2 ThepresentRulesshallapplytovariouselectricpowermarkets.Article 3 TheNationalEnergyAdministration,thelocalofficesthereof("electricpowerregulatorybodies"),andtherelevantauthoritiesoftheStateCouncilsupen/iseandadministerelectricpowermarketsbasedontheirfunctions.Chapter II ElectricPowerMarketMembers电力市场运行基本规则第一章总则第一条为规范电力市场行为,依法保护市场成员的合法权益,保证电力市场的统一、开放、竞争、有序,按照中共中央国务院关于进一步深化电力体制改革的若干意见中共中央国务院关于加快建设全国统一大市场的意见等有关精神,根据有关法律和电力监管条例等行政法规,制定本规则。笫二条本规则适用于各类电力市场。第三条国家能源局及其派出机构(以下简称电力监管机构)、国务院有关部门根据职能对电力市场实施监督管理。第二章电力市场成员第四条本规则所称的电力市场成员包括经营主体、电力市场运营机构和提供输配电服务的电网企业等。其中,经Article4ForthepurposesoftheseRules,electricpowermarketmembersincludetraders,electricpowermarketoperatinginstitutions,andpowergridenterprisesthatprovideelectricpowertransmissionanddistributionservices.Tradersincludepowergenerationenterprises,powersalesenterprises,powerusers,andnewtraders(includingenergystorageenterprises,virtualpowerplants,andloadaggregators)thatparticipateintradingintheelectricpowermarket;electricpowermarketoperatinginstitutionsincludeelectricpowertradinginstitutionsandelectricpowerdispatchinginstitutions.Article5Aregistrationsystemshallbeadoptedfortheelectricpowermarket.Theelectricpowertradinginstitutionshallestablishamarketregistrationsysteminaccordancewiththerelevantprovisionsissuedbythestate,andtakechargeofthespecificworkofregistrationadministrationoftheelectricpowermarket.Anytraderthatentersorexitstheelectricpowermarketshallgothroughtherelevantformalitiesforregistration.Article6Anelectricpowermarketoperatinginstitutionisresponsibleforelectricpowermarkettrading,electricpowerdispatching,andexecutionoftradingresults,aswellassupportingaccessregistration,meteringandsettlement,andinformationdisclosure,amongothers,withinitspurview,andmaintainthesafeandstableoperationoftheelectricpowersystem.营主体包括参与电力市场交易的发电企业、售电企业、电力用户和新型经营主体(含储能企业、虚拟电厂、负荷聚合商等);电力市场运营机构包括电力交易机构、电力调度机构。笫五条电力市场实行注新制度。电力交易机构根据国家有关规定建立市场注册制度,具体负责电力市场注册管理工作。经营主体进入或者退出电力市场应当办理相应的注册手缥第六条电力市场运营机构按职责负责电力市场交易、电力调度和交易结果执行,以及配套的准入注册、计量结算、信息披露等,维护电力系统的安全稳定运行。笫七条电网企业应当公平开放输电网、配电网,根据交易结果为经营主体提供安全、优质、经济的输配电服务,根据结算依据向经营主体结算相关费用。严格执行国家规定的输配电价,并接受相关电力监管机构的监督检查。Article7Agridenterpriseshallfairlyopenupitstransmissionanddistributionnetworks,providesafe,quality,andeconomicaltransmissionanddistributionservicestotradersbasedontradingresults,andsettlerelevantfeeswithtradersbasedonthesettlementbasis.Itshallstrictlyimplementthetransmissionanddistributionpricesstipulatedbythestate,andsubmittosupervisionandinspectionbyrelevantelectricpowerregulatorybodies.Article8Atradershallperformtransactionresultsinaccordancewithrelevantprovisionsandusetransmissionanddistributionnetworksbasedonthetransactionresults.Article9Anelectricpowermarketshallestablishanelectricpowermarketmanagementcommitteeinaccordancewiththerelevantprovisionsissuedbythestateasanautonomousdeliberativeandcoordinationmechanismindependentofelectricpowertradinginstitutionsthatimplementsselfregulationofpowermarketmembers.Chapter III TradingTypesandMethodsArticle 10 Thetradingtypesintheelectricpowermarketincludethetradingofpowerenergy,tradingofelectricpowerancillaryservices,andcapacitytrading.Article 11 Tradingofpowerenergyisdividedintomedium-andlong-termandspotelectricpowertradingaccordingtothetradingperiod."Medium-andlong-termelectricpowertrading"meanstradinginelectricpowerproductsorservicestobedeliveredwithinacertainfutureperiodofseveralyears,ayear,amonth,aweek,orseveraldays,amongothers.笫八条经营主体应当按照有关规定履行交易结果,根据交易结果使用输配电网。第九条电力市场应当按照国家有关规定组建电力市场管理委员会,作为独立于电力交易机构的自治性议事协调机制,对电力市场成员实施自律管理。第三章交易类型与方式第十条电力市场交易类型包括电能量交易、电力辅助服务交易、容量交易等。第十一条电能量交易按照交易周期分为电力中长期交易和电力现货交易。电力中长期交易,是指对未来某一时期内交割电力产品或服务的交易,包含数年、年、月、周、多日等不同时间维度的交易。电力现货交易,是指通过现货交易平台在日前及更短时间内集中开展的次日、日内至实时调度之前电力交易活动的总称。"Spotelectricpowertrading"isageneraltermforelectricpowertradingactivitiesthatareconductedonaspottradingplatformonthedayorwithinashorterperiodbeforenext-day,intra-day,orrealtimedispatching.Article 12 "Tradingelectricpowerancillaryservices"meansfrequencyregulation,capacityreserve,peaking,andotherpaidelectricpowerancillaryservicesprovidedbyatraderthroughmarket-basedmeans.Article 13 Thesubjectmatterofcapacitytradingisthegeneratingcapacitymadeavailablebypowergenerationunitsandenergystorage,amongothers,thatcanreliablysupportthemaximumloadwithinacertainfutureperiod.Tomeettheneedtodevelopanewelectricpowersystem,theestablishmentofamarket-orientedcostrecoverymechanismforcapacityisgraduallypromoted,anditisexploredtoguidetradersinmakingreasonableinvestmentsbycapacitycompensation,capacitymarket,andothermeans,soastoensurelong-termsufficientcapacityoftheelectricpowersystem.Article 14 Thestatecoordinatestheadvancementoftheestablishmentofanationalunifiedsystemofelectricpowermarkets,continuouslyimprovesthefunctionsofelectricpowermarkets,andmaximizetheroleofthemarketmechanism.ChapterIVPowerEnergyTradingArticle 15 Powerenergytradingisorganizedandimplementedbyanelectricpowermarketoperatinginstitutioninaccordancewiththeoperatingrulesfortheelectricpowermarket,ormaybenegotiatedbythepartiestopowerenergytrading.笫十二条电力辅助服务交易是指由经营主体通过市场化方式提供调频、备用和调峰等有偿电力辅助服务。第十三条容量交易的标的是在未来一定时期内,由发电机组、储能等提供的能够可靠支撑最大负荷的出力能力。根据新型电力系统建设需要,逐步推动建立市场化的容量成本回收机制,探索通过容量补偿、容量市场等方式,引导经营主体合理投资,保障电力系统长期容量充裕。第十四条国家统筹推进全国统一电力市场体系建设,持续完善电力市场功能,发挥市场机制作用。第四章电能量交易笫十五条电能量交易由电力市场运营机构按照电力市场运行规则组织实施,也可以由电力交易双方协商。第十六条经营主体在履行市场注册程序后,参与电能量市场交易。Article 16 Afterfollowingthemarketregistrationprocedures,atraderparticipatesintradinginthepowerenergymarket.Atradershallnotengageincollusioninquotation,pricegouging,disruptionofmarketorder,oranyotheract.Whenatradertradespowerenergy,itshallnotabuseitsdominantmarketpositiontomanipulatemarketprices;whenapowergenerationenterpriseconsistingofseveralpowerplantstradespowerenergy,itshallnotprovidecentralizedquotations.Article 17 Powerenergytradingshallbeexecutedafterbeingexaminedbyanelectricpowermarketoperatinginstitution.ChapterVTradingofElectricPowerAncillaryServicesArticle 18 Atradershall,accordingtotherelevantprovisions,providetheelectricpowerauxiliaryservicesinrespectsofmaintenanceofstablevoltageandfrequencyandrecoveryofanymalfunctionofanypowergrid.Article 19 Electricpowerauxiliaryservicesshallbedividedintobasicandpaidelectricpowerauxiliarysen/ices.Theterm"basicelectricpowerauxiliaryservices"referstotheelectricpowerauxiliaryservicesthatshallbeprovidedbytradersfreeofcharge.Theterm"paidelectricpowerauxiliaryservices"referstotheelectricpowerauxiliaryservicesthatareprovidedbytradersotherthanthebasicelectricpowerauxiliarysen/ices.Providersofqualifiedancillaryservicesaredeterminedthroughmarketcompetition.经营主体之间不得实行串通报价、哄抬价格以及扰乱市场秩序等行为。经营主体进行电能量交易,不得滥用市场支配地位操纵市场价格;有多个发电厂组成的发电企业进行电能量交易,不得集中报价。第十七条电能量交易应通过电力市场运营机构校核后执行。第五章电力辅助服务交易笫十八条经营主体应当按照有关规定提供用以维护电压、频率稳定和电网故障恢复等方面的电力辅助服务。第十九条电力辅助服务分为基本电力辅助服务和有偿电力捕助服务。其中,基本电力辅助服务是经营主体应当无偿提供的电力辅助服务。有偿电力辅助服务是经营主体在基本电力辅助服务之外提供的其他电力辅助服务。具备条件的辅助服务采用市场竞争方式确定提供者。第二十条各地按照国家有关规定确定参与辅助服务市场的准入条件时,应当实行公平准入,不得指定特定主体或Article 20 Whendeterminingaccessconditionsforparticipatingintheauxiliaryservicemarketinaccordancewiththerelevantprovisionsissuedbythestate,aregionshallprovidefairaccessandmaynotdesignateaspecificentityormakediscriminatoryprovisionsagainstaspecificentity.Article 21 TheNationalEnergyAdministration,inconjunctionwiththeNationalDevelopmentandReformCommission,isresponsiblefordevelopingtheadministrationmeasuresandbasictradingrulesforpowerauxiliaryservicesthatspecifythespecificcontent,technicalstandards,provisionmethods,andassessmentmethodsforelectricpowerauxiliaryservices.Article 22 Inaccordancewithrelevantprovisionsduringoperations,apowerdispatchinginstitutionassessesatraderthatprovideselectricpowerauxiliaryservicesinaccordancewiththerequirementsofitsundertaking.ChapterVlMeasurementandSettlementofPowerEnergyArticle 23 Atradershallinstallthedevicesofpowerenergymeasurementthatcomplywiththestatestandards,whichmaybeputintouseupontheexaminationandaffirmationofthetestinginstitutionofpowerenergymeasurement.Theterm"testinginstitutionofpowerenergymeasurement"asmentionedinthepresentRulesreferstoatestinginstitutionofpowerenergymeasurementthathasbeenrecognizedbytheadministrativedepartmentofmeasurementofthegovernmentaswellasbeconfirmedbybothpartiestoatradingofpowerenergy.对特定主体作出歧视性规定。第二十一条国家能源局会同国家发展改革委负责制定电力辅助服务管理办法及基本交易规则,明确电力辅助服务的具体内容、技术标准、提供方式、考核方式。第二十二条承诺按照要求提供电力辅助服务的经营主体,在实际运行中,电力调度机构按照有关规定进行考核。电能计量与结算第二十三条经营主体应当安装符合国家标准的电能计量装置,由电能计量检测机构检定后投入使用。本规则所称电能计量检测机构,是指经政府计量行政部门认可、电能交易双方确认的电能计量检测机构。第二十四条电能计量检测机构对电能计量装置实行定期校核。经营主体可以申请校核电能计量装置,经校核,电Article 24 Thetestinginstitutionofpowerenergymeasurementshallcarryoutverificationonthedevicesofpowerenergymeasurementonaperiodicbase.Atradermayapplyfortheverificationofpowerenergymeasurementdevices.Uponverification,wheretheerrorofanypowerenergymeasurementdevicefailstoreachtheprescribedprecision,theexpensesasincurredtherefromshallbebornebythepartyowningthepropertyrightoftheproblematicdeviceofpowerenergymeasurement.Wheretheerrorofanypowerenergymeasurementdevicereachestheprescribedprecision,theexpensesasincurredtherefromshallbebornebytheapplicantparty.Article 25 Atraderparticipatinginpowerenergytradingshallspecifyitsmeteringpointsofpowerenergy.Whereanymeteringpointislaidontheseparationbetweenthepropertyrightsofatraderandagridenterpriseandifnopowerenergymeasurementdevicemaybeinstalledontheseparationpointofthepropertyright,themeteringpointofpowerenergymaybedeterminedthroughnegotiationbybothparties.Thepowerenergyasmeasuredthroughthemeteringpointsaslegallyprovidedfororasstipulatedshallbethebasisforsettlementofpowerprice.Tradersshall,basedontheboundarylineofmeteringpoints,bearanylossofpowerenergyaswellastherelevantliabilities,subjecttotheprovisionsestablishedbythestate.Article 26 Agridenterpriseshallestablishandmaintainadatabaseofpowerenergymeasurementandpublicizetherelevantdataofpowerenergymeasurementtotradersaccordingtotherelevantprovisions.能计量装置误差达不到规定精度的,由此发生的费用由该电能计量装置的产权方承担;电能计量装置误差达到规定精度的,由此发生的费用由申请方承担。.笫二十五条参与电能量交易的经营主体,应当明确各自电能计量点。电能计量点位于经营主体与电网企业的产权分界点,产权分界点不能安装电能计量装置的,由双方协商确定电能计量点。法定或者约定的计量点计量的电能作为电费结算的依据。经营主体以计量点为分界承担电能损耗和相关贲任,国家另有规定的除外。.笫二十六条电网企业应当建立并维护电能计量数据库,并按照有关规定向经营主体公布相关的电能计量数据。第二十七条电力市场结算包括电能量交易结算、电力辅助服务交易结算、容量交易结算等。Article Agridenterpriseorelectricpowerdispatchinginstitutionisresponsibleforprovidingrelevantdatatoelectricpowertradinginstitutions;anelectricpowertradinginstitutionisresponsibleforprovidingthebasisandservicesforsettlingtradingintheelectricpowermarket;agridenterpriseprovidesrelevantsettlementservicesonbehalfofatrader.Article 29 Anelectricpowermarketmembershallsettlethepowerpriceaccordingtothemethodandtermofsettlementasprescribedbythepolicyrequirementsandoperatingrulesfortheelectricpowermarket.Chapter VII SecurityoftheSystemArticle30Atradershallimplementtheproceduresforandprovisionsontheadministrationofoperationoftherelevantpowergrids,besubjecttouniformdispatching,intensifythemaintenanceofequipment,andsetupthenecessarysecurityfacilitiesaccordingtotheagreementongridcombination,provideelectricpowerauxiliaryservices,andmaintainasoundandstableoperationoftheelectricpowersystem.笫二十八条电网企业和电力调度机构负责向电力交易机构提供相关数据,电力交易机构负责提供电力市场交易结算依据和服务,电网企业受经营主体委托提供相关结算服务。第二十九条电力市场成员应当按照政策要求和电力市场运行规则规定的电费结算方式和期限结算电费。第七章系统安全笫三十条经营主体应当执行有关电网运行管理的规程、规定,服从统一调度,加强设备维护,按照并网协议配备必要的安全设施,提供电力辅助服务,维护电力系统的安全稳定运行。.第三十一条电力调度机构应当严格执行电力调度规则,合理安排系统运行方式,及时预报或者通报影响电力系统安全运行的信息,防止电网事故,保障电网运行安全。负责电力市场交易的安全校核,并公布校核方法、参数。根据电力供需形势、设备运行状况、安全约束条件和系统运行状况,统筹安排电力设备检修Article31Aelectricpowerdispatchinginstitutionshallstrictlyimplementtherulesonelectricpowerdispatching,arrangethewaysofsystemoperationinareasonablemanner,forecastorgivenoticeoftheinformationofanyimpactonthesoundoperationoftheelectricpowersysteminatimelymannersoastopreventanyaccidentofpowergridsandguaranteethesoundoperationthereof.Itshalltakechargeofthesecurityverificationonthetradingoftheelectricpowermarketandpublicizethemeasuresforandparametersofverification.Itshall,accordingtothesituationofsupplyanddemandofelectricpower,operationofequipment,restrictionconditionsofsecurityandsystemoperation,makeanoverallplanformaintenanceofelectricpowerequipment.Theprovisionsontheadministrationandtherulesfortheimplementationofgrid-tiedelectricpoweroperationswillbedevelopedbyelectricpowerregulatorybodies.Article32Theconstructionofthetechnicalsupportingsystemoftheelectricpowermarketshallmeettheprescribedperformanceindicatorrequirementsandhavefunctionarysuchasenergymanagement,tradingmanagement,measurementofpowerenergy,settlementsystem,contractmanagement,quotationhandling,marketanalysisandforecast,tradinginformationandsupervisorysystem.Article33Anelectricpowermarketoperatinginstitutionisresponsibleformanagingandmaintainingthetechnicalsupportingsystemoftheelectricpowermarketandensuringthetradingsecurity,datasecurity,andcybersecurityrequiredforelectricpowermarketoperations.Theconstructionofthetechnicalsupportingsystemoftheelectricpowermarketshallmeettheprescribedperformanceindicatorrequirements,bebasedontheoperatingrulesfortheelectricpowermarket,beuniformlyplanned,uniformlydesigned,uniformlymanaged,concurrentlyimplemented,andseparatelymaintained,andbeupdatedinatimelymannertosuittheneedsofpowermarketdevelopment.Chapter
