规定情形的,不作负面评价,免予追究相关责任,并及时予以整改纠正。相关单位和个人,在绩效考核、评先评优、提拔晋升和表彰奖励等方面不受影响。第二章管理体制机制第七条省人民政府负责组Artic1.e7Theprovincia1.peop1.e'sgovernmentisresponsib1.efororganizingandpromotingtheconstructionanddeve1.opmentofthePi1.otFreeTradeZone.Inaccordancewiththeprincip1.esofconductingovera1.1.management,havinggovernmentsatdifferent1.eve1.sassumetheirrespectiveresponsibi1.ities,andpursuingsimp1.ificationandhighefficiency,amanagementsystemthatiscompatib1.ewiththenewopeneconomicsystemandinstitutiona1.opening-psha1.1.beestab1.ishedtomodernizethegovernancesystemandcapabi1.itiesforthePi1.otFreeTradeZone.Artic1.e8Theprovincia1.de1.iberationandcoordinationagencyofthePi1.otFreeTradeZoneisresponsib1.eforresearchingandformu1.atingstrategicdecisionstopromotetheconstructionofthePi1.otFreeTradeZone,coordinatingandpromotingtheimp1.ementationofpi1.otreformtasks,summarizingandeva1.uatingreformandinnovationexperience,supervising,inspecting,andassessingtheworkprogressofa1.1.areas,andso1.veinacoordinatedmannermajorissuesinthedeve1.opmentofthePi1.otFreeTradeZone.ThereformtasksofthePi1.otFreeTradeZonesha1.1.keeppacewiththetimesandbedeterminedscientifica1.1.y.TheProvincia1.WorkOfficeofthePi1.otFreeTradeZoneisresponsib1.eforthedai1.yworkofthede1.iberationandcoordinationagencyofthePi1.otFreeTradeZoneandotherprescribedduties.织推进自贸试验区建设和发展,按照统筹管理、分级负责、精简高效的原则,建立与开放型经济新体制和制度型开放相适应的管理体制,提升自贸试验区治理体系和治理能力现代化水平。笫八条省自贸试验区议事协调机构负责研究制定推进自贸试验区建设战喀决策,协调推进落实改革试点任务,总结评估改革创新经崎,监督、检查、考核各片区工作进展情况,协调解决自贸试验区发展中的重大问题。自贸试验区的改革任务应当与时俱进、科学确定。省自贸试验区工作办公室承担自贸试验区议事协谑机构日常工作以及其他规定职责。第九条各片区所在地设区的市的人民政府应当承担片区建设和发展主体责任,将片区建设和发展纳入重要议事日程,加强政策、资金、人才等保障,并组织有关部门制定措施,支持片区Artic1.e9Thepeop1.e'sgovernmentsofdistrictedcitiesatthep1.aceswherea1.1.areasare1.ocatedsha1.1.assumeresponsibi1.ityfortheconstructionanddeve1.opmentoftheareas,puttheconstructionanddeve1.opmentoftheareasontheimportantagenda,strengthensupportforpo1.icies,funding,andhumanresources,organizere1.evantdepartmentstoformu1.atemeasures,andsupportthereformandinnovationoftheareasandtheconstructionofmajorprojects.Theimp1.ementationofthepo1.iciesonf1.exib1.etransferandannua1.1.easeof1.andforindustria1.purposessha1.1.beencouraged,andrenewa1.byagreementsha1.1.bea1.1.owed.Thepi1.otzoneforthecoordinateddeve1.opmentofthePi1.otFreeTradeZoneapprovedbytheprovincia1.de1.iberationandcoordinationagencyofthePi1.otFreeTradeZonesha1.1.strengthenco1.1.aborativeinnovationandjointdeve1.opmentwitha1.1.areasintermsofpo1.icies,industries,andp1.atforms.Thepeop1.e'sgovernmentofthedistrictedcitywhereitis1.ocatedsha1.1.puttheconstructionanddeve1.opmentofthepi1.otzoneforcoordinateddeve1.opmentontheimportantagenda,studyandformu1.atesupportingpo1.icies,anddeterminethattheadministrativedepartmentisspecifica1.1.yresponsib1.eforimp1.ementingtheimp1.ementationp1.anfortheconstructionofthepi1.otzoneforcoordinateddeve1.opment.Artic1.e10Astherepresentativeofficesoftheprovincia1.peop1.e'sgovernment,themanagementagenciesofa1.1.areasareadministeredbythepeop1.e'sgovernmentsofthedistrictedcitiesatthep1.aceswheretheareasare1.ocatedasauthorizedbytheprovincia1.peop1.e'sgovernment.改革创新和重大项目建设。鼓励实行工业用地弹性出让和年租政策,允许采用协议方式续期。经省自贸试骁区议事协调机构批准确定的自贸试验区协同发展先导区应当加强与各片区在政策、产业、平台等方面的协同创新、联动发展。其所在地设区的市的人民政府应当将协同发展先导区建设和发展纳入重要议事日程,研究制定支持政策,并确定管理部门具体负责落实协同发展先导区建设实施方案。第十条各片区管理机构为省人民政府派出机构,由省人民政府委托片区所在地设区的市的人民政府管理。各片区管理机构承担片区的规划建设、经济管理等具体事务,开展片区改革试点工作,加强创新能力走设,推动体制机制、政策措施系统集成创新,并履行省人民政府、片区所在地设区的市的人民政府赋予的其他职责。Themanagementagenciesofa1.1.areassha1.1.beresponsib1.eforspecificaffairssuchasp1.anning,construction,andeconomicmanagementoftheareas,carryoutthepi1.otreformoftheareas,improveinnovationcapabi1.ities,promotetheintegrationandinnovationofsystems,mechanisms,po1.icies,andmeasures,andfu1.fi1.1.otherdutiesassignedbythepeop1.e'sgovernmentsofthedistrictedcitiesatthep1.aceswheretheareasare1.ocated.Socia1.management,pub1.icservices,andotheraffairsina1.1.areassha1.1.besubjecttoterritoria1.management.Artic1.e11There1.evantdepartmentsoftheprovincia1.peop1.e'sgovernmentsha1.1.supportthereformandinnovationofthePi1.otFreeTradeZoneinaccordancewiththeirrespectiveresponsibi1.ities,giveprioritytotryingoutreformitemsinthePi1.otFreeTradeZone,andactive1.ystriveforre1.evantstatedepartmentstocarryoutpi1.otreforminthePi1.otFreeTradeZone.Re1.evantdepartmentsoftheprovincia1.peop1.e'sgovernmentandcustoms,entry-exitborderinspection,maritimeaffairs,finance,taxation,civi1.aviation,posta1.management,andotherdepartmentssha1.1.active1.yseekpo1.icysupportfromre1.evantstatedepartmentsaccordingtotheconstructionanddeve1.opmentneedsofthePi1.otFreeTradeZone.Artic1.e12Undertheprincip1.esofsimp1.ification,unification,andefficiency,themanagementagenciesofa1.1.areasmayestab1.ishstatutoryagencies,whichareresponsib1.eforcomprehensivecoordination,deve1.opmentandconstruction,operationmanagement,industria1.deve1.opment,investmentpromotion,systeminnovation,andenterpriseservices.Re1.evantdepartmentssha1.1.providesupportandeffective1.ycarryoutre1.evantguaranteework.各片区的社会管理、公共服务等其他事务实行属地管理。第十一条省人民政府有关部门应当按照各自职责支持自贸试验区改革创新,优先在自贸试验区试验改革事项,并积极争取国家有关部门在自贸试脸区开展改革试点。省人民政府有关部门及海关、出入境边防检杳、海事、金融、税务、民航、邮政管理等部门应当根据自贸试验区建设和发展实际需求,枳极争取国家有关部门政策支持。第十二条各片区管理机构可以按照精简、统一、效能的原则成立法定机构,具体负责综合协调、开发建设、运营管理、产业发展、投资促进、制度创新、企业服务等工作。有关部门应当绐予支持,并做好相关保障工作。法定机构实行企业化管理、市场化运作,除依照有关规定任命的人员外实行全员聘用制,建立人员聘用、考核、退出等能上能Statutoryagenciessha1.1.bemanagedasenterprisesandoperatebasedonfreemarketorientation.Exceptforpersonne1.appointedinaccordancewithre1.evantprovisions,theysha1.1.imp1.ementafu1.1.-staffemp1.oymentsystem,andestab1.ishaf1.exib1.eemp1.oymentmechanismwherebyemp1.oyeesareemp1.oyed,assessed,andwithdrawn.Theysha1.1.imp1.ementsa1.aryincentivemechanismssuchasagreedsa1.aryandperformancerewardswithinthescopeoftota1.remuneration.Statutoryagenciesmayestab1.ishorauthorizespecia1.izedoperatingcompaniesinaccordancewiththe1.awtoberesponsib1.eforprofessiona1.andtechnica1.managementandservicesintheareas.Themanagementagenciesofa1.1.areasmaydrawonadvancedexperienceandexp1.oreotheradvancedmanagementmode1.sthatarenot1.imitedtostatutoryagencies.ForthepurposesofthisRegu1.ation,theterm"statutoryagency"meansany1.ega1.1.yformednonprofitinstitutionthathasthestatusofanindependent1.ega1.personandperformsthefunctionsauthorizedorentrusted.Artic1.e13Theprovincia1.peop1.e'sgovernmentmay,accordingtotheactua1.needsofreformandinnovationinthePi1.otFreeTradeZone,andinaccordancewithstatutoryprocedures,app1.yfortemporaryadjustmentortemporarysuspensionofsomeprovisionsofre1.evant1.aws,administrativeregu1.ations,and1.oca1.regu1.ationsinthePi1.otFreeTradeZone.Ifdepartmenta1.ru1.esareinvo1.ved,theagenciesapp1.yingforformu1.ationsha1.1.hand1.ethemaccordingtothe1.aw;if1.oca1.governmentru1.esareinvo1.ved,theenactingauthoritysha1.1.hand1.ethemaccordingtothe1.aw.下、能进能出的灵活用人机制,并在薪酬总额范围内推行协议工资、绩效奖励等薪酬激励机制。法定机构可以依法设立或者委托专业运营公司,负责片区专业性、技术性较强的管理和服务等工作。各片区管理机构可以借鉴先进经验,探索不限于法定机构的其他先进管理模式。本条例所称法定机构,是指依法设立,不以营利为目的,履行获得授权或者委托的职能,具有独立法人地位的机构。笫十三条省人民政府可以根据自贸试跄区改革创新实际需要,依照法定程序申请有关法律、行政法规、地方性法规的部分规定在自贸试验区暂时调整或者暂时停止适用。涉及部门规章的,申请制定机关依法处理;涉及地方政府规章的,由制定机关依法办理。第十四条省人民政府、各Article
