保险单据（二）,-保险单（Insurance Policy),主要内容,一、保险单的缮制二、保险单的背书转让三、保险索赔,教学目标与要求,掌握保险单的缮制了解保险单的背书转让了解保险索赔的相关程序,一、保险单的缮制,保险人（NAME OF INSURANCE COMPANY）填写承保此批货物的保险公司的名称。通常各保险公司会在自己公司的保险单上印制好本公司抬头。实务中应根据信用证和合同要求到相应的保险公司办理保险。如信用证中规定“Insurance Policy/Certificate by PICC”，则该保险单只能由中国人民保险公司出具。,保险单据名称（Name/Title）,1.依照信用证和合同填写。2.UCP600规定：暂保单将不被接受-Cover notes will not be accepted.3.UCP600规定：可以接受保险单代替保险证明书或预约保险项下的保险声明。-An insurance policy is acceptable in lieu of an insurance certificate or a declaration under an open cover.,Insurance Policy/Certificate In TriplicateInsurance Policy In Two Originals,（一）发票号码（Invoice No.）,填写同笔交易中的发票号。,（二）保险单号（Policy No.）,此处为保险公司提供的保险单号。,（三）被保险人（Insured）,1.托收方式下，填写出口商。2.信用证支付方式下，按相关规定办理。（1）如果信用证或合同对于被保险人没有明确规定，填写信用证的受益人，也就是出口商的名称（无须注明地址）。（2）如信用证规定：Insurance policy to order of xxx bank,Insurance policy in favor of yyy bank,则在被保险人栏目填写：xxx（出口公司名称）held to order of xxx bank;xxx（出口公司名称）in favor of yyy bank 同时出口商要在保险单背面进行背书。,（3）如果信用证规定某一特定方为被保险人，则可以在此栏直接填写该指定方，同时出口商不用背书。,Insurance policies or certificate,name of assured to be showed:ABC Co.,Ltd.,（4）如信用证中关于保险单规定为：Endorsed to the order of xxx bank则在Insured 栏目，要填写出口商的名称同时在保险单背面进行记名指示背书。,SDUT PAY TO THE ORDER OF xxx BANK,（5）如果信用证中关于被保险人的规定为：to order 则在 Insured XX,（7）FOB、CFR、FCA、CPT条件下，如进口商委托我出口商办理保险：在汇付、托收方式下：Insured栏目 填 出口商 信用证支付方式下：填 xx on behalf of yy,出口商,进口商,（8）若信用证中规定：Documents required:Insurance Policy to order of whom it may concern covering marine transportation all risks,war risks as per CIC clauses d.d.1/1/1981则Insured 栏目填写：to order of whom it may concern 出口商不用对保单进行背书。,（9）国外来证规定：insurancepolicyorcertificatefortenpctaboveCIFinvoicevaluepayableto the orderofbankofCeylon？,在Insured 栏目，填写信用证受益人的名称。同时，信用证受益人要在保单背面加盖公司章作空白背书最后，在保险单Claim payable at 栏目，填写 赔付地名 后再加注 payable to the order of bank of Ceylon,（四）保险货物说明（Description of Goods）,1.与提单相同，填写货物的总称即可。2.一般还要加写最大包装件的加总数。3.如信用证或合同中有特殊要求，如在所有单据上注明信用证号码及开证日期与开证行，或加注合同号，则在此栏空白处作相应加注。,（五）包装、单位及数量（Packing Unit Quantity）,1.与提单相同，填写最大包装总件数及包装种类。2.裸装货物填写货物本身件数。3.散装货物填写货物净重。4.有包装但是以重量计价的应该同时填写总件数和计价总重量。,（六）保险金额（Amount Insured）,1.按信用证或合同规定的金额及加成率填写。2.如无具体规定，则按CIF或CIP或发票金额加一成；3.“进一取整”原则：USD1199.99与 USD1199.01 均为USD1200.004.人保公司不接受保额超过发票总值30%的保单；5.货币单位应与信用证的货币一致，至少按信用证要求的金额出具；6.如发票已扣佣或扣折扣，按扣前的发票毛值投保。,Documents required:Insurance Policy/Certificate endorsed in blank covering marine transportation all USD121,000.00,（七）承保险别（Conditions）,1.以“Covering”开头。2.不仅要注明所投保的险别还要写明适用的文本及日期。3.常用保险条款及生效日期 ICC 1/1/1982 CIC 1/1/19814.险别：,中国保险条款海上货运保险险别,按照中国人民保险公司1981年1月1日海运货物保险条款和海运货物战争险条款承保一切险和战争险。,（1）Covering All Risks and War Risks as per Ocean Marine Cargo Clauses&Ocean Marine Cargo War Risks Clauses of The Peoples Insurance Company of China dated 1/1/1981.,（2）Covering Marine Risks Clause(A)as per Institute Cargo Clause(A)dated 1/1/1982.,按照伦敦协会1982年1月1日货物A条款承保海运险A条款。在实际业务中可采用缩略形式：PICC;CIC;dd;ICC;&OMCC等。,5.出口公司只需要在副本上填写。6.应该严格按照信用证规定的险别来填写。7.如果信用证规定的险别超出了合同规定，那么出口商可以拒绝，然后要求进口商改证；或者先和进口商商定，如果多出的保险费买方另行支付，那么出口商可以接受，然后按照信用证规定的险别去投保。,（八）货物标记（Marks of Goods）,1.与提单相同，填写唛头或者写“as per invoice no.XXX”2.但是信用证规定所有单据必须显示唛头的则必须按照实际唛头填写。,（九）总保险金额(Total Amount Insured:）,填写大写保险金额:计价货币的大写+数值的大写+only,（十）保费（Premium）,1.保险公司一般在印刷的保险单上填入“as arranged”，无需填写。2.但信用证另有规定者除外，如Insurance policy endorsed in blank for full invoice value plus 10%marked premium paid此时要把已经印好的 as arranged 删去，加盖校对章后打上paid,（十一）装载工具（per conveyance S.S.）,1.填写运输工具名称。2.如为海运，则根据配舱回单填装运船的船名。如果是两程运输完成时，要分别填写一程船名和二程船名。例如：Dawnstar/Flyingcloud,（十二）开航日期（Slg.On or abt.）,1.一般填写提单的签发日期。2.也可填提单签发日前后5天之内的任何一天的日期。3.也可直接填写 AS PER B/L。,（十三）装运港（From）,UCP600规定:保险单据须表明承保的风险区间至少涵盖从信用证规定的货物接管地或发运地开始到卸货地或最终目的地为止。,iii.The insurance document must indicate that risks are covered at least between the place of taking in charge or shipment and the place of discharge or final destination as stated in the credit.,（十四）目的港（to）,1.不需要转运的货物，则直接填写目的港。2.如果货物是经转船到达目的港的，则填写“目的港+W/T（VIA）转运港”。3.如果到达目的港之后须转运内陆某地买方仓库，例如到达目的港西雅图之后转运芝加哥，保险单目的港可填写 Seattle AND THENCE TO CHICAGO”,（十五）保险单的份数,1.若保险单表明有多份正本，全部提交。2.如信用证没有特别说明保单份数，出口公司一般提交一套完整的保险单（一份正本“original”,一份复联“duplicate”）。3.中国人民保险公司出具的保险单一套五份，由一份正本“original”、一份复联“duplicate”与三份副本“copy”构成。,4.当来证要求：Insurance policies or certificate in two fold/in duplicate/in 2 copies制单结汇时应提交一份正本“original”,一份复联“duplicate”5.注意保单份数需要在两处进行填写。,（十六）赔款偿付地点（claim payable at）,1.如来证无特别规定，一般将目的地作为赔付地点，一般填写目的港的名称。2.但是信用证有明确规定时，严格按照信用证的规定填写（即使信用证将目的国作为赔付地，也应该如实填写目的国）3.有的情况下，须在填写完该栏后，按照要求 填写 payable to xxxx 4.此栏还应加注赔款支付币种，用In 作引导词，所用币种一般为与投保额相同的币种。5.如信用证要求注明理赔代理人，则在此栏上方空白处注明相应代理人。,Insurance policies or certificate in two fold issued to the applicant,covering risks as per institute cargo clauses(A),and institute war agent in Germany.,（十七）日期（Date）,1.填写保险单的签发日期。2.根据W/W条款，保险手续应该在货物离开出口方仓库前办理。因此保险单的日期应该是货物离开出口商仓库前的日期。3.UCP600明确规定：保险单据的日期不得晚于装运日期，除非保险单据表明保险责任不迟于装运日生效。,e.The date of the insurance document must be no shipment.,（十八）投保地点（at）,填写投保地点名称，一般填写装运港的名称。,（十九）保险人签字盖章,1.加盖保险公司的公章并由保险公司授权签字人签字。2.根据英国法律规定，海上保险公司出具的保险单可只盖图章。3.UCP600规定：保险单据，例如保险单，保险凭证或预约保险项下的保险声明，必须看似由保险公司或承保人或其代理人或代表出具并签署。如果保险单据表明其以多份正本出具，则所有正本均须提交。,UCP600,Article 28 Insurance Document and Coverage a.An insurance document,such as an insurance policy,an insurance certificate or a declaration under an open cover,must appear to be issued and signed by an insurance company,an underwriter or their agents or their proxies.Any signature by an agent or proxy must indicate whether the agent or proxy has signed for or on behalf of the insurance company or underwriter.b.When the insurance document indicates that it has been issued in more than one original,all originals must be presented.,二、保险单的背书,（一）空白背书1.在保险单的背面注明出口公司的名称和经办人的名字即可。2.如来证没有规定使用哪种背书方式，默示规定为空白背书方式。,（二）记名背书,1.如来证规定：则在保险单背面盖上出口公司的章以及注明经办人的名字后，根据信用证的要求，填写记名背的后手不可再背书转让。,Insurance policy delivered to Citibank,New xxx”，然后盖上出口公司的章。,Insurance policy or certificate is negotiable for issued to the order of xxx,（四）背书的特殊情况,1.当出口商代进口商投保，并且保险单上的被保险人是进口商，那么出口商不能背书，如需转让保单，只能由进口商背书。2.当被保险人为第三方时，该保险单不用背书即可转让。,信用证中保险单条款举例：,Insurance policies or certificate,name of assured to be showed:ABC Co.,Ltd.,Insurance packing.,三、保险索赔,1.收货方发现货损后，应及时通知保险公司在目的港的代理人勘查现场，并请第三方检验机构进行检验，同时要求承运人或货代公司签发损坏货物证明或短装记录或货物残损清单；若是集装箱破损，应要求理货公司出具损失/破损报告副本，并采取保留破损的铅封等相应措施。2.保险公司勘查代理人出具检验报告，收货方提交索赔单证，勘查代理人把相关材料发回到国内保险公司。3.国内的保险公司进行理赔。,小结,1.如果来证无其他规定，保险单的被保险人应该是信用证上的受益人，并用空白背书形式。2.保险险别和保险金额要与来证的规定相符。保险单上的运输标志、包装及数量、货名、船名、大约开航日期、装运港和目的港等要与提单一致。3.保险单的签发日期不能晚于提单日期。4.不能使用保险经纪人开出的暂保单代替保险单去银行议付，银行是不会接受的。,
