1 ThepresentRegulationisformulatedforthepurposeofensuringthequalitysafelyofthemajorindustrialproductsthatdirectlyconcernthepublicsafety,physicalhealth,andsafetyoflifeandproperty,implementingthestateindustrialpolicy,andpromotingthehealthyandharmoniousdevelopmentofsocialistmarketeconomy.中华人民共和国工业产品生产许可证管理条例（2005年7月9日中华人民共和国国务院令第440号公布根据2023年7月20日国务院关于修改和废止部分行政法规的决定修订）第一章总则第一条为了保证直接关系公共安全、人体健康、生命财产安全的重要工业产品的质量安全，贯彻国家产业政策，促进社会主义市场经济健康、协调发展，制定本条例。Article 2 Thestateshallimplementthesystemofproduction第二条国家对生产下列重要工业产品的企业实行licensefortheenterprisesundertakingtheproductionofthefollowingimportantindustrialproducts:1. dairyproduce,meatproduce,beverages,rice,flour,edibleoil,alcoholandotherprocessedfoodsdirectlyrelatetophysicalhealth;2. electriccarpet,pressurecooker,gas-firedwaterheater,andotherproductsthatmayendangerthepersonalandpropertysafety;3. fiscalcashregisters,moneydetectors,satellitetelevisionbroadcastgroundreceivingfacilities,wirelessradioandtelevisiontransmissionequipmentandotherproductsconcerningHnancialsafetyandthesafetyofcommunicationsquality;4. safetynet,safetyhelmet,constructionfastenerandotherproductsthatcanensurelaborsafety;5. electricpowerirontower,bridgeabutment,railwayindustrialproducts,waterengineeringmetalstructure,hazardouschemicalsandtheirwrappagesandcontainers,andotherproductsthatmayaffectworksafetyandpublicsecurity;and6. otherproductssubjecttotheadministrationofproductionlicenseasrequiredbylawsandadministrativeregulationsinaccordancewiththeprovisionsofthepresentRegulation.生产许可证制度：（一）乳制品、肉制品、饮料、米、面、食用油、酒类等直接关系人体健康的加工食品；（二）电热毯、压力锅、燃气热水器等可能危及人身、财产安全的产品；（三）税控收款机、防伪验钞仪、卫星电视广播地面接收设备、无线广播电视发射设备等关系金融安全和通信质量安全的产品；（四）安全网、安全帽、建筑扣件等保障劳动安全的产品：（五）电力铁塔、桥梁支座、铁路工业产品、水工金属结构、危险化学品及其包装物、容器等影响生产安全、公共安全的产品；（六）法律、行政法规要求依照本条例的规定实行生产许可证管理的其他产品。第三条国家实行生产许可证制度的工业产品目录（以下简称目录）由国务院工业产品生产许可证主管部门 会同国务院有关部门制定，并征求消费者协会利相关产品 行业协会的意见，报国务院批准后向社会公布。Article3TheCatalogofIndustrialProducts(hereinafterreferredtoastheCatalog)subjecttothesystemofproductionlicensebythestateshallbeformulatedbythecompetentdepartmentoftheStateCouncilinchargeofproductionlicenseforindustrialproductstogetherwiththerelevantdepartmentsoftheStateCouncil,andbeannouncedtothepublicupontheapprovaloftheStateCouncilaftersolicitingtheopinionsofconsumersassociationsandindustrialassociationsoftherelevantproducts.工业产品的质量安全通过消费者自我判断、企业自律和市 场竞争能够有效保证的，不实行生产许可证制度。工业产品的质量安全通过认证认可制度能够有效保证的， 不实行生产许可证制度。Thesystemofproductionlicenseshallnotbeapplicabletotheindustrialproductswhosequalitycanbeeffectivelyensuredthroughselfjudgmentofconsumers,self-disciplineofenterprisesandmarketcompetition.Thesystemofproductionlicenseshallnotbeapplicabletotheindustrialproductswhosequalitysafetycanbeeffectivelyensuredthroughthesystemofcertificationandauthentication.国务院工业产品生产许可证主管部门会同国务院有关部门 适时对目录进行评价、调整和逐步缩减，报国务院批准后 向社会公布。ThecompetentdepartmentoftheStateCouncilinchargeofproductionlicenseforindustrialproductsshalltimelymakeevaluation,adjustmentandcurtailmentstepbysteptotheCatalogtogetherwiththerelevantdepartmentsoftheStateCouncil,andannouncetothepublicafterreportingtoandbeingapprovedbyLheStateCouncil.第四条在中华人民共和国境内生产、销售或者在经营活动中使用列入目录产品的，应当遵守本条例。Article 4 ThepresentRegulationshallbeobservedfortheproduction,saleoruseoftheproductslistedintheCataloginthebusinessmanagementactivitieswithintheterritoryofthePeople'sRepublicofChina.列入目录产品的进出口管理依照法律、行政法规和国家有关规定执行。TheadministrationontheimportandexportoftheproductslistedintheCatalogshallbeconductedinaccordancewiththelaws,administrativeregulationsandtherelevantstateprovisions.第五条任何企业未取得生产许可证不得生产列入 目录的产品。任何单位和个人不得销售或者在经营活动中 使用未取得生产许可证的列入目录的产品。Article 5 NoenterprisethatfailstoobtaintheproductionlicenseshallproduceanyoftheproductslistedintheCatalog.NoentityorindividualmayselloruseanyproductlistedintheCataloginthebusinessactivitieswithoutobtainingproductionlicense.第六条国务院工业产品生产许可证主管部门依照 本条例负责全国工业产品生产许可证统一管理工作，县级 以上地方工业产品生产许可证主管部门负责本行政区域内 的工业产品生产许可证管理工作。Article 6 ThecompetentdepartmentoftheStateCouncilinchargeofproductionlicenseforindustrialproductsshallberesponsiblefortheunifiedadministrationontheproductionlicenseforindustrialproductsnationwideaccordingtothepresentRegulation.ThecompetentlocaldepartmentofproductionlicenseforindustrialproductsatorabovethecountylevelshallberesponsiblefortheadministrationofproductionlicenseIbrindustrialproductswithintheirownadministrativedistricts.国家对实行工业产品生产许可证制度的工业产品，统一目录，统一审查要求，统一证书标志，统一监督管理。Thestateshall,fortheindustrialproductssubjecttothesystemofproductionlicenseforindustrialproducts,unifythecatalog,theexaminationrequirements,thecertificatesymbolsandthesupervisionandadministration.第七条工业产品生产许可证管理，应当遵循科学公正、公开透明、程序合法、便民高效的原则。Article 7 Theprincipleofscienceandjustness,opennessandtransparency,legitimacyintheproceduresandconvenientforthepublicaswellashighefficiencyshallbefollowedfortheadministrationofproductionlicenseforindustrialproducts.Article 8 Thecompetentdepartmentsofproductionlicenseforindustrialproductsatorabovethecountylevelandtheirstaffmembers,inspectioninstitutionandinspectorsshallhavetheobligationtokeepsecretthenationalsecretsandbusinesssecretstheyknow.ChapterIIApplicationandAcceptanceArticle9Anenterpriseshallmeetthefollowingconditionsforobtainingaproductionlicense:1. havingthebusinesslicense;2. havingprofessionaltechniciansqualifiedfortheproductsitproduces;3. havingproductionconditionsandmeansofinspectionandquarantinethataresuitablefortheproductsitproduces;4. havingtechnicaldocumentsandtechniquedocumentsmatchingtheproductsitproduces;5. havingsoundandeffectivequalitycontrolsystemandresponsibilitysystem;6. theproductcomplyingwiththerelevantnationalstandards,industrialstandardsandrequirementsforensuringpersonalhealthandpersonalandpropertysafety;and第八条县级以上工业产品生产许可证主管部门及其人员、检验机构和检验人员，对所知悉的国家秘密和商业秘密负有保密义务。第二章申请与受理第九条企业取得生产许可证，应当符合下列条件：（一）有营业执照：（二）有与所生产产品相适应的专业技术人员；（三）有与所生产产品相适应的生产条件和检验检疫手段；（四）有与所生产产品相适应的技术文件和工艺文件；（五）有健全有效的质量管理制度和责任制度；（六）产品符合有关国家标准、行业标准以及保障人体健康和人身、财产安全的要求；（七）符合国家产业政策的规定，不存在国家明令淘汰和 禁止投资建设的落后工艺、高耗能、污染环境、浪费资源 的情况。7. complyingwiththeprovisionsofstateindustrialpolicy,andhavingnosuchconditionsasbackwardtechnique,highenergycost,pollutingofenvironment,orwasteofresources,andetc.asarewashedoutbypublicproclamationofthestateandprohibitedfrombeinginvestedandconstructed.法律、行政法规有其他规定的，还应当符合其规定。Unlessthereareotherwiseprovisionsbyanylaworadministrativeregulation,suchprovisionsshallalsobeaccordedwith.第十条国务院工业产品生产许可证主管部门依照 本条例第九条规定的条件，根据工业产品的不同特性，制 定并发布取得列入目录产品生产许可证的具体要求；需要 对列入目录产品生产许可证的具体要求作特殊规定的，应 当会同国务院有关部门制定并发布。Article 10 ThecompetentdepartmentoftheStateCouncilinchargeofproductionlicenseforindustrialproductsshall,accordingtotheconditionsasprescribedinArticle9ofthepresentMeasures,andinlightofthedifferentcharacteristicsofindustrialproducts,formulateandissuespecificrequirementsforobtainingtheproductionlicensesfortheproductslistedintheCatalog;ifthereisnecessitytomakespecialprovisionsonthespecificrequirementsfortheproductionlicensesfortheproductslistedintheCatalog,itshallformulateandissuesuchprovisionstogetherwiththerelevantdepartmentsoftheStateCouncil.制定列入目录产品生产许可证的具体要求，应当征求消费 者协会和相关产品行业协会的意见。第-I一条 企业生产列入目录的产品，应当向企业 所在地的省、自治区、直辖市工业产品生产许可证主管部 门申请取得生产许可证。TheopinionsoftheconsumersassociationsandtheindustrialassociationsoftherelevantproductsshallbesolicitedfortheformulationoftheconcreterequirementsfortheproductionlicenseoftheproductslistedintheCatalog.Article 11 Anenterpriseshall,whenproducinganyproductthatislistedintheCatalog,applyforobtainingthepiuctionlicensetothecompetentdepartmentofproductionlicenseforindustrialproductsattheprovince,autonomousregion,andmunicipalitydirectlyundertheCentralGovernmentwheretheenterpriseislocated.IncaseanyproductthatisbeingproducedbyanenterpriseislistedintheCatalog,theenterpriseshallapplyforobtainingtheproductionlicensewithinthetimeasprescribedbythecompetentdepartmentoftheStateCouncilinchargeofproductionlicenseforindustrialproducts.Theapplicationoftheenterprisemaybefiledthroughletter,telegraph,telex,fax,electronicdatainterchange,email,andotherways.Article 12 Thecompetentdepartmentofproductionlicenseforindustrialproductsataprovince,autonomousregion,andmunicipalitydirectlyundertheCentralGovernmentshall,afterreceivingtheapplicationofanenterprise,handleitaccordingIotherelevantprovisionsoftheAdministrativeLicenseLawofthePeople'sRepublicofChina.Article 13 Thecompetentdepartmentofproductionlicenseforindustrialproductsataprovince,autonomousregion,andmunicipalitydirectlyundertheCentralGovernmentandanyotherentityshallnotannexanyconditionadditionallytorestrictanyenterprisefromapplyingfortheproductionlicense.ChapterIIIExaminationandDecisionArticle 14 Thecompetentdeparlmenlofproductionlicense企业正在生产的产品被列入目录的，应当在国务院工业产品生产许可证主管部门规定的时间内申请取得生产许可证。企业的申请可以通过信函、电报、电传、传真、电子数据交换和电子邮件等方式提出。第十二条省、自治区、直辖市工业产品生产许可证主管部门收到企业的申请后，应当依照中华人民共和国行政许可法的有关规定办理。第十三条省、自治区、直辖市工业产品生产许可证主管部门以及其他任何单位不得另行附加任何条件，限制企业申请取得生产许可证。第三章审查与决定第十四条省、自治区、直辖市工业产品生产许可forindustrialproductsataprovince,autonomousregion,and证主管部门受理企业申请后，应当组织对企业进行审查。依照列入目录产品生产许可证的具体要求，应当由国务院 工业产品生产许可证主管部门组织对企业进行审查的， 省、自治区、直辖市工业产品生产许可证主管部门应当自 受理企业申请之日起5日内将全部申请材料报送国务院工 业产品生产许可证主管部门。对企业的审查包括对企业的实地核查和对产品的检验。第十五条对企业进行实地核查，国务院工业产品 生产许可证主管部门或者省、自治区、直辖市工业产品生 产许可证主管部门应当指派2至4名核查人员，企业应当 予以配合。第十六条核查人员经国务院工业产品生产许可证 主管部门组织考核合格，取得核查人员证书，方可从事相 应的核查工作。municipalitydirectlyundertheCentralGovernmentshall,afteracceptingtheapplicationofanenterprise,organizetomakeexaminationontheenterprise.If,accordingtotheconcreterequirementsoftheproductionlicenseforanyproductlistedintheCatalog,theexaminationontheenterpriseshallbeorganizedbythecompetentdepartmentoftheStateCouncilinchargeofproductionlicenseforindustrialproducts,thecompetentdepartmentofproductionlicenseforindustrialproductsataprovince,autonomousregion,andmunicipalitydirectlyundertheCentralGovernmentshall,within5daysfromacceptingtheapplicationoftheenterprise,reportalltheapplicationdocumentstothecompetentdepartmentoftheStateCouncilinchargeofproductionlicenseforindustrialproducts.Theexaminationonanenterpriseshallincludeon-sitecheckingontheenterpriseandinspectionontheproducts.Article 15 ThecompetentdepartmentoftheStateCouncilinchargeofproductionlicenseforindustrialproductsandthecompetentdepartmentofproductionlicenseforindustrialproductsataprovince,autonomousregion,andmunicipalitydirectlyundertheCentralGovernmentshallappointtwotofourcheckerstomakeon-sitecheckingonanenterprise,andtheenterpriseshallcooperatewiththem.Article 16 ThecheckersshallnotundertakethecorrespondingcheckingworkuntilafterhavingpassedtheexaminationsorganizedbythecompetentdepartmentoftheStateCouncilinchargeofproductionlicenseforindustrialproductsandobtainedthecertificateofcheckers.Article 17 Thecheckersshallmakeon-sitecheckingonanenterpriseinaccordancewiththeconditionsasprescribedinArticle9ofthepresentRegulationandthespecificrequirementsforproductionlicenseoftheproductslistedin(heCatalog.Thecheckersshallnot,whenmakingon-sitecheckingonanyenterprise,createdifficultiesfortheenterprise,orseekfororreceiveanypropertyoftheenterpriseorfigureforotherimproperbenefits.Article 18 ThecompetentdepartmentoftheStateCouncilinchargeofproductionlicenseforindustrialproductsandthecompetentdepartmentofproductionlicenseforindustrialproductsataprovince,autonomousregion,andmunicipalitydirectlyundertheCentralGovernmentshall,within3()daysfromacceptingtheapplicationofanenterprise,notifytheresultoftheon-sitecheckingtotheenterpriseinwriting.Iftheenterprisedoesnotpassthechecking,thereasonsshallbeexplained.Article 19 Ifanenterprisehaspassedon-sitechecking,itshallmakeinspectionontheproductintime.Ifthereisnecessitytosendsamplesforinspection,thecheckersshallsealupthesamplesforkeepingandnotifytheenterprisetosendthesamplestotheinspectioninstitutionthathasthecorrespondingqualificationwithin7days.Ifthereisnecessitytomakeon-siteinspection,thecheckersshallnotifytheinspectioninstitutiontomakeon-siteinspection.第十七条核查人员依照本条例第九条规定的条件和列入目录产品生产许可证的具体要求对企业进行实地核查。核查人员对企业进行实地核查，不得刁难企业，不得索取、收受企业的财物，不得谋取其他不当利益。第十八条国务院工业产品生产许可证主管部门或者省、自治区、直辖市工业产品生产许可证主管部门应当自受理企业申请之日起30日内将对企业实地核查的结果书面告知企业。核查不合格的，应当说明理由。第十九条企业经实地核查合格的，应当及时进行产品检验。需要送样检验的，核查人员应当封存样品，并告知企业在7日内将该样品送达具有相应资质的检验机构。需要现场检验的，由核查人员通知检验机构进行现场检验。Article 20 Theinspectioninstitutionshallmakeinspectiononproductsaccordingtotherelevantnationalstandardandrequirements,andcompletetheinspectionworkwithintheprescribedtime.TheinspectioninstitutionandinspectorsshallissueinspectionreportsObjectivelyJustlyandtimely.Theinspectionreportshallbesignedbythepersoninchargeoftheinspectioninstitutionafterbeingsignedbytheinspectors.Theinspectioninstitutionandtheinspectorsshallberesponsiblefortheinspectionreport.Article 21 Theinspectioninstitutionandtheinspectorsshall,whenmakinginspectiononanyproduct,followtheprincipleofgoodfaithandconvenienceforenterprises,soastoprovidereliableandconvenientinspectionsen,iceforenterprises,andshallnotdelayorcreatedifficultiesforenterprises.Article 22 NoinspectioninstitutionorinspectormayundertakeanyproductionandsalesactivityrelatingtotheproductlistedintheCatalogunderits/hisinspection,orrecommendorsupervisethemanufactureorthesaleofanyproductlistedintheCatalogunderits/hisinspectioninils/hisname.Article 23 Incasetheexaminationonanenterpriseisconductedbythecompetentdepartmentofproductionlicenseforindustrialproductsataprovince,autonomousregion,andmunicipalitydirectlyundertheCentralGovernment,thesaiddepartmentshall,aftercompletingtheexamination,submitthe第二十条检验机构应当依照国家有关标准、要求进行产品检验，在规定时间内完成检验工作。检验机构和检验人员应当客观、公正、及时地出具检验报告。检验报告经检验人员签字后，由检验机构负责人签署。检验机构和检验人员对检验报告负责。第二一条检验机构和检验人员进行产品检验,应当遵循诚信原则和方便企业的原则，为企业提供可靠、便捷的检验服务，不得拖延，不得刁难企业。第二十二条检验机构和检验人员不得从事与其检验的列入目录产品相关的生产、销售活动，不得以其名义推荐或者监制、监销其检验的列入目录产品。第二十三条由省、自治区、直辖市工业产品生产许可证主管部门组织对企业进行审查的，省、自治区、直辖市工业产品生产许可证主管部门应当在完成审查后将审查意见和全部申请材料报送国务院工业产品生产许可证主管部门。examinationopinionsandalltheapplicationdocumentstothecompetentdepartmentoftheStateCouncilinchargeofproductionlicenseforindustrialproducts.Article 24 ThecompetentdepartmentoftheStateCouncilinchargeofproductionlicenseforindustrialproductsshall,within60daysfromthedayofacceptingtheapplicationofanenterprise,makeadecisiononwhethertograntlicenseornot,ifitmakesadecisionongrantingalicense,itshallissuethecertificateofproductionlicenseforindustrialproducts(hereinafterrefeedtoastheLicenseCertificate)totheenterprisewithi
