1 (PurposesandBasis)WithaviewtoregulatingandfacilitatingtheconstructionandadministrationofthisMunicipality'sinformationinfrastructure,ensuringthesecurityofitsinformationinfrastructure,andpromotingthecomprehensivedigitaltransformationofeconomy,lifeandgovernance,theseProceduresareformulatedinaccordancewithrelevantlaws,rulesandregulations,andinthelightoftheactualcircumstancesofthisMunicipality.Article 2 (ScopeofApplication)TheseProceduresshallapplytotheplanning,construction,maintenance,protectionandsupervisionofinformationinfrastructurewithintheadministrativeareasofthisMunicipality.Wherelaws,rulesandregulationshavespecialprovisionsontheadministrationofrelevantinformationinfrastructure,suchprovisionsshallprevail.上海市信息基础设施管理办法(2023年1月19日上海市人 民政府令第75号公布 自 2023年3月1日起施行)第一条(目的和依据)为了规范和推进本市信息基础 设施建设和管理,保障信息基 础设施安全,推动经济、生 活、治理全面数字化转型,根 据有关法律法规,结合本市实 际,制定本办法。第二条(适用范围)本市行政区域内信息基础设施 的规划、建设、维护、保护和 监督等活动,适用本办法。法 律、法规、规章对于相关信息 基础设施管理有特别规定的, 从其规定。本办法所称信息基础设施,包 括为社会公众提供通信服务、 广播电视服务以及数据感知、 传输、存储和运算等信息服务 (以下统称通信和信息服务)的设备、线路和其他配套设ForthepurposesoftheseProcedures,“informationInfrastructurenincludesequipment,linesandothersupportingfacilitiesthatprovidecommunicationservices,radioandtelevisionservices,andinformationservicessuchasdatasensing,transmission,storageandcalculation(hereinaftercollectivelyreferredtoas“communicationandinformationservicesn)forthepublic.Themunicipaldepartmentofeconomyandinformatizationshall,togetherwiththemunicipaldepartmentsofcommunicationsadministration,andradioandtelevision,andotherrelateddepartments,compilealistofinformationinfrastructureandupdateitinatimelymanner.Article 3 (FundamentalPrinciplesandRequirements)Theconstructionandadministrationofinformationinfrastructureshalladheretotheprinciplesofoverallplanning,intensiveconstruction,resourcesharingandstandardizedmanagement.ThisMunicipalityprotectsitsinformationinfrastructureinaccordancewiththelaw.Nounitorindividualmayobstructtheconstruction,maintenanceandmanagementofinformationinfrastructureinaccordancewiththelaw,engageinactivitiesthatillegallyintrude,interferewithordestroyinformationinfrastructure,orendangerthesecurityofinformationinfrastructure.Article 4 (GovernmentalDuties)Themunicipalanddistrictpeople'sgovernmentsshallincorporatethedevelopmentofinformationinfrastructureintotheirplansfornationaleconomicandsocialdevelopment,andsolvemajorproblemsinvolvinginformationinfrastructurethroughoverallplanningandcoordination.施。市经济信息化部门应当会 同市通信管理、广播电视等部 门编制信息基础设施名录,并 适时更新°第三条(基本原则和要 求)信息基础设施建设与管理工作 应当坚持统一规划、集约建 设、资源共享、规范管理的原 则。本市依法保护信息基础设施。 任何单位和个人不得阻碍依法 进行的信息基础设施建设和维 护管理,不得实施非法侵入、 干扰、破坏信息基础设施的活 动,不得危害信息基础设施安 全。第四条(政府职责)市、区人民政府应当将信息基 础设施的发展纳入国民经济和 社会发展规划,统筹协调解决 涉及信息基础设施的重大问 题。乡镇人民政府、街道办事处配合协调信息基础设施建设、保Town/townshippeople'sgovernmentsandsubdistrictofficesshallcooperateandcoordinatetheconstructionandprotectionofinformationinfrastructureandotherrelatedwork.Article 5 (DepartmentalDuties)Thedepartmentofeconomyandinformatizationshallberesponsibleforthecoordinationandpromotionofinformationinfrastructureaswellasrelevantsupervisionandadministrationwithinitsadministrativearea.Thedepartmentsofcommunicationsadministration,andradioandtelevisionshallberesponsibleforthesupervisionandadministrationofinformationinfrastructureintheirrespectivefieldsofcommunicationsandradioandtelevision.Thedepartmentsofdevelopment&reform,planningandresources,housingandurban-ruraldevelopmentadministration,transportation,water(ocean),ecologyandenvironment,andpublicsecurity,andotherrelateddepartmentsshall,pursuanttotheirrespectivefunctionsandduties,performtheirpartsintheadministrationofinformationinfrastructure.Article 6 (SubjectDuties)Informationinfrastructureoperatorsshall,incompliancewiththerequirementsandstandardsprescribedbytheStateandthisMunicipality,assumethemainresponsibilityfortheconstruction,maintenanceandprotectionofinformationinfrastructure,andprovidecommunicationandinformationservicesthatmeettherequirements.护等相关工作。第五条(部门职责)经济信息化部门负责本行政区 域内信息基础设施的协调推进 以及相关监督管理工作。通信管理、广播电视部门分别 负责通信、广播电视领域信息 基础设施的监督管理工作。发展改革、规划资源、住房城 乡建设管理、交通、水务(海 洋)、生杰环境、公安等部门 按照各自职责,做好信息基础 设施相关管理工作。第六条(主体责任)信息基础设施运营者应当按照 国家和本市规定的要求和标 准,承担信息基础设施的建 设、维护、保护主体责任,提 供符合要求的通信和信息服 务。信息基础设施运营者应当根据Informationinfrastructureoperatorsshall,basedontheneedsofeconomicdevelopmentandpeople,slivelihood,graduallybuildandprovidecompleteinformationinfrastructure,improvenetworkconditions,andenhancethequalityofpubliccommunicationandinformationservices.Article 7 (PublicityandEducation)Thedepartmentofeconomyandinformatizationshall,togetherwithsuchdepartmentsascommunicationsadministration,radioandtelevision,scienceandtechnology,andeducation,organizeactivitiesforthepopularizationofinformationinfrastructureknowledgeandpublicizerelevantlaws,rulesandregulationstoraisethepublic'sconsciousnessofprotectinginformationinfrastructure.Radiostations,televisionstations,thepress,newswebsites,andothersshall,inaccordancewithrelevantprovisions,carryoutnonprofitpublicityontheprotectionofinformationinfrastructure.Article 8 (RegionalCooperationintheYangtzeRiverDelta)经济建设和群众生活需要,逐 步建设完善信息基础设施,改 善网络条件,提升公共通信和 信息服务质量。第七条 (宣传教育)经济信息化部门应当会同通信 管理、广播电视、科技、教育 等部门组织开展信息基础设施 科普活动,宣传相关法律、法 规、规章,提高社会公众保护 信息基础设施的自觉性。广播电台、电视台、报刊、新 闻网站等应当按照有关规定, 开展信息基础设施保护的公益 宣传。第八条(长三角合作)本市推进长江三角洲区域信息 基础设施一体化建设,共同构 建新一代信息基础设施,推动 设施互联互通,加强设施保护 的会商和信息共享,完善应急 联动、执法协助等工作机制, 为长三角一体化高质量发展提 供支撑。ThisMunicipalityshalladvancetheintegrateddevelopmentofinformationinfrastructureintheYangtzeRiverDeltaregionandjointlybuildanewgenerationofinformationinfrastructure,promotetheinterconnectionoffacilities,strengthentheconsultationmechanismandinformationsharingonfacilityprotection,andimprovesuchworkingmechanismsasjointemergencyresponseandlawenforcementassistance,soastoprovidesupportfortheintegratedhigh-qualitydevelopmentoftheYangtzeRiverDelta.Article 9 (DevelopmentPlan)Themunicipaldepartmentofeconomyandinformatizationshall,togetherwiththemunicipaldepartmentsofcommunicationsadministration,andradioandtelevision,andotherrelateddepartments,organizetheformulationofthedevelopmentplanfortheMunicipality'sinformationinfrastructureinlinewiththerelevantplanfornationalinformationtechnologydevelopmentandtheplanforthisMunicipality'snationaleconomicandsocialdevelopment,andpromulgateandimplementitincompliancewithrelevantrequirements.第九条(发展规划)市经济信息化部门应当会同市 通信管理、广播电视等部门根 据国家信息化发展相关规划、 本市国民经济和社会发展规划 等,组织编制本市信息基础设 施发展规划,并按照相关要求 发布实施。信息基础设施发展规划应当体 现信息技术和产业发展趋势, 统筹各类信息基础设施合理布 局与协调发展。Thedevelopmentplanforinformationinfrastructureshallreflectthedevelopmenttrendofinformationtechnologyandindustry,andworktopursuereasonablelayoutandcoordinateddevelopmentofalltypesofinformationinfrastructure.Article 10 (SpecialPlan)第十条(专项规划)本市信息基础设施相关领域的 专项规划,由市经济信息化、 通信管理、广播电视等部门会 同市规划资源等部门组织编 制。专项规划应当符合本市信 息基础设施发展规划的要求, 统筹信息基础设施的建设和空 间利用需求,经批准后纳入相 应的国土空间规划。ThespecialplanofthisMunicipalityforrelatedfieldsofinformationinfrastructureshallbeformulatedbythemunicipaldepartmentsofeconomyandinformatization,communicationsadministration,andradioandtelevision,andotherrelateddepartments,togetherwiththedepartmentofplanningandresources,andotherrelateddepartments.ThespecialplanshallconformtotherequirementsofthisMunicipality'sdevelopmentplanforinformationinfrastructure,ensurebettercoordinationinmeetingthedemandforconstructionandspaceutilizationofinformationinfrastructure,andshallbeincorporatedintothecorrespondingnationalterritoryspatialplanninguponapproval.以出让方式提供国有土地使用 权的,规划资源部门应当根据 控制性详细规划,将信息基础 设施有关内容纳入规划条件, 作为国有土地使用权出让合同 的组成部分。Wheretherighttotheuseofstate-ownedlandisprovidedbymeansoftransfer,thedepartmentofplanningandresourcesshall,inlinewiththeregulatoryplans,incorporatethecontentrelatedtoinformationinfrastructureintotheplanningconditionsasanintegralpartofthecontractforthetransferoftherighttotheuseofstate-ownedland.第十一条 (建设和设置 的总体要求)Article 11 (GeneralRequirementsforConstructionandSetups)信息基础设施的建设和设置应 当符合信息基础设施专项规 划,并按照有关规定办理审批 等手续。Theconstructionandsetupsofinformationinfrastructureshallconformtothespecialplanforinformationinfrastructure,andgothroughsuchformalitiesasexaminationandapprovalinaccordancewithrelevantprovisions.在同等条件下,信息基础设施 应当优先利用公共建筑物或者 道路综合杆、路灯杆、高架道 路、龙门架、道路指示牌、公 交候车亭、公用电话亭等公共 设施设置。第十二条(共建共享)Underthesameconditions,thesetupofinformationinfrastructureshallgiveprioritytoutilizingpublicbuildingsorsuchpublicfacilitiesasroadintegratedpoles,roadlightpoles,elevatedhighways,gantries,roadsigns,busshelters,andpublicphonebooths.Article 12 (JointConstructionandSharing)本市推进信息基础设施共建共 享。市经济信息化、通信管 理、广播电视等部门应当按照 各自职责,组织协调信息基础 设施共建共享。ThisMunicipalityshallpromotejointconstructionandsharingofinformationinfrastructure.Themunicipaldepartmentsofeconomyandinformatization,communicationsadministration,andradioandtelevision,andotherrelateddepartmentsshall,pursuanttotheirrespectivefunctionsandduties,organizeandcoordinatethejointconstructionandsharingofinformationinfrastructure.信息基础设施运营者需要新建 信息基础设施的,在技术可 行、安全可控的情况下,应当 优先共享利用已经建成的信息 基础设施;不具备共享条件 的,应当按照有关规定进行共 建OWhereinformationinfrastructureoperatorsneedtobuildnewinformationinfrastructure,theyshallgiveprioritytosharingandutilizinginformationinfrastructurealreadybuiltifitistechnicallyfeasible,safeandcontrollable;whereconditionsforsharingarenotmet,jointconstructionshallbecarriedoutinaccordancewithrelevantprovisions.第十三条 (配套建设)Article 13 (SupportingConstruction)新建、改建、扩建建设工程, 建设单位应当根据规划条件和 相关标准,配套设置机房、基 站等信息基础设施,并保障用 电等的需求。施工图审查机构 在审查建设工程施工图设计文 件时,应当按照法律、法规和 强制性标准进行审查,并根据 住房城乡建设管理等部门的指 导,落实信息基础设施建设的 有关要求。Fornewconstruction,reconstructionorexpansionprojects,thedevelopmentunitshall,incompliancewiththeplanningconditionsandrelevantstandards,setupsuchsupportinginformationinfrastructureasnetservercentersandtelecombasestations,andsecuresufficientpowersupply.Whenexaminingtheconstructiondrawingdocumentsofconstructionprojects,therelevantexaminationinstitutionsshallconducttheexaminationinaccordancewithlaws,rules,regulationsandmandatorystandards,andimplementrelevantrequirementsforinformationinfrastructureconstructionundertheguidanceofthedepartmentofhousingandurban-ruraldevelopmentadministrationandotherrelateddepartments.配套信息基础设施应当与建设 工程同步设计、同步施工。建 设工程竣工后,应当按照国家 和本市有关标准和要求开展验 收QThesupportinginformationinfrastructureshallbedesignedandconstructedsimultaneouslywiththeconstructionprojects.Aftercompletion,theseconstructionprojectsshallbeinspectedandacceptedincompliancewithrelevantstandardsandrequirementsoftheStateandthisMunicipality.配套信息基础设施的相关费用 纳入工程概算、预算。Theexpensesrelatedtosupportinginformationinfrastructureshallbeincludedintheprojectestimateandbudget.Article 14 (StandardizedDevelopmentofCenters)Data第十四条(数据中心规 范发展)Themunicipaldepartmentofeconomyandinformatizationshall,togetherwiththedepartmentsofdevelopment&reform,andcommunicationsadministration,andotherrelateddepartments,coordinateandpromotetheconstructionandupgradingofdatacenters,guidethecoordinatedconstructionofedgecomputingresourcespoolnodewithpowersubstationsorotherfacilities,improveenergyutilizationefficiency,andfacilitateanewdevelopmentparadigmofdatacentersfeaturingreasonablelayout,advancedtechnology,greenandlow-carbondevelopment,inwhichthescaleofcomputingpoweriscommensuratewiththegrowthofdigitaleconomy.市经济信息化部门应当会同市 发展改革、通信管理等部门统 筹推动数据中心建设和改造升 级,引导边缘计算资源池节点 与变电站等设施协同建设,提 高能源利用效率,推动形成布 局合理、技术先进、绿色低 碳、算力规模与数字经济增长 相适应的新型数据中心发展格 局°鼓励数据中心参与算力调度, 提高闲置算力使用效率,提升 数据中心整体利用率。市经济 信息化部门应当对数据中心进 行节能监察。Article 15 (Development of IoT Sensing Facilities)第十五条施发展)(物联感知设Datacentersareencouragedtoparticipateintheschedulingofcomputingpowertoimprovetheutilizationefficiencyofidlecomputingpowerandtheoverallutilizationofdatacenters.Themunicipaldepartmentofeconomyandinformatizationshallexercisesupervisionovertheenergyconservationofdatacenters.本市推进公共领域物联感知设 施建设,构建感知网络,提升 工业、农业、商贸流通、交通 能源、公共安全、城市管理、 安全生产等领域的数字化水 平。市经济信息化、通信管理、交ThisMunicipalityshallpromotetheconstructionofIoTsensingfacilitiesinpublicareas,buildsensornetworks,andimprovethedigitalizationlevelinsuchfieldsasindustry,agriculture,commercialcirculation,transportationandenergy,publicsecurity,urbanmanagement,andproductionsafety.Themunicipaldepartmentsofeconomyandinformatization,communicationsadministration,andtransportation,andotherrelateddepartmentsshall,pursuanttotheirrespectivefunctionsandduties,coordinateandpromotetheinformatization,intelligentandstandardizedconstructionofroadinfrastructure,guideenterprisestorationallylayoutIoTsensingfacilities,andsupportthedevelopmentofintelligentconnectedautomobileandotherindustries.通等部门按照各自职责统筹推进道路基础设施的信息化、智能化和标准化建设,引导企业合理布局物联感知设施,支持智能网联汽车等产业发展。Article16(OpeningofResourcesinPublic第十六条Places)源开放)(公共场所资Wheneveritisnecessarytosetupinformationinfrastructureinthefollowingplaces,theinformationinfrastructureoperatorshallinformrelevantunitsinwritinginadvance,andtherelevantunitsshallopentheirbuildings,ancillaryfacilitiesandotherresourcesandprovidenecessaryconveniences,unlessotherwiseprovidedbylaws,rulesandregulations:需要在下列场所设置信息基础设施的,信息基础设施运营者应当事先书面告知相关单位,相关单位应当开放其建筑物以及附属设施等资源,并提供必要的便利,但法律、法规另有规定的除外:1.theofficepremisesofstateorgans,publicinstitutionsandotherstate-fundedinstitutions;(一)国家机关、事业单位等公共机构的办公场所;2.transportinfrastructuresuchasrailwaystations,airports,ports,highways,roads,railways,bridges,tunnelsandurbanrailtransit;and、施路道设)车站、机场、港口、公道路、铁路、桥梁、隧城市轨道交通等交通基础3.hospitals,exhibitionhalls,touristattractions,publicgreenspacesandotherpublicplacesheldwithstate-ownedassets.(三)利用国有资产举办的医院、展馆、旅游景区和公共绿地等公共场所。Article17(SignalCoverageandEqualAccess)第十七条(信号覆盖与平等接入)基础电信业务经营者应当按照 国家和本市的要求设置信息基 础设施,实现住宅小区、商务 楼宇等建筑室内、室外公共区 域、电梯、楼梯、地下空间等 的信号覆盖。Operatorsofbasictelecommunicationsservicesshall,incompliancewiththerequirementsoftheStateandthisMunicipality,setupinformationinfrastructuretoachievesignalcoverageofindoorandoutdoorpublicareas,elevators,stairsandundergroundspacesofresidentialcommunities,commercialbuildingsandotherbuil
