人力资源服务机构管理规定第一章总则第一条为了加强对人 力资源服务机构的管理,规 范人力资源服务活动,健全 统一开放、竞争有序的人力 资源市场体系,促进高质量 充分就业和优化人力资源流 动配置,根据中华人民共 和国就业促进法人力资 源市场暂行条例等法律、 行政法规,制定本规定。第二条在中华人民共 和国境内的人力资源服务机 HumanProvisionsontheAdministrationResourcesServiceProvidersChapterIGeneralProvisionsArticle1TheseProvisionsaredevelopedinaccordancewiththeEmploymentPromotionLawofthePeople'sRepublicofChina,theInterimRegulationonHumanResourcesMarket,andotherlawsandadministrativeregulationsforthepurposesofstrengtheningtheadministrationofhumanresourcesserviceproviders,regulatinghumanresourcesserviceactivities,improvinghumanresourcesmarketsystemthatisunified,open,competitiveandorderly,promotinghigh-qualityfullemploymentandoptimizingtheflowandallocationofhumanresources.Article2TheseProvisionsshallapplytohumanresourcesserviceprovidersengagedinhumanresourcesserviceactivitiesinthePeople'sRepublicofChina.适用本规定。Article3Theadministrativedepartmentofhumanresourcesandsocialsecurityatorabovethecountylevelshall,inaccordancewiththelaw,administerhumanresourcesserviceproviderswithinitsadministrativeregion.Article4Theadministrativedepartmentofhumanresourcesandsocialsecurityshallstrengthenthestandardizationandinformatizationofhumanresourcesservices,andguidehumanresourcesserviceindustryassociationsinstrengtheningindustryself-regulation.第三条县级以上人力资源社会保障行政部门依法开展本行政区域内的人力资源服务机构管理工作。第四条人力资源社会保障行政部门应当加强人力资源服务标准化、信息化建设,指导人力资源服务行业协会加强行业自律。ChapterIlAdministrativeLicensingandRecordation第二章行政许可和备案Article5Anoperationalhumanresourcesserviceproviderengagedinjobintermediaryactivitiesshallapplyforanadministrativelicensetotheadministrativedepartmentofhumanresourcesandsocialsecurityinaccordancewiththelawandobtainahumanresourceservicepermitaftercompletingtheregistrationofmarketparticipants.Thoseengagedinonlinerecruitmentservicesshallalsoobtainatelecommunicationsbusinesspermitinaccordancewiththelaw.第五条经营性人力资源服务机构从事职业中介活动的,应当在市场主体登记办理完毕后,依法向住所地人力资源社会保障行政部门申请行政许可,取得人力资源服务许可证。从事网络招聘服务的,还应当依法取得电信业务经营许可证。ForthepurposeoftheseProvisions,“jobintermediaryactivitiesnmeanstheintermediaryservicesprovidedforemployerstorecruitstaffandforworkerstoseekjobs,includingcommercialactivitiessuchasrecommendingworkerstoemployers,introducingemployerstoworkers,organizingandholdingjobfairs,providingonlinerecruitmentservices,andprovidingseniorexecutive本规定所称职业中介活动是指为用人单位招用人员和劳动者求职提供中介服务,包括为用人单位推荐劳动者、为劳动者介绍用人单位、组织开展招聘会、开展网络招聘服务、开展高级人才寻访search(headhunting)services.(猎头)服务等经营性活动。Article6Toapplyforbeingengagedinjobintermediaryactivities,anapplicantshallmeetthefollowingconditions:第六条申请从事职业中介活动的,应当具备下列条件:(1)Havingcleararticlesofassociationandmanagementrules;(一)有明确的章程和管理制度;(2)Havingafixedplaceofbusiness,officefacilities,andacertainsumofstartupcapital,whichareessentialtocarryoutbusiness;(二)有开展业务必备的固定场所、办公设施和一定数额的开办资金;(3)Havingthreeormorefull-timeemployees;(三)有3名以上专职工作人员;(四)法律、法规规定的其 他条件。第七条申请从事职业 中介活动的,可以自愿选择 按照一般程序或者告知承诺 制方式申请行政许可。按照 一般程序申请的,应当向住 所地人力资源社会保障行政 部门提交以下申请材料:(一)从事职业中介活动的 申请书;(4)Otherconditionsasprescribedbylawsandregulations.Article7Anapplicantforbeingengagedinjobintermediaryactivitiesmayvoluntarilychoosetoapplyforadministrativelicensingunderthegeneralproceduresorthenotificationandcommitmentsystem.Iftheapplicationisfiledunderthegeneralprocedures,thefollowingapplicationmaterialsshallbesubmittedtotheadministrativedepartmentofhumanresourcesandsocialsecurityatitsplaceofdomicile:(1) Awrittenapplicationforbeingengagedinjobintermediaryactivities;(二)机构章程和管理制 度;(2) Thearticlesofassociationandmanagementrulesoftheserviceprovider;(三)场所的所有权证明或 者租赁合同;(3) Thecertificateofownershiportheleasingcontractofitspremises;(四)专职工作人员的基本 情况表;(4) Thestatementonthebasicinformationonitsfull-timeemployees;(五)法律、法规规定的其 他材料。(5) Othermaterialsasprescribedbylawsandregulations.前款规定的申请材料通过政 务信息共享可以获得的,人 力资源社会保障行政部门应 当通过政务信息共享获取。 提交申请材料不齐全的,人 力资源社会保障行政部门应 当当场一次性告知需要补正 的全部材料。Wheretheapplicationmaterialsprescribedintheprecedingparagraphmaybeobtainedthroughthesharingofgovernmentinformation,theadministrativedepartmentofhumanresourcesandsocialsecurityshallobtainthemthroughthesharingofgovernmentinformation.Iftheapplicationmaterialssubmittedareincomplete,theadministrativedepartmentofhumanresourcesandsocialsecurityshallinformtheapplicantofallnecessarysupplementsandcorrectionsatonetimeonthespot.按照告知承诺制方式申请 的,只须提交从事职业中介 活动的申请书和承诺书。申 请人有较严重不良信用记录 或者存在曾作出虚假承诺等 情形的,在信用修复前不适 用告知承诺制。Wheretheapplicationisfiledunderthenotificationandcommitmentsystem,onlytheapplicationforbeingengagedinjobintermediaryactivitiesandtheletterofcommitmentshallbesubmitted.Wheretheapplicanthasarelativelyseriousadversecredithistoryorfallsintooneofthecircumstancessuchashavingmadeafalsecommitment,thenotificationandcommitmentsystemwillnotapplyuntiltheapplicant'screditisrepaired.第八条按照一般程序Article 8 Whereanapplicationforadministrative申请行政许可的,人力资源 社会保障行政部门应当自收 到申请之日起20日内依法作 出行政许可决定。按照告知 承诺制方式申请行政许可 的,人力资源社会保障行政 部门应当经形式审查后当场 作出行政许可决定。licensingisfiledinaccordancewiththegeneralprocedures,theadministrativedepartmentofhumanresourcesandsocialsecurityshallmakeanadministrativelicensingdecisioninaccordancewiththelawwithin20daysofreceiptoftheapplication.Ifanapplicationforanadministrativelicenseisfiledunderthenotificationandcommitmentsystem,theadministrativedepartmentofhumanresourcesandsocialsecurityshallmakeanadministrativelicensingdecisiononthespotafteraformalexamination.符合条件,人力资源社会保 障行政部门作出准予行政许 可决定的,应当自作出决定 之日起10日内向申请人颁 发、送达人力资源服务许可 证;不符合条件,人力资源 社会保障行政部门作出不予 行政许可书面决定的,应当 说明理由,并告知申请人享 有依法申请行政复议或者提 起行政诉讼的权利QWheretheadministrativedepartmentofhumanresourcesandsocialsecuritymakesadecisiontograntanadministrativelicensewhentheconditionsaremet,ahumanresourcesservicepermitshallbeissuedtoandservedontheapplicantwithintendaysfromthedatewhenthedecisionismade;wheretheadministrativedepartmentofhumanresourcesandsocialsecuritymakesadecisiontodenyanadministrativelicensewhentheconditionsarenotmet,thereasonsshallbestated,andtheapplicantshallbeinformedoftherighttoapplyforadministrativereconsiderationortofileanadministrativelawsuitinaccordancewiththelaw.第九条经营性人力资 源服务机构开展人力资源供 求信息的收集和发布、就业 和创业指导、人力资源管理 咨询、人力资源测评、人力 资源培训、人力资源服务外 包等人力资源服务业务的, 应当自开展业务之日起15日 内向住所地人力资源社会保 障行政部门备案,备案事项 包括机构名称、法定代表Article 9 Whereanoperationalhumanresourcesserviceproviderprovidessuchhumanresourcesservicesascollectionanddistributionofsupplyanddemandinformationofhumanresources,guidanceforemploymentandbusinessstartup,humanresourcesmanagementandconsultation,humanresourcesassessment,humanresourcestraining,andhumanresourcesoutsourcingservices,itshallundergorecordationformalitieswiththeadministrativedepartmentofhumanresourcesandsocialsecuritywithin15daysaftertheservicesgetsstarted,withtherecordationmattersincludingits人、住所地、服务范围等。name,legalrepresentative,domicile,andscopeofservices.备案事项齐全的,人力资源 社会保障行政部门应当予以 备案,并出具备案凭证,载 明备案事项、备案机关以及 日期等;备案事项不齐全 的,人力资源社会保障行政 部门应当当场一次性告知需 要补正的全部事项。Wheretherecordationmattersarecomplete,theadministrativedepartmentofhumanresourcesandsocialsecurityshallgranttheapplicantrecordation,andissuetherecordationcertificate,indicatingtherecordationmatters,recordationorgan,anddate,amongothers;wheretherecordationmattersareincomplete,theadministrativedepartmentofhumanresourcesandsocialsecurityshallinformtheapplicantofallnecessarysupplementsandcorrectionsatonetimeonthespot.经营性人力资源服务机构开 展劳务派遣、对外劳务合作 业务的,执行国家有关劳务 派遣、对外劳务合作的规 定。Whereanoperationalhumanresourcesserviceproviderprovideslabordispatchandforeignlaborcooperationservices,itshallobservetheprovisionsofthestateonlabordispatchandforeignlaborcooperation.第十条依法取得的人 力资源服务许可证在全国范 围内长期有效。Article 10 Ahumanresourcesservicepermitobtainedinaccordancewiththelawshallbevalidforalongtimethroughoutthecountry.第十一条人力资源服 务许可证分为纸质证书 (正、副本)和电子证书, 具有同等法律效力。Article 11 Ahumanresourcesservicepermitshallbedividedintopapercertificates(originalandduplicate)andelectroniccertificates,bothofwhichhavethesamelegalforce.人力资源服务许可证纸质证 书样式、编号规则以及电子 证书标准由人力资源社会保 障部制定。ThestyleandnumberingrulesofpapercertificatesforhumanresourcesservicepermitsandthestandardsforelectroniccertificatesforhumanresourcesservicepermitsshallbedevelopedbytheMinistryofHumanResourcesandSocialSecurity.Article 12 Whereanoperationalhumanresourcesserviceprovidersetsupabranchoffice,itshall,within15daysaftertheregistrationofmarketparticipantsiscompleted,fileawrittenreportwiththeadministrativedepartmentofhumanresourcesandsocialsecurityoftheplacewherethebranchofficeisdomiciled,andthemattersreportedinwritingshallincludeitsnameandunifiedsocialcreditcode,theserialnumberofitspermit,aswellasthenameofthebranchoffice,thenameofitspersonincharge,theplaceofdomicile,andthescopeofservices,amongothers.第十二条 经营性人力 资源服务机构设立分支机构 的,应当自市场主体登记办 理完毕之日起15日内,书面 报告分支机构住所地人力资 源社会保障行政部门,书面 报告事项包括机构名称、统 一社会信用代码、许可证编 号以及分支机构名称、负责 人姓名、住所地、服务范围 等。Uponreceiptofthewrittenreport,theadministrativedepartmentofhumanresourcesandsocialsecurityshallissueareceipt,indicatingthenameofthewrittenreport,thenameofthebranchoffice,thenumberofpages,andthetimeofreceipt,amongothers,andaffixthesignatureorsealofthepersoninchargethereto.人力资源社会保障行政部门 收到书面报告后,应当出具 收据,载明书面报告的名 称、分支机构名称、页数以 及收到时间等,并由经办人 员签名或者盖章。Article 13 Whereanoperationalhumanresourcesserviceprovidermodifiesitsname,domicile,orlegalrepresentativeorterminatesitsbusinessactivities,itshall,within15daysaftertheregistrationmodificationorderegistrationformalitiesformarketparticipantsarecompleted,reportitinwritingtotheadministrativedepartmentofhumanresourcesandsocialsecurityatitsplaceofdomicile.Theadministrativedepartmentofhumanresourcesandsocialsecurityshallpromptlyreneworwithdrawthehumanresourcesservicepermitortherecordationcertificate.第十三条经营性人力 资源服务机构变更名称、住 所、法定代表人或者终止经 营活动的,应当自市场主体 变更登记或者注销登记办理 完毕之日起15日内,书面报 告住所地人力资源社会保障 行政部门。人力资源社会保 障行政部门应当及时换发或 者收回人力资源服务许可 证、备案凭证。经营性人力资源服务机构跨 管辖区域变更住所的,应当 书面报告迁入地人力资源社 会保障行政部门Q迁出地人 力资源社会保障行政部门应 当及时移交经营性人力资源 服务机构申请行政许可、办 理备案的原始材料。Whereanoperationalhumanresourcesserviceprovidermovesitsdomiciletoaplaceunderthejurisdictionofanotherregistrationorgan,itshallreportinwritingtotheadministrativedepartmentofhumanresourcesandsocialsecurityatitsnewplaceofdomicile.Theadministrativedepartmentofhumanresourcesandsocialsecurityatitsformerplaceofdomicileshallpromptlytransfertheoriginalmaterialsregardingtheapplicationforadministrativelicensingandrecordationtotheoperationalhumanresourcesserviceprovider.第十四条人力资源社 会保障行政部门应当公开申 请行政许可和办理备案的材 料目录、办事指南和咨询监 督电话等信息,优化办理流 程,推行当场办结、一次办 结、限时办结等制度,实现 集中办理、就近办理、网上 办理,提升经营性人力资源 服务机构申请行政许可、办 理备案便利化程度。Article 14 Theadministrativedepartmentofhumanresourcesandsocialsecurityshalldisclosetothepublicalistofapplicationmaterialsforadministrativelicensingandrecordationmaterials,guides,andtelephonenumbersforconsultationandsupervisionandotherinformation,optimizetherulesfortheregistrationofmarketentities,enhancetheefficiencyofregistrationofmarketentities,promoteon-siteprocessing,completionofhandlingatonetimeandwithinaspecifiedperiod,andotherrules,realizecentralizedprocessing,processingatthenearestoutlets,andonlineprocessing,andenhancethefacilitationforcommercialhumanresourcesserviceprovidersinapplyingforadministrativelicensingandundergoingrecordationformalities.Theadministrativedepartmentofhumanresources人力资源社会保障行政部门andsocialsecurityshallpromptlydisclosetothepublicalistofoperationalhumanresourcesserviceprovidersthathaveobtainedanadministrativelicenseorhaveundergonerecordationformalitiesinaccordancewiththelaw,aswellastheirmodificationandderegistration,andprovideinquiryservices.应当及时向社会公布依法取 得行政许可或者经过备案的 经营性人力资源服务机构名 单及其变更、注销等情况, 并提供查询服务。第三章服务规范ChapterIIIServiceSpecifications第十五条人力资源服 务机构接受用人单位委托招 聘人员的,发布招聘信息应 当真实、合法,不得含有民 族、种族、性别、宗教信仰 等方面的歧视性内容。人力资源服务机构不得违反 国家规定,在户籍、地域、 身份等方面设置限制人力资 源流动的条件。第十六条人力资源服 务机构接受用人单位委托招 聘人员的,应当建立招聘信 息管理制度,依法对用人单 位所提供材料的真实性、合 法性进行审查,并将相关审 查材料存档备核。审查内容Article 15 Whereahumanresourcesserviceproviderisentrustedbyanemployertorecruitstaff,therecruitmentinformationitpublishesmustbetrueandlegal,andshallnotcontainanydiscriminatorycontentintheaspectsofethnicstatus,race,gender,andreligiousbelief.Nohumanresourcesserviceprovidershallsetrestrictionsontheflowofhumanresourcesintermsofhouseholdregistration,geographiclocation,andidentityinviolationoftheprovisionsissuedbythestate.Article 16 Whereahumanresourcesserviceproviderisentrustedbyanemployertorecruitstaff,itshallestablisharecruitmentinformationmanagementsystemtoexaminetheauthenticityandlegalityofthematerialsprovidedbytheemployerinaccordancewiththelawanddeposittherelevantexaminedmaterialsinthearchivesforfurtherverification.Thecontentstobeexaminedshall include:应当包括以下方面:(一)用人单位招聘简章;(1) The employer's recruitment brochures;(2) The employer's business license or any approval document on their formation issued by a relevant department;(二)用人单位营业执照或 者有关部门批准设立的文 件;(3) The identification of the handling person and the letter of entrustment from the employer.(三)经办人员的身份证 件、用人单位的委托证明。The human resources service provider shall confirm the authorization relationship between the handling person and the employer through the enterprise's bank account or other means in accordance with the law.经办人员与用人单位的委托 关系,人力资源服务机构可 以依法通过企业银行结算账 户等途径确认。A human resources service provider which is entrusted by an employer o recruit foreign nationals shall comply with the provisions of the Provisions on the Employment Administration of Foreign Nationals in China and other laws, regulations, and rules.接受用人单位委托招聘外国 人的,应当符合外国人在 中国就业管理规定等法 律、法规、规章的规定。Article 17 No human resources service provider shall engage in the following conduct:第十七条人力资源服 务机构不得有下列行为:(1) Forging, altering, or transferring a human resources service permit;(一)伪造、涂改、转让人 力资源服务许可证;(2) Providing job intermediary services to any employer without a legal license;(二)为无合法证照的用人 单位提供职业中介服务;(3) Introducing any minor under the age of 16 for taking up an occupation;(三)介绍未满16周岁的未 成年人就业;(4) Providing job intermediary services for any worker without legal identification;(四)为无合法身份证件的 劳动者提供职业中介服务;(5) Introducing a worker to engage in occupation prohibited by laws and regulations;any (五)介绍劳动者从事法律、法规禁止从事的职业;(6) Introducing an employer or a worker to engage in any illegal activity;(六)介绍用人单位、劳动 者从事违法活动;(7) Carrying out related service activities by such means as fraud, violence, or coercion;(七)以欺诈、暴力、胁迫 等方式开展相关服务活动;(8) Seeking illicit benefits in the name of providing related services;(A)以开展相关服务为名 牟取不正当利益;(9) Acquiring social insurance fund expenditures or social insur
