管理办法，现予以公布。Forthepurposesofstrengtheningtheadministrationofrawmaterialsofaquaticproductsforexport,ensuringthesafetyandhygieneofaquaticproductsforexport,andregulatingtheadministrationoffilingoffarmsforrawmaterialsofaquaticproductsforexport,theGeneralAdministrationofCustomshasdevelopedtheMeasuresfortheAdministrationofFilingofFarmsforRawMaterialsofAquaticProductsforExport,whichisherebyissued.特此公告。海关总署GeneralAdministrationofCustomsMarch 20242024年3月4日MeasuresfortheAdministrationofFilingofRawMaterialsofAquaticProductsforExportChapterIGeneralProvisionsArticle1InaccordancewiththeFoodSafetyLawofthePeople'sRepublicofChinaandtheregulationfortheimplementationthereof,theFisheriesLawofthePeople,sRepublicofChinaandthedetailedrulesforitsimplementation,theCustomsLawofthePeople'sRepublicofChina,theMeasuresofthePeople'sRepublicofChinafortheAdministrationofSafetyofImportedandExportedFood,andotherlaws,regulationsanddepartmentalrules,theseMeasuresaredevelopedforpurposesofstrengtheningtheadministrationofrawmaterialsofaquaticproductsforexport,ensuringthesafetyandhygieneofaquaticproductsforexport,andregulatingtheadministrationoffilingoffarmsforrawmaterialsofaquaticproductsforexport.Article 2 TheseMeasuresapplytothefilingofaquaculturefarmsthatproviderawmaterialsofaquaticproductsforproducersoffoodforexport.ForthepurposesoftheseMeasures,Uaquaculturenmeansanyproductionactivityoffarmingaquaticanimalsandplantsbyusingvariouswaters,andinvariousways.Itdoesnotincludeaquaticproductsthatgrownaturallyafterartificialseedlingthrowinginopenseaareas,unlessexplicitlyrequiredbytheimportingcountry(region).出口水产品原料养殖场备案管 理办法第一章总则第一条为加强出口水产 品原料管理，保障出口水产品 的安全卫生，规范出口水产品 原料养殖场备案管理工作，根 据中华人民共和国食品安全 法及其实施条例、中华人 民共和国渔业法及其实施细 则、中华人民共和国海关 法、中华人民共和国进出 口食品安全管理办法等法律 法规、部门规章的规定，制定 本办法。第二条为出口食品生产 企业提供水产品原料的水产养 殖场备案适用于本办法。本办法适用的水产养殖是指利 用各种水域以各种方式进行水 产经济动植物养殖和种植的生 产活动，除输入国家（地区） 有明确要求外，不包括在开放 海域内人工投苗后自然生长的 水产品。第三条出口水产品原料 养殖场应当向所在地海关备 案。海关总署统一公布出口水Article 3 Afarmforrawmaterialsofaquaticproductsforexportshallbefiledwiththelocalcustoms.TheGeneralAdministrationofCustomsuniformlypublishesthelistoffarmsforraw产品原料养殖场备案名单。materialsofaquaticproductsforexportthataresubjecttofiling.ChapterIlConditionsandProceduresforFilingArticle4Afarmforrawmaterialsofaquaticproductsforexportshallmeetthefollowingbasicconditionsandhygienerequirements:(1) Ithaslegallyobtainedthecertificationmaterialsrecognizedaslegalfarmingbytheagriculturalorfisherydepartmentatorabovethecountylevel;(2) Therearenopollutionsourcessuchaslivestockandpoultryfarms,hospitals,chemicalplants,andgarbagedumpsaroundthefarms,andtheinternalenvironmentisingoodsanitation;(3) Farmingpondsorcagesinthefarmhaveastandardizednumber;(4) Thewatersourceissufficient,andthewaterqualityofaquaculturewatermeetstheFisheryWaterQualityStandard;(5) Thefarmiscleanandtidy,andthelayoutisreasonable;itmeetsthesanitaryandepidemicpreventionrequirements,therebyavoidingcrosscontaminationofwaterintakeanddrainage;第二章 备案条件和程序第四条出口水产品原料 养殖场应当满足以下基本条件 和卫生要求：（一）依法取得县级以上农业 或渔业部门认可为合法养殖的 证明材料；（二）养殖场周围无畜禽养殖 场、医院、化工厂、垃圾场等 污染源，内部环境卫生良好；（三）养殖场内养殖池或网箱 有规范的编号；（四）水源充足，养殖用水水 质符合渔业水质标准；（五）场区卫生整洁、布局合 理，符合卫生防疫要求，避免 进排水交叉污染；（六）具有独立分设的药物和 饲料仓库，仓库保持清洁干 燥，通风良好，有专人负责记 录入出库登记；(6) Ithasindependentdrugandfeedwarehouses,whicharekeptclean,dry,andwell-ventilated.Aspecialpersonisdesignatedforrecordingtheentryandexitregistration;(7) Thefarmingdensityisappropriate,anditisequippedwithoxygenationfacilitiessuitableforthefarmingdensity;(8) ItdoesnotstoreandusedrugsandothertoxicandharmfulsubstancesprohibitedbyChinaandimportingcountries(regions).Thedrugsusedshouldbemarkedwitheffectiveingredients.Itestablishestrueandcompletedruguserecords,andstrictlyabidesbytheprovisionsforthewithdrawalperiod;(9) ThefeedfedmeetstherequirementsoftheRegulationontheAdministrationofFeedsandFeedAdditives;(10) Itestablishesasoundaquaculturemanagementsystemandoperatesthesystemeffectively.Thefarmshouldfillintheaquacultureloginanaccurate,standardized,andtimelymanner,andtherelevantrecordsshouldbekeptformorethantwoyearsafteralltheaquaticproductsaresold;and(11) Itisstaffedwithaquaculturetechnicians,whoshouldbefamiliarwithandabidebytheprovisionsofrelevantlawsandregulationsandbefamiliarwiththerelevantdrugresiduecontrolregulationsandstandardsoftheimportingcountries(regions)oftheiraquaculturerawmaterialsprocessing,andisabletocarryoutaquaculturemanagementaccordingtoitsrequirements.（七）养殖密度适当，配备与 养殖密度相适应的增氧设施；（A）不存放和使用中国、输 入国家（地区）禁止使用的药 物和其他有毒有害物质，使用 的药物应当标注有效成份，建 立真实完整的用药记录，并严 格遵守停药期规定；（九）投喂的饲料符合饲料 和饲料添加剂管理条例要 求；（十）建立完善的水产养殖管 理制度并有效运行，养殖场应 准确、规范、及时填写养殖日 志，相关记录应当保存至该批 水产品全部销售后2年以上；（十一）配备养殖技术员，养 殖技术员应熟悉并遵守相关法 律法规等规定，熟悉其养殖原 料加工的水产品输入国家（地 区）相关药残控制法规和标准 并能遵照其要求开展养殖管 理。第五条出口水产品原料 养殖场备案的申请人可以为自 然人、个体工商户、农民专业 合作社、行业协会或企业。Article5Anapplicantforthefilingoffarmsforrawmaterialsofaquaticproductsforexportmaybeanaturalperson,individualindustrialandcommercialhousehold,specializedfarmers'cooperative,industryassociation,orenterprise.Article6Anapplicantforthefilingoffarmsforrawmaterialsofaquaticproductsforexportshall,throughtheinformationsystem,applytothecustomswherethefarmislocated,andprovidethefollowingapplicationmaterialsandberesponsiblefortheirauthenticity:(1) AnApplicationFormforFilingofFarmsforRawMaterialsofAquaticProductsforExport(seeAnnex1)；(2) Thecertificationmaterialsapprovedaslegalfarmingbytheagriculturalorfisherydepartmentatorabovethecountylevel.Iftheownerofthefarminthecertificationmaterialsoflegalfarmingisinconsistentwiththeapplicant,thelease,contract,oruseagreementsignedbybothpartiesshallbeprovided.Article7Thecustomsexaminestheapplicationmaterialssubmittedbytheapplicant,andifthematerialsarecompleteandconformtothestatutoryform,itshallcompletethefilingwithinfiveworkingdays.ChapterIIIAdministrationofFilingArticle8Thevalidityperiodoffilingshallbevalidforalongtimewithinthevalidityperiodofcertificationmaterialsoflegalfarming.第六条出口水产品原料 养殖场备案申请人通过信息化 系统向养殖场所在地海关提出 申请，提供以下申请材料并对 其真实性负责：（一）出口水产品原料养殖 场备案申请表（见附件 D ;（二）县级以上农业或渔业部 门认可为合法养殖的证明材 料，合法养殖证明材料中养殖 场所有人与申请人不一致的， 需提供双方签订的租赁、承包 或使用协议。第七条海关对申请人提 出的申请材料进行审核，对材 料齐全、符合法定形式的，应 当在5个工作日内完成备案。第三章备案管理第八条备案有效期在合 法养殖证明材料有效期内长期 有效。第九条已获得备案的出 口水产品原料养殖场的名称、 地址（未发生位置搬迁）、养 殖面积、法定代表人或经营 者、养殖品种等备案信息发生 变更，或者合法养殖证明材料Article9Ifthefilinginformation,suchasthename,address(norelocation),farmingarea,legalrepresentativeoroperator,andfarmingvariety,ofafarmforrawmaterialsofaquaticproductsforexportthathasbeenfiledischanged,orthecertificationmaterialsoflegalfarmingexpire,itshallapplytothelocalcustomsforchangewithin30daysfromthedateofthechange.Ifnochangeismadewithinthetimelimit,thecustomsmaynotifyittomakecorrectionswithintenworkingdays.Article10Ifthereisagreatchangeintherighttouse,farmingtypes,location,andsurroundingfarmingenvironmentofafarmforrawmaterialsofaquaticproductsforexportthathasbeenfiled,oranyothermajorchangethatmaydirectlyorindirectlyaffectthesafetyandhygieneoffarmingaquaticproducts,theoriginalfilingqualificationshallbecanceledwithin30daysfromthedateofthechange,andanewapplicationforfilingshallbemade.Article11Afarmforrawmaterialsofaquaticproductsforexportthathasbeenfiledshall,fromthefollowingyearoffiling,submittheAnnualReportofFarmsforRawMaterialsofAquaticProductsforExportthatHasBeenFiledofthepreviousyear(seeAnnex2)tothelocalcustomsbeforetheendofMarchofeachyear.Ifitisnotsubmittedonschedule,thecustomsmaynotifyittomakecorrectionswithintenworkingdays.Article12Ifanyofthefollowingcircumstancesoccurstoafarmforrawmaterialsofaquaticproductsforexportthathasbeenfiled,thefilingshallbecanceled:(1) Theapplicantforfilingthefarmvoluntarilyappliesforcancellationofthefiling;到期的，应当自变更之日起30 日内向所在地海关申请变更。 超期未予变更的，海关可通知 其在10个工作日内改正。第十条出口水产品原料 备案养殖场养殖使用权、养殖 种类、养殖场位置搬迁、养殖 场及周边养殖环境有较大变 化，或发生其他较大改变可能 直接或间接影响养殖水产品安 全卫生的，应当自改变之日起 30日内注销原备案资质后，重 新申请备案。第十一条出口水产品原 料备案养殖场应当于备案次年 起，每年3月底前向所在地海 关报送上年度出口水产品原 料备案养殖场年度报告表（见附件2） o未按期提交 的，海关可通知其在10个工 作日内改正。第十二条出口水产品原 料备案养殖场有以下情形之一 的，注销备案：（一）养殖场备案申请人主动 申请注销备案的；（二）养殖场养殖使用权依法 终止的；terminated(2) Therighttouseofthefarmisaccordingtothelaw;(3) Noapplicationforchangeismadewithin30daysunderthecircumstancessetoutinArticle9oftheseMeasures,andthefarmrefusestochangewithintenworkingdaysafterbeingnotifiedbythecustomsforcorrection;(4) AnyofthecircumstancessetoutinArticle10oftheseMeasuresexists;or(5) Itfailstosubmittheannualreportonscheduleandrefusestosubmitthereportwithintenworkingdaysafterbeingnotifiedbythecustomsforcorrection.Article13Ifanyofthefollowingcircumstancesoccurstoafarmforrawmaterialsofaquaticproductsforexportthathasbeenfiled,thefilingshallbecanceled,andnonewapplicationshallbemadewithintwoyears:(1) ItstoresorusesdrugsandothertoxicandharmfulsubstancesprohibitedbyChinaortheimportingcountry(region),usesdrugsthatarenotmarkedwitheffectiveingredientsordrugadditivescontainingprohibiteddrugs,andfailstostoptakingdrugsduringthewithdrawalperiodasrequired;(2) Itprovidesfalsesupplycertificationmaterials,ortransfers,ortransfersindisguisedform,thefilingnumber;（三）存在本办法第九条所述 情形未在30日内申请变更 的，且经海关通知改正后10 个工作日内仍拒绝变更的；（四）存在本办法第十条情形 的；（五）未按期提交年度报告，且经海关通知改正后10个工作日内仍拒绝提交的。第十三条出口水产品原 料备案养殖场有以下情形之一 的，取消备案，且2年内不得 重新提出申请：（一）存放或者使用中国、输 入国家（地区）禁止使用的药 物和其他有毒有害物质，使用 的药物未标明有效成份或者使 用含有禁用药物的药物添加 剂，未按规定在休药期停药 的；（二）提供虚假供货证明材 料、转让或者变相转让备案编 号的；（三）隐瞒重大养殖水产品疫 病或者未及时向海关报告的；(3) Itconcealsmajorepidemicsofculturedaquaticproductsorfailstoreportthemtothecustomsinatimelymanner;(4) It refuses to accept the supervision and administration of the customs or the inspection by the competent authorities of the importing country (region), or fails to truthfully provide relevant information and materials; or（四）拒不接受海关监督管理 或输入国（地区）主管当局检 查的，或未如实提供有关情况 和材料的；(5) It is unable to continuously meet the basic conditions and hygiene requirements for filing or to take corrective action or refuses to take corrective action.（五）不能持续符合备案基本 条件和卫生要求，无法整改或 拒不整改的。Article 14 If there are any special provisions on farms for raw materials of aquatic products in the laws and regulations of the importing country (region) or multi-bilateral agreements, such provisions shall prevail.第十四条输入国家（地 区）法律法规、多双边协议如 对水产品原料养殖场有特殊规 定的，从其规定。Article 15 The General Administration of Customs shall be responsible for the interpretation of these Measures.第十五条本办法由海关
