1 ThisRegulationisdevelopedinaccordancewiththeLaborLawofthePeople'sRepublicofChinaandtherelevantlegalprovisionsforthepurposesofregulatingwagepaymenttomigrantworkersandensuringthatmigrantworkersreceivetheirwagesontimeandinfull.Article 2 ThisRegulationshallapplytotheensuringofwagepaymenttomigrantworkers.ForthepurposeofthisRegulation,umigrantworker"meansanyruralresidentwhoprovideslaborforanemployer.ForthepurposeofthisRegulation,“wage”meanstheremunerationthatamigrantworkershouldreceiveafterprovidinglabortoanemployer.Article 3 Amigrantworkershallhavetherighttoreceivehisorherwagesinduetimeandinfull.Noentityorindividualmaydefaultonthewagesofmigrantworkers.Migrantworkersshallabidebylabordisciplineandprofessionalethics,implementrulesonlaborsafetyandhealth,andfulfilltheirlabortasks.民工按时足额获得工资，根 据中华人民共和国劳动 法及有关法律规定，制定 本条例。第二条保障农民工 工资支付，适用本条例。本条例所称农民工,是指为 用人单位提供劳动的农村 居民Q本条例所称工资，是指农民 工为用人单位提供劳动后 应当获得的劳动报酬。第三条农民工有按 时足额获得工资的权利。任 何单位和个人不得拖欠农 民工工资。农民工应当遵守劳动纪律 和职业道德，执行劳动安全 卫生规程，完成劳动任务。第四条县级以上地 方人民政府对本行政区域 内保障农民工工资支付工 作负责，建立保障农民工工 资支付工作协调机制，加强 监管能力建设,健全保障农 民工工资支付工作目标责 任制，并纳入对本级人民政 府有关部门和下级人民政 府进行考核和监督的内容。Article4Thelocalpeople'sgovernmentsatorabovethecountylevelshallberesponsibleforensuringthepaymentofthewagesofmigrantworkerswithintheirrespectiveadministrativeareas,establishamechanismforcoordinatingthepaymentofwagestomigrantworkers,enhancetheirsupervisioncapability,improvetheresponsibilitysystemforensuringthepaymentofwagestomigrantworkers,andincludetheaforesaidcontentsintheexaminationandsupervisionoftherelevantdepartmentsofthepeople'sgovernmentsatthecorrespondinglevelsandthepeople'sgovernmentsatlowerlevels.Thepeople'sgovernmentsatthetownshiplevelandsub-districtofficesshallstrengthentheinvestigationandmediationofthewagearrearstomigrantworkers,preventandresolvetheconflicts,andmediatedisputesinatimelymanner.Article5Marketparticipantsshallberesponsibleforensuringthepaymentofwagestomigrantworkers,whichshallbesupervisedbythegovernmentandassistedbythepublic,sothatthewagearrearstomigrantworkersmaybelegallyeradicatedaccordingtotherequirementsofcontrollingatthesource,focusingonpreventionandcombiningpreventionandcontrol,andaddressingbothsymptomsandrootcauses.Article6Anemployershalladoptthereal-namesystemfortheemploymentofmigrantworkers,andagreeinwritingwiththerecruitedmigrantworkersonwagepaymentstandardsandpaymenttimeandmethodorstipulatethemthroughrulesandregulationsdevelopedaccordingtolaw.Article7Theadministrativedepartmentofhumanresourcesandsocialsecurityshallberesponsiblefortheorganization,coordination,managementandguidanceoftheworkofensuringthepaymentofwagestomigrantworkersandforthesupervisionandinspectionofthepaymentofwagestomigrantworkers.Itshallinvestigateandhandlethecasesconcerningthewagearrearstomigrantworkers.乡镇人民政府、街道办事处 应当加强对拖欠农民工工 资矛盾的排查和调处工作, 防范和化解矛盾，及时调解 纠纷。第五条保障农民工 工资支付,应当坚持市场主 体负责、政府依法监管、社 会协同监督，按照源头治 理、预防为主、防治结合、 标本兼治的要求，依法根治 拖欠农民工工资问题。第六条用人单位实 行农民工劳动用工实名制 管理，与招用的农民工书面 约定或者通过依法制定的 规章制度规定工资支付标 准、支付时间、支付方式等 内容。第七条人力资源社 会保障行政部门负责保障 农民工工资支付工作的组 织协调、管理指导和农民工 工资支付情况的监督检查, 查处有关拖欠农民工工资 案件。住房城乡建设、交通运输、 水利等相关行业工程建设 主管部门按照职责履行行 业监管责任，督办因违法发 包、转包、违法分包、挂靠、Departmentsresponsibleforengineeringconstructioninhousingandurban-ruraldevelopment,transport,waterconservancyandotherrelatedindustriesshall,accordingtotheirfunctionsandduties,assumeresponsibilityforindustrysupervisionandsupervisecasesofwagearrearstomigrantworkerscausedbyillegalcontractingandsubcontracting,affiliationorprojectpaymentarrears.Departmentsresponsiblefordevelopmentandreformshall,accordingtotheirduties,beresponsiblefortheexaminationandapprovalandadministrationofgovernment-fundprojects,examinethesourcesoffundsandwaysoffundraisingforgovernment-fundprojectsinaccordancewithlaw,makeatimelyarrangementofgovernmentinvestmentinaccordancewithrelevantprovisions,strengthenthebuildingofthesocialcreditsystem,andorganizerestrictionsandpunishmentsonthosethataresubjecttojointdisciplinaryfordishonestyinwagearrearstomigrantworkers.Financedepartmentsshallberesponsibleforthebudgetmanagementofgovernmentinvestmentfunds,andallocategovernmentinvestmentfundsinfullandontimeaccordingtotheapprovedbudget.Publicsecurityorgansshallberesponsibleforacceptingandinvestigatingcriminalcasesofsuspectedrefusaltopaylaborremunerationinatimelymanner,andhandlingpublicsecuritycasescausedbywagearrearstomigrantworkersinaccordancewithlaw.Departmentsofjudicialadministration,naturalresources,auditing,state-ownedassetsmanagement,taxation,marketsupervisionandfinancialsupervision,aswellasthePeople'sBankofChina,shall,accordingtotheirduties,effectivelyconducttheworkrelatedtoensuringthepaymentofwagestomigrantworkers.拖欠工程款等导致的拖欠 农民工工资案件。发展改革等部门按照职责 负责政府投资项目的审批 管理，依法审查政府投资项 目的资金来源和筹措方式, 按规定及时安排政府投资， 加强社会信用体系建设，组 织对拖欠农民工工资失信 联合惩戒对象依法依规予 以限制和惩戒。财政部门负责政府投资资 金的预算管理，根据经批准 的预算按规定及时足额拨 付政府投资资金。公安机关负责及时受理、侦 办涉嫌拒不支付劳动报酬 刑事案件，依法处置因农民 工工资拖欠引发的社会治 安案件。司法行政、自然资源、人民 银行、审计、国有资产管理、 税务、市场监管、金融监管 等部门，按照职责做好与保 障农民工工资支付相关的 工作。第八条工会、共产 主义青年团、妇女联合会、 残疾人联合会等组织按照 职责依法维护农民工获得Article8Tradeunions,communistyouthleagues,women'sfederations,disabledpersons*federationsandotherorganizationsshall,accordingtotheirdutiesandinaccordancewithlaw,protecttherightofmigrantworkerstoreceivewages.Article9Thenewsmediashallgivepublicityoverthelaws,regulationsandpoliciesforensuringthepaymentofmigrantworkers*wages,providecoverageofrolemodels,andlegallystrengthenpublicsupervisionoverillegalactofdefaultingonmigrantworkers*wages,sothatemployersmaybeencouragedtostrengthentheirlegalawarenessoflaw-basedemploymentandwagepaymentinfullandontimeandmigrantworkersmaybeencouragedtosafeguardtheirrightsinaccordancewithlaw.Article10Amigrantworkerwhosewagesarepaidinarrearsshallbeentitledtofilecomplaintsinaccordancewithlawortoapplyformediationandarbitrationoflabordisputesandbringlawsuits.Anyentityorindividualshallhavethepowertoreportanyactofdefaultingonwagesformigrantworkerstotheadministrativedepartmentofhumanresourcesandsocialsecurityorotherrelevantdepartments.工资的权利。第九条新闻媒体应 当开展保障农民工工资支 付法律法规政策的公益宣 传和先进典型的报道，依法 加强对拖欠农民工工资违 法行为的舆论监督，引导用 人单位增强依法用工、按时 足额支付工资的法律意识, 引导农民工依法维权。第十条被拖欠工资 的农民工有权依法投诉，或 者申请劳动争议调解仲裁 和提起诉讼。任何单位和个人对拖欠农 民工工资的行为，有权向人 力资源社会保障行政部门 或者其他有关部门举报。人力资源社会保障行政部 门和其他有关部门应当公 开举报投诉电话、网站等渠 道，依法接受对拖欠农民工 工资行为的举报、投诉。对 于举报、投诉的处理实行首 问负责制，属于本部门受理 的，应当依法及时处理；不 属于本部门受理的，应当及 时转送相关部门，相关部门 应当依法及时处理，并将处 理结果告知举报、投诉人。Theadministrativedepartmentofhumanresourcesandsocialsecurityandotherrelevantdepartmentsshalldisclosetip-offandcomplainthotline,websiteandotherchannels,andaccepttip-offsandcomplaintsonwagearrearstomigrantworkersinaccordancewithlaw.Thefirstinquiryaccountabilitysystemshallbeperformedinhandlingtip-offsorcomplaints.Ifatip-offorcomplaintisacceptedwithinadepartment,itshall,inatimelymanner,bedealtwithinaccordancewithlaw;ifatip-offorcomplaintisnotacceptedwithinadepartment,itshall,inatimelymanner,betransferredtotherelevantdepartment,whichshalldealwithitinatimelymanneraccordingtolawandinformtheinformantorcomplainantofthehandlingresults.ChapterIlFormandCycleofWagePaymentArticle 11 Wagesofmigrantworkersshallbepaidtothemintheformofcurrencybybanktransferorcash,andshallnotbesubstitutedbyphysicalobjectsornegotiablesecurities.Article 12 Anemployershallpaywagesinfullaccordingtothewagepaymentcycleandspecificpaymentdateasagreeduponinwritingwiththemigrantworkersorasspecifiedintherulesandregulationsdevelopedaccordingtolaw.Article 13 Ifthemonthly,weekly,dailyandhourlywagesystemisimplemented,wagesshallbepaidonamonthly,weekly,dailyorhourlybasis;ifthesystemofpayingwagesbypieceworkisimplemented,thepaymentcycleshallbeagreeduponbybothpartiesaccordingtolaw.Article 14 Thewagepaymentcycleandspecificpaymentdateasagreeduponinwritingwiththemigrantworkersorasspecifiedintherulesandregulationsdevelopedaccordingtolawmaybethecurrentorsubsequentperiodwhenmigrantworkersprovidelabor.Ifaspecificpaymentdatefallsonastatutoryholidayoranoff-day,wagesshallbepaidbeforethestatutoryholidayoroff-day.Ifanemployerfailstopaywagesonthedateofpaymentduetoforcemajeure,itshallmakepaymentsinatimelymanneraftertheforcemajeureiseliminated.第二章工资支付形式与 周期第H一条农民工工 资应当以货币形式，通过银 行转账或者现金支付给农 民工本人，不得以实物或者 有价证券等其他形式替代。第十二条用人单位 应当按照与农民工书面约 定或者依法制定的规章制 度规定的工资支付周期和 具体支付日期足额支付工 资。第十三条实行月、 周、日、小时工资制的，按 照月、周、日、小时为周期 支付工资；实行计件工资制 的，工资支付周期由双方依 法约定。第十四条用人单位 与农民工书面约定或者依 法制定的规章制度规定的 具体支付日期，可以在农民 工提供劳动的当期或者次 期。具体支付日期遇法定节 假日或者休息日的，应当在 法定节假日或者休息日前 支付。用人单位因不可抗力未能 在支付日期支付工资的，应 当在不可抗力消除后及时 支付。第十五条用人单位Article 15 Anemployershall,accordingtothewagepaymentcycle,prepareawrittenpayrolljournal,whichshallbekeptforaminimumofthreeyears.Thewrittenjournalshallinclude,amongothers,theemployer'sname,thepaymentcycleanddate,thepayee'sname,IDnumberandcontactinformation,workinghours,theitemsandamountofwagespayable,theitemsandamountwithheldanddeducted,theamountofwagesactuallypaidaswellasthevouchersforwagespaidbythebankorthesignaturesofmigrantworkers.Whentheemployerpayswagestomigrantworkers,itshallprovideeachmigrantworkerwithhisorherwagelist.ChapterIIIPayoffofWagesArticle 16 Anemployerthatdefaultsonthewagesofmigrantworkersshallpayoffsuchwagesaccordingtolaw.Article 17 Ifanentitythatisnotqualifiedtoconductlegaloperationsrecruitsmigrantworkersandthemigrantworkershaveworkedbutfailedtoreceivewages,therelevantlawsandregulationsshallapply.Article 18 Ifthewagesofmigrantworkersareinarrearswhenanemployeremploysmigrantworkersdispatchedbyanindividualoranentitynotqualifiedtoconductlegaloperationsorfailingtoobtainthelabordispatchpermitinaccordancewithlaw,theemployershallpayoffallthewages,andmaymakerecourseinaccordancewithlaw.应当按照工资支付周期编 制书面工资支付台账，并至 少保存3年。书面工资支付台账应当包 括用人单位名称，支付周 期，支付日期，支付对象姓 名、身份证号码、联系方式, 工作时间，应发工资项目及 数额，代扣、代缴、扣除项 目和数额，实发工资数额, 银行代发工资凭证或者农 民工签字等内容。用人单位向农民工支付工 资时,应当提供农民工本人 的工资清单。第三章工资清偿第十六条用人单位 拖欠农民工工资的，应当依 法予以清偿。第十七条不具备合 法经营资格的单位招用农 民工，农民工已经付出劳动 而未获得工资的，依照有关 法律规定执行。第十八条用工单位 使用个人、不具备合法经营 资格的单位或者未依法取 得劳务派遣许可证的单位 派遣的农民工，拖欠农民工 工资的，由用工单位清偿, 并可以依法进行追偿。第十九条用人单位 将工作任务发包给个人或Article 19 Ifanemployercontractsitstaskstoanindividualoranentitywithoutlegalbusinessqualificationsandthereforeresultsinthewagearrearstotherecruitedmigrantworkers,therelevantlawsshallapply.Ifanemployerallowsanindividualoranentitynotqualifiedtoconductlegaloperationsorfailingtoobtainthecorrespondingqualificationstoconductoperationsinthenameoftheemployer,whichthusresultsinthewagearrearstotherecruitedmigrantworkers,theemployershallpayoffthewagesinarrearsandmaymakerecourseinaccordancewithlaw.Article 20 Ifanemployersuchasapartnership,soleproprietorshiporindividualeconomicorganizationdefaultsonthewagesofmigrantworkers,itshallpayoffwagesinarrearsaccordingtolaw;ifitrefusestopayoff,theinvestorshalldosoaccordingtolaw.Article 21 Inthecaseofmergerorsplit,anemployershallpayoffthewagesofmigrantworkersinarrearsaccordingtolawbeforemergerorsplit.Ifaconsensusisreachedthroughwrittenconsultationwithmigrantworkers,thearrearswagesmaybepaidoffbytheemployerthathasinheriteditsrightsandobligationsaftermergerorsplit.Article 22 Ifanemployerisrevokedofitsbusinesslicenseorregistrationcertificate,orderedtoclosedown,revokedordissolvedaccordingtolaw,itshallpayoffthewagesofmigrantworkersinarrearsaccordingtolawbeforeapplyingforde-registration.者不具备合法经营资格的 单位,导致拖欠所招用农民 工工资的，依照有关法律规 定执行。用人单位允许个人、不具备 合法经营资格或者未取得 相应资质的单位以用人单 位的名义对外经营，导致拖 欠所招用农民工工资的，由 用人单位清偿，并可以依法 进行追偿。第二十条合伙企 业、个人独资企业、个体经 济组织等用人单位拖欠农 民工工资的，应当依法予以 清偿；不清偿的，由出资人 依法清偿。第二十一条用人单 位合并或者分立时,应当在 实施合并或者分立前依法 清偿拖欠的农民工工资；经 与农民工书面协商一致的, 可以由合并或者分立后承 继其权利和义务的用人单 位清偿。第二十二条用人单 位被依法吊销营业执照或 者登记证书、被责令关闭、 被撤销或者依法解散的，应 当在申请注销登记前依法 清偿拖欠的农民工工资。未依据前款规定清偿农民 工工资的用人单位主要出 资人,应当在注册新用人单Themaininvestoroftheemployerthatfailstopayoffthewagesofmigrantworkersinaccordancewiththeprovisionsoftheprecedingparagraphshallpayoffthewagesofmigrantworkersinarrearsbeforetheregistrationofanewemployer.ChapterIVSpecialProvisionsonEngineeringConstructionArticle23Aconstructionemployershallhavefundingarrangementsthatmeettheneedsofconstruction.Ifanengineeringconstructionprojecthasnofundingarrangementsthatmeettheneedsofconstruction,theconstructionthereofshallnotstart;ifaconstructionpermitisrequiredaccordingtolaw,theengineeringconstructiondepartmentfortherelevantindustriesshallnotissuetheconstructionpermit.Thefundsneededforgovernment-fundedprojectsshallbeallocatedinaccordancewiththerelevantprovisionsofthestate,andshallnotbeprovidedinadvancebytheconstructioncontractor.Article24Theconstructionemployershallprovideguaranteeforthepaymentofprojectfundstotheconstructioncontractor.Whenconcludingawrittencontractforprojectconstructioninaccordancewithlaw,theconstructionemployerandthegeneralconstructioncontractorshallagreeuponthecalculationcycleofprojectpayments,themeasuresforprogresspaymentsonconstructionprojectsandtheallocationcycleoflaborcosts,andspecifylaborcostsaccordingtotherequirementsforensuringthepaymentofmigrantworkers*wagesinfullandontime.Theallocationcycleoflaborcostsshallnotexceedonemonth.位前清偿拖欠的农民工工 资。第四章工程建设领域特 别规定第二十三条建设单 位应当有满足施工所需要 的资金安排。没有满足施工 所需要的资金安排的，工程 建设项目不得开工建设；依 法需要办理施工许可证的, 相关行业工程建设主管部 门不予颁发施工许可证。政府投资项目所需资金,应 当按照国家有关规定落实 到位，不得由施工单位垫资 建设。第二十四条建设单 位应当向施工单位提供工 程款支付担保。建设单位与施工总承包单 位依法订立书面工程施工 合同，应当约定工程款计量 周期、工程款进度结算办法 以及人工费用拨付周期，并 按照保障农民工工资按时 足额支付的要求约定人工 费用。人工费用拨付周期不 得超过1个月。建设单位与施工总承包单 位应当将工程施工合同保Theconstructionemployerandthegeneralconstructioncontractorshallkeeptheprojectconstructioncontractforfuturereference.Article25Whenthegeneralconstructioncontractorandsubcontractorsconcludewrittensubcontractsinaccordancewithlaw,theyshallagreeuponthecalculationcycleofprojectpaymentsandthemeasuresforprogresspayments.Article26Thegeneralconstructioncontractorshall,inaccordancewiththerelevantprovisions,openspecialaccountsformigrantworkers*wages,whichareusedexclusivelyforpaymentofthewagesofmigrantworkersforaconstructionproject.Relevantmaterialsforopeningandusingspecialaccountsformigrantworkers*wagesshallbeproperlykeptbythegeneralconstructioncontractorforfuturereference.Article27Financialinstitutionsshalloptimizetheproceduresforopeningspecialaccountsformigrantworkers'wages,andeffectivelyconductthedailymanagementofspecialaccountsformigrantw
